TERMS AND CONDITIONS:

DreamWorks Spirit Untamed – Enter for a Chance to Win 1 of 100 Family Passes Promotion at BIG W (“Promotion”) will begin on April 4, 2021 at 12:01 AM AEST and end on May 20, 2021 at 11:59 PM AEST (“Promotion Period”). All times in the Promotion refer to Australian Eastern Standard Time (“AEST”). Odds of winning depend upon the number of eligible Entries received. Promotion is subject to all applicable federal, state and local laws.

ELIGIBILITY: Open only to permanent, legal Australian residents who are physically residing in Australia and who are thirteen (13) years of age or older as of the start of the Promotion Period. If an entrant is under the age of eighteen (18) (“minor”) they must obtain prior consent from their parent or legal guardian to enter and the parent or legal guardian may be required to verify the granting of consent and/or sign a release at the discretion of the Sponsor. Failure of a minor entrant’s parent or legal guardian to verify consent and/or sign a release under this clause will invalidate all of the entrant’s entries. Officers, directors, and employees of Promotion Entities (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and each of their respective spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Promotion. Promotion Entities, as referenced herein, shall include Universal Pictures International Australasia Pty Ltd., ABN 44 122 951 099, Level 32, 580 George Street Sydney, NSW 2000 Australia (“Sponsor”), and its parent, subsidiary, and affiliate companies, and each of their administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Promotion.

HOW TO ENTER:

To enter the Promotion, during the Promotion Period, you must:

Purchase AUD$20 or more of any DreamWorks Spirit Untamed product in one (1) transaction from any BIG W stores in Australia (“Participating Retailer”) and obtain a receipt for your purchase (“Receipt”);
Visit www.SpiritUntamed-BigWtickets.com.au (the “Website”) and follow the provided instructions to complete the following details:
Name (first and last);
Email;
Gender;
Date of birth;
Mobile phone number;
Address (number, street address, suburb, postcode, state, country);
Upload a clear image of your Receipt, displaying all details on your Receipt; and
Confirm that you have read and agree to be bound by these Official Rules and submit your entry.
(each, an “Entry” and collectively, the “Entries”).

All Entries become the property of Sponsor and will not be acknowledged or returned.

Limit one (1) Entry per Receipt. Entries must be received before May 20, 2021 at 11:59 PM AEST to be eligible for the Promotion. Sponsor’s computer shall be the official timekeeper for all matters related to this Promotion. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. “Authorized account holder” of an email address is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Entry constitutes permission (except where prohibited by law) to use entrant’s name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.

WINNER SELECTION AND NOTIFICATION: On May 21, 2021 at Level 32, 580 George Street, Sydney, NSW 2000 at 12:00 PM AEST, one hundred (100) potential winners (“Winners,” each a “Winner”) will be selected in a random drawing (“Draw”) by representatives of Sponsor from among all eligible Entries received during the Promotion Period. Sponsor may share each potential Winner’s name and contact information with Promotion Entities and/or any prize provider, as applicable, if necessary. Sponsor will, within two (2) business days of the Draw, make two (2) attempts to notify potential Winner(s) at the phone number and/or email address submitted at the time of Entry. Winners’ details will be published on the Website on May 21, 2021. Potential Winners may each be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Promotion Documents”) within seven (7) days of such notification. Noncompliance within this time period will result in disqualification, and an alternate potential Winner will be selected from the remaining eligible Entries. If a potential Winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if Prize (defined below) or Prize notification is returned as undeliverable, Sponsor will hold the applicable prize until 5 PM AEST, May 31, 2021, after which time such potential Winner will forfeit their Prize and an alternate potential Winner will be selected from the remaining eligible Entries. Any element of the Prize (as defined below) that needs to be delivered will be delivered to the Winner’s address submitted at time of Entry within seven (7) days of Sponsor receiving such Winner’s properly executed Promotion Documents. Limit one (1) Prize (defined below) per person, family, or household.

UNCLAIMED PRIZE DRAW: If required, an unclaimed Prize draw (“Unclaimed Draw”) will be held on June 1, 2021 at the same time and location and using the same notification and delivery method as for the Draw, and additional potential winners will be randomly selected from among all remaining eligible Entries. Unclaimed Draw Winners’ names will be published on the Website on June 2, 2021. Each Winner of an Unclaimed Draw may be required to execute and return Promotion Documents within seven (7) days of such notification.

PRIZE: There will be one hundred (100) prizes (“Prizes,” each a “Prize”) awarded to the Winners; one (1) Prize will be awarded to each Winner. Each Prize will consist of the following: one (1) family pass for the Winner, which consists of a pass for the Winner plus one (1) adult guest, and two (2) minor guests (collectively, “Guests,” each a “Guest”) for general admission to see DreamWorks Spirit Untamed (“Event”), at their local participating Australian exhibitor (the “Prize”). Prize is valid until DreamWorks Spirit Untamed is no longer showing at a participating Australian exhibitor (“End Date”). If Prize is not used by End Date, Prize will be forfeited and no alternative prize(s) will be awarded. Prize is subject to certain terms and conditions as specified by issuer. Restrictions may apply. Prize is not valid at premium, large format screens or special events; check with participating Australian exhibitor for details and validity. Prize does not include the cost of purchasing/renting 3D glasses required to attend a 3D session. Prize is not valid on cinema discount days, Saturdays after 5:00 PM AEST, or on Australian Government public holidays. Prize is not valid for re-sale or with any other offer. Prize is not transferable, exchangeable or redeemable for cash. Prize is not valid for mobile or online ticketing. Seats at the Event are subject to availability. Prize must be surrendered upon redemption. Prize is valid even if participating Australian exhibitor has issued a “no free tickets” restriction. Prize is not valid at premium, large format screens or special events; check with participating Australian exhibitor for details and validity.

Estimated Retail Value (“ERV”) of each Prize is AUD$80. The total estimated value of all Prizes is AUD$8,000. Actual Retail Value (“ARV”) of the Prize may vary. Any difference between ERV and ARV will not be awarded.

All details of the Prize will be determined by Sponsor in its sole discretion. Sponsor reserves the right to substitute the Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of the Prize are the sole responsibility of Winner and their Guest, including any food or drinks, travel to and from the Event or any other additional purchases. The Prize, or any unused portion of the Prize, cannot be transferred or substituted by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of the Prize by Winner.

Sponsor shall have the right, but not the obligation, to make any deductions and withholdings that Sponsor deem necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances.

Nothing in these Official Rules limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Official Rules would contravene any statute or cause any part of these Official Rules to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, Sponsor shall have no responsibility or liability for cancellations, delays, or any other change outside of Sponsor’s control by any company or person providing any element of the Prize, and is not responsible or liable for any expenses incurred as a consequence thereof. Further, Sponsor excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, except for liability in relation to a Non Excludable Guarantee, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Promotion (b) telecommunications, network, electronic, technical, or computer failures of any kind; (c) for inaccurate transcription of entry information; (d) for errors in any promotional or marketing materials or in these Official Rules; (e) for any human or electronic error; (f) for Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned; (g) any theft, unauthorised access or third party interference; (h) any tax implications; (i) any variation in reward value to that stated in these Official Rules; (j) the Prize or use of the Prize.

Date and/or time of Event is subject to change. Event is subject to cancellation. If Winner chooses to attend the Event with no Guests, the remaining elements of the Prize shall constitute full satisfaction of Sponsor’s Prize obligation to Winner and no additional compensation will be awarded. Guests, if any, may be required to execute and return releases of liability and, except where prohibited, publicity releases (collectively, “Guest Documents”), which must be returned with the Promotion Documents, or Guest portion of the Prize will be forfeited. If any Guest is a minor, Winner or one of the other Guests must be such minor’s parent or legal guardian and must execute and return the Guest Documents on such minor’s behalf.

All parts of the Prize are subject to availability, and subject to change or cancellation without written notice or warning. Should an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities, epidemics, pandemics and the spread of infectious diseases, including without limitation COVID-19 (as defined by the World Health Organization and any of the strains, variants or mutations thereof), and any related governmental or judicial actions, including but not limited to travel restrictions, taken in connection with, or as a response to, any such event, or any other event beyond the reasonable control of a party, whether or not existing, known, foreseen or foreseeable at the time this Promotion occurs, render the redemption or fulfillment of all or a portion of the Prize delayed, hindered, adversely affected, impracticable, or impossible, Sponsor in its sole and absolute discretion, reserves the right to evaluate, make modifications to, and restructure the redemption and fulfillment processes and timelines for the Prize, or portion thereof, that Sponsor is responsible for, which may include, but is not limited to, providing additional time for redemption and/or fulfillment. Sponsor may modify and/or restructure the Prize or portions thereof to comply with government orders or guidelines and Sponsor’s and/or any prize provider’s health and safety requirements. In addition, Winner and Guest(s) should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before traveling. Should the Prize, or a portion thereof, become unavailable Sponsor shall make reasonable efforts to provide Winner with substitute experiences and/or items of a similar nature and value for that portion of the Prize that is unavailable. If no substitute prizing is reasonably available then the remaining components, if any, of the Prize shall constitute full satisfaction of Sponsor’s Prize obligation to Winner, and no other or additional compensation will be awarded.

CONDITIONS: By entering the Promotion, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Promotion Entities and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, except for liability, claims or causes of action relating to Non-Excludable Guarantees, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof; (b) to indemnify Released Parties from any and all liability resulting or arising from the Promotion and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, except for Non-Excludable Guarantees, express or implied, relative to Prize; (c) if selected as a Winner, to the posting of such entrant’s name on the Website and the use by Released Parties of such entrants name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Promotion itself, and to be bound by all decisions of the Sponsor, which are binding and final. Failure to comply with these conditions may result in disqualification from the Promotion at Sponsor’s sole discretion.

ADDITIONAL TERMS: Sponsor reserves the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Promotion or the operation thereof is unlawful and subject to legal action by Sponsor, who may seek damages to the fullest extent permitted by law. The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Subject to any directions by a regulatory authority, Sponsor reserves the right to cancel, modify, or suspend the Promotion or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, and subject to any directions of a regulatory authority, Sponsor reserves the right to select Winner in a random drawing from among all eligible, non-suspect Entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted at Website. Sponsor may prohibit any entrant or potential entrant from participating in the Promotion, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsor, or Sponsor’s agents or representatives; or behaves in any other disruptive manner (as determined by Sponsor in its sole discretion). Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Promotion.

Entrants’ personal information submitted in connection with the Promotion will be handled in accordance with the Sponsor’s Privacy Policy available at https://www.nbcuniversal.com/privacy. The Sponsor collects personal information in order to conduct the Promotion, for internal research and/or to enable Prize fulfilment and may, for these purposes, disclose such information to the Promotion Entities and other third-party service providers, including, but not limited to, Prize suppliers and Prize fulfilment houses and for any purpose required under Australian lottery legislation or any other regulatory authority. Some of the third parties the Sponsor discloses information to may be based or have servers located overseas. If the Entrant does not provide some or all of the personal information requested, the Entrant may be disqualified. The Entrant has the right to request access to personal information that the Sponsor holds about the Entrant, or ask the Sponsor to update or correct that information.
