Sydney Metro harbour tunnels
The Saturday Telegraph – in conjunction with Sydney Metro – is offering readers the once-in-lifetime opportunity to walk through the completed harbour tunnels with 30 double passes on offer.


Located 40m beneath the harbour at the deepest point, readers will be able to view first-hand the extraordinary engineering feat that has been achieved as part of a guided tour.

To occur on Sunday December 20, the one-way walk will begin at Blues Point and end up at Barangaroo.

The offer of a tunnel walk comes almost three decades since the Sydney Harbour Tunnel was opened to the public to walk through from Falcon St at North Sydney to The Domain in Eastern Sydney in 1992.

NSW Transport and Roads Minister Andrew Constance described the scale and engineering accomplishment of Sydney Metro as “breathtaking”.

“This new Metro railway will change Sydney for generations to come, making it easier and faster to get around,” he said.

“Being able to keep delivering this massive project throughout the COVID-19 pandemic has been a major support to the NSW economy, both in the direct employment of thousands of people and in supporting development across Sydney.

“This tour is a once-in-a-lifetime opportunity to walk under Sydney Harbour, where in a few short years driverless metro trains will be zipping through every four minutes – transforming our global city the way the Sydney Harbour Bridge, directly above these tunnels, changed Sydney a century ago.”

John Holland CPB Ghella project director Terry Sleiman said 11,000 people had worked on the tunnelling project.

“The pipeline of work announced recently has boosted confidence, and that is exactly what is needed now and into the future to help stimulate economic recovery after a pandemic affected year,” he said.

TERMS AND CONDITIONS – SYDNEY METRO TUNNEL TOUR PROMOTION

General

1.The promoter of this competition is Nationwide News Pty Ltd (ABN 98 008 438 828) of 2 Holt Street, Surry Hills, NSW 2010. Telephone number (02) 9288 3000 (Promoter).

2.The prize fulfilment party is Sydney Metro (ABN 12 354 063 515), a corporation constituted under the Transport Administration Act 1988 (NSW), located at Level 43, 680 George Street, Sydney, New South Wales 2000 (Sydney Metro).

3.Information on how to enter and prizes forms part of the terms of entry. Entry into the Promotion is deemed acceptance of these terms and conditions. If there is any inconsistency between these terms and conditions and anything else that refers to this Promotion, these terms and conditions will prevail.

Who can enter?

4.Entry is open to all residents of NSW who are:

(a)over the age of 18 years only (photo identification and proof of age will be required);

(b)able-bodied and suitably fit to participate in a walking tour in the metro railway tunnels 40 metres under Sydney Harbour on Sunday December 20, 2020 (the Event); and

(c)free of drugs and alcohol at the time of the Event (Sydney Metro’s contractor has a zero-tolerance drugs and alcohol policy on site and random tests may be conducted. Any individuals suspected of being under the influence of drugs or alcohol will be denied access to the Event, at Sydney Metro’s and its contractor’s sole discretion).

5.Companies, suppliers and agencies associated with the Promotion are not eligible to enter the Promotion, including but not limited to:

(a)directors, contractors and employees (and their immediate families) of the Promoter; and

(b)employees of Sydney Metro or Transport for NSW (TfNSW), or their immediate family members, or any suppliers, contractors, or any other individuals engaged by Sydney Metro in respect of any Sydney Metro project.

6.The Promoter reserves the right at its sole discretion to request winners provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership in order to claim a prize. If a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

When to enter

7.The Promotion opens at 12:05 am on Saturday December 12, 2020 and closes at 11:55pm on Sunday December 13, 2020 AEDT (Promotion Period). Entries must be received by the Promoter in the Promotion Period.

8.All entries are deemed received at the time of receipt by the Promoter not at the time of transmission by the entrant.

9.The Promoter accepts no responsibility for any late, lost misdirected, delayed, ineligible, incomplete or corrupted entries or delays in the delivery of entries due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account are invalid and will not be accepted.

How to enter

10.Entrants can enter online by logging onto dailytelegraph.com.au/promotions and registering their details and describing in 25 words or less why they want to be one of the first to walk through the Sydney Metro tunnel to complete their entry. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider. The most inspiring answer will win.

11.Entrants must take full responsibility for their entry content and ensuring that their entry complies with these terms and conditions. “Entry content” includes any content (including text, photos, videos and email messages) that entrants submit, upload, transmit, publish, communicate or use in connection with their entry into the Promotion. Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work. If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry. An entrant’s entry must not include:

(a)any image or voice of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;

(b)any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and

(c)any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content (for example, recorded music) they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these terms and conditions.

The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry includes content as described in any of paragraphs (a) to (c) above.

12.Entrants must not:

(a)tamper with the entry process;

(b)engage in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion;

(c)submit an entry that is not in accordance with these terms and conditions;

(d)use multiple email addresses, postal addresses, PO Box addresses or SIM cards to register multiple qualifying purchases or use any form of software or third-party application to enter multiple times (including scripting software) except where expressly permitted in these terms and conditions;

(e)use a third party (including online competition entry site) to enter on their behalf, except where the entrant needs to use those services of that third party to enter due to a disability; or

(f)engage in conduct in entering the Promotion which, in the opinion of Promoter, is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.

If an entrant is found to have breached these terms and conditions including this clause, the entrant will be disqualified such that their entries will be invalidated, any claim to any prize will be invalidated and where a disqualified entrant has already been awarded a prize before being found to have breached these terms and conditions, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if these terms and conditions have been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm or deny its suspicions in this regard and any failure to provide such requested documentation to the Promoter on request gives the Promoter the right to disqualify the entrant. The Promoter’s legal rights to recover damages or other compensation from any offender are reserved.

Number of Entries permitted

13.One prize per person - Entrants may enter as many times as they like. A maximum of one (1) prize will be awarded per person.

Draw and Notification of winner

14.The winners will be the top thirty (30) valid entries submitted in accordance with these terms and conditions that are judged by The Daily Telegraph editorial team as the most inspiring answers at 9:00am on Monday December 14, 2020 at 2 Holt Street, Surry Hills, NSW 2010 (‘the draw’).

15.This competition is a game of skill. Chance plays no part in determining the winner.

16.The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result or any other decisions the Promoter makes in connection with the Promotion.

17.The winners will be notified by telephone or email within two days of the judging. Winners of prizes will be published using their first initial, surname and postcode on the dailytelegraph.com.au/promotions website approximately 24 hours after the draw and will remain on the website for a minimum of 30 days.

18.Prizes will be awarded to the person named in each winning entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

19.If an entrant’s contact details change during the Promotion Period, the entrant must notify the Promoter. A request to access or modify any information provided in an entry should be sent to the Promoter.

Prize on offer

20.Individual prize value is up to $1.00 (including GST). Total prize pool value is up to $30.00 (including GST) as at 10 December 2020. 30 winners will each receive 1 x double pass for the Event.

21.Unless otherwise expressly stated, prizes are not generally made available and so the value is an estimate only. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

22.Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

23.Prizes cannot be transferred, exchanged or redeemed for cash.

24.It is a condition of accepting the prize that each winner and their nominated guest must comply with all the conditions of use of the prize and Sydney Metro’s specific requirements. It is the responsibility of the winner to confirm such conditions with Sydney Metro or other relevant third parties.

25.It is a condition of accepting the prize that the winner and their guest may be required to sign a legal release in a form determined by the Promoter and/or Sydney Metro in their absolute discretion.

26.All entrants agree that if they win the prize, they will not, and their companions will not, sell or otherwise provide their story and/or photographs in relation to the taking of the prize, to any media or other organisation, without the Promoter’s or Sydney Metro’s prior written consent. Photographs will be allowed to be taken only at the discretion of the Promoter and Sydney Metro.

27.The prize must be redeemed on Sunday, 20 December 2020. In the event a winner does not redeem the prize on that date, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

Prize clauses

28.Event tickets are only valid for the date specified on the tickets and are subject to any terms and conditions imposed by Sydney Metro. Once awarded, the Promoter is not liable for any ticket that has been lost, stolen, forged, damaged or tampered with in any way. The Promoter makes no representations or warranties about the attendance at the Event of any individuals or groups involved in the marketing of the Event.

29.The winner acknowledges and accepts that activities that form part of the prize are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The winners and their guests are required to be physically fit. This prize is not suitable for anyone who suffers from a respiratory disorder, circulatory ailment, or physical disability that limits mobility.

30.By entering this Promotion, entrants accept and acknowledge full responsibility for their decision to participate in the Event should they be chosen as winners. The winners release the Promoter, Sydney Metro and any other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties will not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the event or any other aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize and that they and their guest may be excluded from participation in the prize if the Promoter or Sydney Metro consider that he or she is not fit to participate.

Further Terms and Conditions

31.If for any reason this Promotion or the Event is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter or Sydney Metro, including but not limited to vandalism, power failures, tempests, inclement weather, natural disasters, pandemic, epidemic, acts of God, civil unrest, strike, war or act of terrorism, the Promoter and Sydney Metro reserve the right in to take any action that may be available to either of them, and (without limitation) to cancel, terminate, modify or suspend the competition or the Event, subject to any direction given under State Regulation. Should this occur, the Promoter and Sydney Metro will make reasonable attempts to notify each winner via the contact details provided by the winner to the Promoter.

32.If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

33.If the prize includes attendance at an event which is cancelled for any reason beyond the control of the Promoter, including due to pandemic or epidemic or illness of a performer, or the inappropriateness of the proposed site for the event, the Promoter reserves the right to take action under either of the previous two clauses.

Sydney Metro’s requirements

34.A reference to ‘Visitors’ in these terms and conditions is a reference to each winner and guest who has a ticket or is entitled to a ticket to attend the Event. A reference to Visitor in these terms and conditions may also be a reference to other persons invited to attend the Event by the Sydney Metro City and Southwest Project and Project Communications Teams.

35.Each Visitor must provide photo identification on the day prior to entry to the Event.

36.Each Visitor warrants that they will not sell, trade or exchange their ticket to the Event or otherwise advertise or use the Sydney Metro name or logo in respect of the Event other than in accordance with these terms and conditions.

37.Each Visitor acknowledges and agrees:

(a)The Event will be held at a live construction site that is not yet open to the public. Given the constraints of accessing a live construction site, Sydney Metro cannot provide wheelchair access to Visitors attending the Event.

(b)The Event involves a walk under Sydney Harbour railway tunnels and through to Barangaroo Station site (approximately 800 metres).

(c)They are suitably fit and able to walk without assistance down and up approximately 200 stairs (10 flights) in an enclosed steel structure.

(d)They are not afraid of heights, they do not suffer from vertigo or otherwise feel uncomfortable in confined spaces.

(e)Access to the Event is subject to the control of Sydney Metro and its contractor. Access to the Event may be limited, restricted or denied at Sydney Metro’s or its contractor’s absolute discretion.

38.Sydney Metro reserves the right to change the date or time of the Event, or to cancel the Event if it is necessary for the safety of the Visitors or other attendees at the Event or the site of the Event. Should this occur, Sydney Metro will make reasonable attempts to notify each winner via the contact details provided by the winner to the Promoter with as much notice as reasonably practicable.

39.Neither the Promoter nor Sydney Metro is liable for any loss, damage, personal injury or death whatsoever suffered or sustained in connection with attendance at the Event, nor any act or omission (other than a negligent act of the Promoter or Sydney Metro) of Sydney Metro, the Promoter or any person associated with either of them. Each Visitor waives all rights to make a claim against Sydney Metro, the Promoter or any person associated with either of them, for any loss, cost, damage, expense, or for any other matter arising out of or in connection with the Event.

40.Visitors are responsible for their own transport to and from the Event and car parking. There will be no car parking available at the Event.

41.Visitors are responsible for arriving at the Event prior to their allocated timeslot. Sydney Metro recommends Visitors arrive 10 minutes prior to their allocated timeslot. Any Visitor that arrives after their allocated timeslot will be denied access to the Event.

42.Each Visitor agrees to attend a safety induction on the day of the Event and sign a declaration in relation to the safety induction. Sydney Metro and its contractor reserve the right to exclude any Visitor from the Event who does not participate in the safety induction, does not comply with the requirements of the safety induction, or who, in Sydney Metro’s or its contractor’s discretion, should not be permitted onto the construction site for any other reason.

43.Visitors must wear appropriate clothing for the Event, including sturdy flat enclosed shoes with non-slip rubber soles (no open shoes or high heels), long pants and a long sleeved shirt. Visitors who do not wear appropriate clothing will be denied access to the Event at Sydney Metro’s or its contractor’s discretion.

44.Visitors must at all times comply with the directions of Sydney Metro, its representatives and its contractor when attending the Event. Any failure by a Visitor to comply with the directions of Sydney Metro, its representatives or its contractor will result in that Visitor being removed from the Event or denied entry to the Event.

45.Visitors must not interfere with any equipment attached to, or forming part of, the construction site or block or interfere with the operation of the train doors at the construction site. Visitors must not destroy or damage any part of the construction site.

46.It is a condition of entry to the Event that Visitors must present their bags for inspection upon entry to the Event. Visitors must not bring large bags to the Event that may cause an obstruction in a confined space. Sydney Metro reserves the right to refuse access to any Visitor whose bag/s or personal belongings may cause an obstruction in a confined space.

47.Visitors may not be permitted to bring certain personal belongings to the Event if deemed unsuitable by Sydney Metro, its contractor or any other person associated with Sydney Metro. Sydney Metro takes no responsibility for lost, stolen or damaged personal items.

48.Each Visitor that attends the Event gives Sydney Metro and/or TfNSW consent to film and take photos of the Visitor (‘the footage’) and to publish and distribute the footage (in whole or in part, and whether or not the Visitor is clearly identifiable in the footage) along with his/her name on Sydney Metro’s and TfNSW’s websites and social media accounts, on television, in print and electronic mainstream media, and in any other promotional materials, without any further reference or payment or other compensation to that Visitor.

49.Sydney Metro will deal with any personal information that is collected from Visitors as part of registration for, and attendance of, the Event (‘Personal Information’) in accordance with the Information Protection Principles under the Privacy and Personal Information Protection Act 1998 (NSW) and Sydney Metro’s privacy policy, other than the matters agreed in clause 47 above.

50.Personal Information will be:

(a)retained by Sydney Metro for the purposes of conducting the Event;

(b)shared with relevant business units within Sydney Metro for purposes related to the Event; and

(c)shared with third parties comprising sponsors and suppliers for promotional, marketing and publicity purposes, including, but not limited to, sending electronic messages to, or telephoning, the Visitor,

but will not otherwise be released to third parties (subject to the provisions of the Government Information (Public Access) Act 2009 (NSW) and any other lawful reason for disclosure).

51.Visitors who do not wish to provide Personal Information to Sydney Metro will not be able to attend the Event.

52.In consideration of the Promoter awarding the prize to the winner, the winner permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter or any of its related bodies corporate or the goods and services of any of them or the advertising or marketing of any of them, in any media whatsoever throughout the world and the winner will not be entitled to any fee.

53.The Promoter acknowledges that the entrant may own intellectual property rights (including copyright) in any material created or otherwise submitted to the Promoter in connection with the entrant’s entry or participation in any aspect of the promotion (Works). The entrant does not transfer their intellectual property rights to the Promoter by submitting an entry. The entrant grants the Promoter a non-exclusive, irrevocable, perpetual, worldwide, sublicensable licence to use the Works (including modifying, adapting or publishing the Works, whether in original or modified form, in whole or in part, to use, modify, delete from, add to, publicly display and reproduce, the photo(s), including without limitation, in any online media formats and through any social media channels, pages or accounts) for the sole purpose of running the Promotion, promoting and celebrating the promotion and future promotions and agrees that the Promoter may assign and/or sublicense the Works to third parties for this same purpose. Should the Promoter wish to use an entrant’s Works for any other purposes, it will contact the entrant to discuss licensing opportunities.

54.The entrant acknowledges and agrees that neither the entrant nor any third party shall be entitled to any fee, royalty or other consideration in respect of such licence. If the entrant holds, now, or at any time in the future, any so called “droit moral” or moral rights in connection with the Works, the entrant unconditionally and irrevocably consents, for the benefit of the Promoter and all of its assignees, licensees and sub licensees to minor alterations to the Works which may be required for print or display purposes such as resizing and minor colour correction notwithstanding that such conduct may amount to derogatory treatment of the Works for the purposes of the Copyright Act 1968 (Cth) (Copyright Act). All Entrants consent to attribution by either full name or social media handle in satisfaction of their right to attribution under the Copyright Act.

Limitation of Liability

55.The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter and Sydney Metro shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s (including without limitation due to attendance at an event or travel undertaken when there is any current health warning, epidemic or pandemic declared which would apply to or could be considered to impact, effect or apply to the relevant event or travel) except for any liability which cannot be excluded by law.

56.The Promoter and Sydney Metro are not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

Entry details and privacy

57.The Promoter is collecting the entrant’s personal information for the purpose of conducting this competition (including but not limited to determining the winner). If you are not willing for this to occur, you cannot participate in the Promotion.

58.The Promoter collects information about entrants, including for example their name and contact details which are provided when entering this competition and when registering or using Promoter’s services and may also collect information from data houses, social media services and the Promoter’s affiliates. The Promoter collects and uses that information to run this competition, to provide entrants with the Promoter’s goods and services, to promote and improve its goods and services, to provide entrants with targeted advertising based on their online activities, for the purposes described in the Promoter’s Privacy Policy and for any other purposes that were described at the time of collection. The Promoter may disclose entrants’ information to its related companies, including those located outside Australia. Any of those companies may contact entrants for those purposes (including by email and SMS) at any time. The Promoter may also disclose entrants’ information to its service and content providers, including those located outside Australia. If entrants do not provide the Promoter with requested information, it may not be able to provide entrants with the competition goods and services. The Promoter may disclose entrants’ personal information to authorities if they are a prize winner or otherwise as required by law.
