Terms and Conditions
Information on how to enter forms part of the terms and conditions of entry. Acceptance of a prize is deemed acceptance of these terms and conditions. Headings in this document are included for ease of reference, and do not affect interpretation in any way.
The Promoter is Weber-Stephen (Australia) Pty Ltd (ABN 18 006 305 237) of Level 1, 142-144 Fullarton Road, Rose Park. SA 5067. (Promoter).
Duration
The promotion commences at 12.01am (AEDT) Thursday 13 October 2022 and closes at 11:59pm (AEDT) Saturday 4 February 2023 (Promotion Period).
Entry is open to Australian residents aged 18 years or older (Eligible Entrants), excluding directors, management, employees and their immediate families of the Promoter or Mike Da Silva and Associates (Aust) Pty Ltd ABN 50 003 894 022 (MDSA) and each of their related bodies corporate and employees of the Promoter and its related bodies corporate.
Entry into the promotion
To enter, during the Promotion Period, Eligible Entrants must either scan a QR code located on Weber-produced products, or logon to:
www.summerofweber.com and fully complete the entry form. One entry per Eligible Entrant is permitted.
The Promoter is not responsible for any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant’s identity, age and place of residence and to disqualify any entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Drawing of entries
The draw will take place at 2.00pm (AEST) on Wednesday 8 February 2023 at MDSA, Level 16, 1 Denison Street, North Sydney NSW 2060. The draw will be conducted by MDSA (Drawer). All eligible entries received during the promotion period will be entered into the draw.
There are 10 Grand Prizes, each to a value of $998.85. The maximum total prize pool value is $9,988.50.
The first ten (10) valid and eligible entries drawn will be the Grand Prize Winners.
All winners will be notified by phone and in writing within 2 business of the draw. The Winner’s name will be published on:
www.summerofweber.com from Friday, 17 February 2023 for a period of 28 days.
The result of the draw is final and no correspondence will be entered into.
The Grand Prize
Each of the 10 Grand Prize Winners will win a Weber Prize Pack, containing:
A Weber Q2200 Red LPG BBQ.
A Weber Essentials pack.
A Weber Q Duffle Bag.
One set of BBQ tongs and a spatula.
A $100 Cricket Australia online store voucher. (Conditions will apply).The value of each Prize Pack is $998.85, based on the recommended retail value of each item at the time of the start of the Promotion. The total value of the 10 Prizes is $9,988.50.
If any part of the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Each Prize must be taken as stated and no compensation will be payable if a winner is unable to use the Prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A Prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting a Prize that the winner accept the conditions of use of that Prize.
Right of the Promoter to redraw
The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming a Prize. If a Prize remains unclaimed at 5.30pm (AEDT) on Monday June 5 2023, a second chance draw will be conducted on Tuesday 6 June 2023 at 2:00pm (AEDT) at the same location as the original draw, subject to any written direction given under applicable law. A winner determined in accordance with this clause will be notified by phone and in writing within 2 business days of the draw and their name/s will be published on:
www.summerofweber.com from Friday 9 June 2023 for a period of 28 days.
Limitation of liability and variation of terms
If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations.
The Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents and prize suppliers (including Cricket Australia) (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
The Promoter reserves the right to verify the validity of any entries and in its sole discretion, disqualify any or all entries from, and prohibit further participation in this Promotion by, any person who: (a) tampers with or benefits from any tampering with the entry process or with the operation of the Promotion; (b) acts in violation of these Terms and Conditions; (c) acts in a disruptive manner; (d) acts with the intent to annoy, abuse, threaten or harass any other person; or (e) engages in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
The exclusion of liability in clause 18 above, does not apply to limit or exclude liability: for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business.
Entrants consent to the Promoter using the personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes, including to third parties involved in the promotion and any relevant authorities. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the private information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
If you have selected the option to receive information and offers from Australian Cricket, you understand and agree that Cricket Australia also collects your personal information, including on behalf of State or Territory cricket associations, including the Big Bash League teams (together, “Australian Cricket”) to communicate with you, and for any of the purposes set out in Australian Cricket’s Privacy Policy (available at
www.cricket.com.au/privacy or by emailing
privacy@cricket.com.au), and that the personal information you provide will be disclosed to and used by Australian Cricket under the terms of Australian Cricket’s Privacy Policy, which contains information about how you may access and seek to correct your personal information or complain about a breach of your privacy, and how Australian Cricket will deal with that complaint. Australian Cricket may disclose your personal information to other parties, including Australian Cricket’s third party service providers. From time to time, these third parties may be located (and so your personal information may be disclosed) overseas, including in India, the USA and the UK, and other countries from time to time. Australian Cricket may use and disclose your personal information for direct marketing purposes, unless you opt out (which you can do at any time in accordance with Australian Cricket’s Privacy Policy), and for facilitating further offers directly from third parties if you opt in to receive those offers. You can request to access, update or correct any personal information Australian Cricket holds about you by writing to Cricket Australia’s Privacy Officer at 60 Jolimont Street, Jolimont, VIC, 3002 or sending an email to
privacy@cricket.com.au.
Entrants consent to the Promoter and Cricket Australia using the Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or Cricket Australia.
Entry details remain the property of the Promoter. The name of the winners may be used for promotional purposes by the Promoter, unless a winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes (including to third parties involved in the promotion and any applicable statutory authorities) and to conduct marketing activities. Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement,
