Information on how to enter and the prize(s) forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over.
Employees (and their immediate families) of the Promoter, participating HOYTS Cinemas and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 12:01am AEDT on Tuesday 3 November 2020 and final entries close at 23:59pm AEDT on Friday 18 December 2020 (“Promotional Period”).
To be eligible to enter, eligible individuals must, during the Promotional Period, complete the following steps:
Make a private group booking for “THE CROODS: A NEW AGE” for 30 or more students.
Visit hoyts.com.au/competitions follow the prompts to the promotion entry page; and fully complete and submit the online entry form with their personal details and booking reference number (i.e. first name, last name, date of birth, email address, mobile number and State/Territory of residence, booking reference number) and provide an answer to the question: If your class could travel back to any time in history, when/where would it be? Explain In [25] words or less for your chance to win! (“Promotional Response”).

Only one (1) entry is per permitted per booking.

Winning Method: Judging
Prize Conditions: No part of this prize may be extended, transferred, exchangeable, redeemable for any other prize or transferable. Under no circumstances will Hoyts pay the prize to an individual’s bank account. The winner must provide a signed statement from the school principal as to what legal entity the prize is to be paid into and any bank account details provided must match this entity name.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Entrants must retain their purchase receipt(s)/reference number(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.
A winner will be determined by representatives of The HOYTS Corporation, Level 50, 680 George Street, Sydney, NSW 2000 on Monday 18 January 2020. Each entry will be judged on the basis of the individual creative merit of the answer to the Promotional Response. The best valid entry, as determined by the judges, will win the prize for their classroom specified in the above clause 6. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry, ineligible entrant, non-contactable entrant or unclaimed prize. The winner will be determined by skill. Chance plays no part in determining the winner. The judges' decision is final and binding and no correspondence will be entered into. The winner will be contacted via email or phone between Wednesday 20 January and Wednesday 3 February 2021.

Subject to the unclaimed prize clause below, if for any reason the winner does not take the prize (or an element of the prize) by 23:59pm AEST/AEDST on Friday 26 February 2021, then the prize (or that element of the prize) will be forfeited.
If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
In case of an invalid entry, ineligible entrant, non-contactable entrant or unclaimed prize, the judges will select additional reserve entries which they determine to be the next best and record them in order. An alternative winner will be determined by the representatives of The HOYTS Corporation, Level 50, 680 George Street, Sydney, NSW 2000 on Monday 1 March 2021 at the same time and place as the original judging. In the case of a winner, they will be notified in writing within two (2) business days of the judging.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
These Terms and Conditions may be varied by the Promoter at any time. The Promoter accepts no responsibility for and will not be liable because of any reliance placed on the Terms and Conditions before they were varied.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees, as well as any other implied warranties (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Including arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any prizes that are damaged, delayed or lost in transit; (f) any tax liability incurred by a winner or entrant; or (g) use of a/the prize.
If liability under these terms implied by legislation cannot be excluded, the liability of the Promoter and its related bodies corporate is limited to the re-supply of the relevant goods or services or paying the cost of replacing them
The Promoter may communicate or advertise this Promotion using Facebook. However, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.
As a condition of accepting the prize, the winner must sign any legal documentation as required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

If the Promoter cannot collect your personal information, we will not be able to enter you in the Promotion or provide you with a prize.
