Terms and Conditions

Information on how to enter and prizes form part of these Terms and Conditions. By entering the Competition, you agree to be bound by these Terms and Conditions. All entries must comply with these conditions to be valid.

Entry:

The Competition commences on Tuesday 11 June 2019 and ends at 11.59pm AEST on Sunday 7 July 2019 (“Entry Period”). The Organiser reserves the right to alter the Entry Period without notice if impacted by unforeseen scheduling changes.

Entry is open to everyone aged 18 years or over. However, entry to the prize draw is only open to Australian residents aged 18 years or over.  You may only enter once.

Employees of the Organiser and their immediate family and other persons associated with the Competition are ineligible to enter.

To submit a valid entry into the Competition: You must, during the Entry Period, go to the Competition Website and follow the entry instructions, including:- providing your first name, last name, email address, your answer to the Competition Question ‘What do you love most about patchwork’, and selecting which project you like best from each category. You may only pick one nominee in each category.

Any entrant who has not answered the Competition Question will be disqualified from Competition entry.

Incomplete, indecipherable or illegible entries will be deemed invalid.

Entrants confirm and promise that their entry is their own original work and does not infringe the intellectual property rights of any third party.

When you submit a valid entry, you will automatically be entered into the Competition.

The Organiser reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process, including by: (a) corrupting or attempting to corrupt the administration, security, fairness, integrity or proper conduct of the entry mechanism or process (including a Website entry mechanism); or (b) using an automated process to submit an entry or entries. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights. Any entry that the Organiser deems otherwise inappropriate will be ineligible and will be discarded.

Entries must be received by the Organiser during the Entry Period. Entries received after the end date will not count towards the competition.

The Organiser accepts no responsibility for any entries not received by the Organiser or delays in the delivery of entries due to any reason whatsoever. An entry will only be counted as being received once it has been received by the Organiser and not when it was sent. The Organiser accepts no responsibility for late, lost or misdirected entries.

Access to the entry form on the Website may be limited on some mobile, tablet and other portable devices. It is your responsibility to check the functionality of the entry form on your device prior to entering. The Organiser accepts no responsibility for any technical issues that result in the failure of the functionality of the entry form or Website or for any inability to access the Website at the time you intend on doing so.

Any costs associated with entering and accessing the Competition Website, including data costs are the entrant’s responsibility and is dependent on the Internet service provider used.

Judging and awarding of prizes:

This Competition is a game of skill. Chance plays no part in determining the winner. All entries will be judged individually on their merits based on originality and creativity.

The judging and awarding of the prizes will take place at the Organisers premises in North Ryde between Monday 8 July 2019 and Wednesday 10 July 2019.

For the judging, the Organiser will select a judging panel to read the entries to the Competition Question and based on the quality of the entry determine the winner from valid entries. The team will also select the second prize winner and runner up prize winners from valid entries.

The best valid entry, as determined by the judges will win the following prize: $1,000 cash paid by cheque.

The second-best valid entry, as determined by the judges will win the following prize: A Brother Innov-is NV1800Q sewing machine valued at $1,799.

The next five runner up valid entries, as determined by the judges will win the following prize: One of five 12-month subscriptions to Quilters Companion magazine.

The winners will be notified with details on how to redeem their prize by email within 7 business days of the judging day using the email address provided with their entry. The winner’s names may be published in an issue of Quilters Companion following the competition and on the Quilters Companion social media accounts.

If for any reason a winner does not redeem the prize or an element of the prize by the time stipulated by the Organiser, then the prize or that element of the prize will be forfeited.

The winners must take the prizes as offered. The prizes, or any unused portion of the prizes, is not transferable or exchangeable and cannot be redeemed as cash. The prizes cannot be used in conjunction with any other special offer.

If requested by the Organiser, the winners hereby agree to be interviewed, photographed and filmed at a time determined by the Organise for a feature on this promotion to be developed for the Quilters Companion magazine and its associated website or social media pages (or any other form of media the Organiser deems suitable) without further remuneration or reference to the winner. The creation or use of any such feature (including but not limited to creative control of the feature) is at the discretion of the Organiser. The winners consent to the Organiser using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition, and promoting any products manufactured, distributed and/or supplied by the Organiser.

If the prizes, or part of the prizes, are unavailable, the Organiser, in it’s discretion, reserves the right to substitute the prize, or part of the prize, with an alternative prize to substantially the same recommended retail value and/or specification.

The Organiser is neither responsible nor liable for any loss or damage suffered in the event that a prize is not delivered on time, late or changed for any reason.

As a condition of accepting the prizes, the winners may be required to sign any legal documentation as and in the form required by the Organiser and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

The Prizes:

The prizes will be delivered to the nominated address of the winner, provided that address is in Australia. The Organiser is not responsible or liable for any delay or failure in delivery of the prizes by a third party or for any damaged caused to the prizes during delivery.

The prizes are subject to the standard terms and conditions of individual prizes and service providers.

General:

The Organiser’s decision in relation to all aspects of the Competition is final and no correspondence will be entered into.

In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Organiser may cancel, terminate, modify or suspend the Competition.

If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organiser, the Organiser  reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

The Organiser reserves the right to keep all competition details confidential.

You acknowledge that the political, professional and personal views of the nominees for the Quilters Companion Hall of Fame are in no way a reflection of the Organiser’s views.

You acknowledge that the Organiser may disqualify any nominee for a Quilters Companion Hall of Fame and that, in such circumstances, any vote by you for that nominee will be forfeited.

Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act or similar applicable laws (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Organiser (including its officers, employees and agents) excludes all liability (including negligence) for any: (a) personal injury arising in any way out of the Competition; or (b) any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of: (i) the Competition; (ii) any technical difficulties or equipment malfunction (whether or not under the Organiser’s control); (iii) any theft, unauthorised access or third party interference; (iv) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Organiser) due to any reason beyond the reasonable control of the Organiser; (v) any variation in prize value to that stated in these terms and conditions; (vi) any tax liability incurred by a winner or entrant; or (vii) use of the prize.

Subject to the Non-Excludable Guarantees, the Organiser makes no representations or warranty as to the quality, suitability or merchantability of any of the goods or services offered as a prize.

The Organiser collects personal information (“PI”) to conduct the Competition and may disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to regulatory authorities. It does so directly and through the entry form and entry in the Competition is conditional on providing this PI. The Organiser will also use and handle PI as set out in its privacy policy, which is available at XXX. In addition to any use that may be outlined in the Organiser’s privacy policy, the Organiser may also, for an indefinite period, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to you. You should direct any request to opt out, access, update or correct PI to the Organiser and direct any complaints regarding treatment of you PI as set out in the Organiser’s privacy policy. All entries, including any associated PI, become the property of the Organiser.
