Terms and Conditions for entry into the POOLWERX “Aquawize AW5 Robotic Pool Cleaner Promotion (“Promotion”)
The Promoter
Information on how to enter and Prize details form part of these terms and conditions for entry (“T&C’s”). Entry into this Promotion is deemed acceptance of these T&C’s.
The Promoter is Poolwerx Corporation Pty Ltd (ABN 94 061 535 493)trading as Poolwerx of 10 Camford Street, Milton QLD 4064 Phone 1800 009 000. (“Promoter”).
The Promotion will be open from 01am AEST on 27th August 2021 and closes at 11:59pm AEST on 2nd September 2021 (“Promotion Period“).
The Prize
The Grand Prize valued at $3,000 (inc GST) is made up of one Aquawize AW5 Robotic Pool Cleaner.
The Grand Prize must be redeemed by no later than 30th September 2021 after which it will be distributed at the Promoter’s absolute discretion.
The Grand Prize cannot be transferred and cannot be redeemed for cash.
Entry Requirements
Entry is open to all Australian residents, aged 18 years and over, other than management, employees or contractors of the Promoter and other agencies, firms or companies associated with the Promotion (including suppliers of prizes), and their immediate families (“Eligible Entrants“).
To enter and be eligible to win, Eligible Entrants must:

enter the requested details (‘like’ the Poolwerx Corporation Facebook and/or follow the Instagram page, ‘like’ the Win an Aquawize AW5 Robotic Pool Cleaner promotional post, and

Completion of the relevant steps described above is an “Eligible Entry”.
Eligible Entrants may only enter once per social media account.
This Promotion is a game of chance. There is no element of skill in the judging and determination of the winner.
Winner
The draw from all Eligible Entries received during the Promotion Period will take place at 10 Camford Street, Milton QLD 4064 at 3:00pm AEST on 3 September 2021. The draw will be conducted by a representative of the Promoter.
The first Eligible Entrant drawn at as determined by the judge in their sole discretion, will win the Prize (“Winner”).
There is one Winner only and only Eligible Entries are eligible to win the Grand Prize.
The Winner will be notified via Direct Message on either Facebook or Instagram followed by email no later than 5pm on 6 September 2021 (AEST).

The Promoter’s decision (including any decisions as to distribution of the Grand Prize) is final and no correspondence regarding the result will be entered into.
The Winner may be required to sign a release and indemnity form in favour of the Promoter and return that document to the Promoter prior to receiving the Grand Prize.
General terms for prizes in Poolwerks Promotions
Clauses 18 to 36 inclusive apply to all Poolwerx promotions (including this Promotion) unless expressly stated otherwise.
The Promoter shall not be liable for any prize that may be lost, stolen, forged, damaged or tampered with in any way after it leaves the Promoter.
The Promoter accepts no responsibility for any variation in the value of a prize.
If the Promoter is unable to provide a finalist or winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of equal or greater monetary value, subject to written directions by the relevant State and Territory gaming departments.
If a winner chooses not to take their prize (or is unable to), they forfeit the prize and the Promoter is not obliged to substitute the prize.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter.
The judges’ decision is final and binding and no correspondence will be entered into. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
If, for any reason, a p[promotion (including this Promotion) is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
The Promoter reserves the right to disqualify entries in the event of non-compliance with these T&C’s. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these T&C’s limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of:
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
any theft, unauthorised access or third party interference;
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
any variation in prize value to that stated in these Terms and Conditions;
any tax liability incurred by a winner or Entrant; or
use of a prize.
The Promoter (including its’ officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Promotion including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable Guarantees.
Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
Privacy- Information collection & use
By entering the Promotion, each Eligible Entrant understands and agrees that the Promoter may use and disclose the information provided by the Eligible Entrant for the purposes of conducting this Promotion and on the terms and for the purposes (including marketing) set out below and in the Promoter’s Privacy Statement available here.
Each Eligible Entrant agrees that the Promoter can continue to contact them even after this Promotion ends. If an Eligible Entrant would like to access or correct the personal information that the Promoter holds about the Eligible Entrant, or if an Eligible Entrant does not wish the information to be disclosed, they should advise the Promoter by emailing [insert contact details].
By entering into the Promotion, the Eligible Entrant agrees and acknowledges that:
they may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of them;
the Promoter may use such comments or photos (the “Materials“) for the Promoter’s future promotional and marketing purposes without further reference or compensation to them;
the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (“Moral Rights“);
they waive all Moral Rights in the Materials that arise outside Australia; and
they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
