Volvo Car Australia accessory promotion: Terms and conditions
1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. By participating in the promotion, entrants acknowledge that they have read and understood these Terms and Conditions and agree to be bound by them. Entries must be submitted in accordance with these Terms and Conditions to be valid.
3. To enter, entrants must be an Australian resident and above the age of 18.
4. Employees (and their immediate families) of the Promoter or Participating Retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. The promotion will be run in thirty-four (34) Volvo Retailers each of whom will display promotional material advertising this promotion (each a “Participating Retailer”). There will be a total of fourteen (14) Participating Retailers in NSW (8 in major metro areas, and 6 in rural or regional areas), eight (
Participating Retailers in VIC (7 in major metro areas, and 1 in rural or regional areas), one (1) Participating Retailer in SA, two (2) Participating Retailers in WA, six (6) Participating Retailers in QLD (3 in major metro areas, and 3 in rural or regional areas), one (1) Participating Retailer in ACT and two (2) Participating Retailers in TAS. Contact information for each Participating Retailer, and whether they are a major metro, or rural or regional Retailer, is at Schedule A to these Terms and Conditions.
6. The promotion commences for purchases at a Participating Retailer on 01/10/22 and ends for purchases at a Participating Retailer at 11:59pm local time on 31/12/22 (“Purchase Period”). Entries open on 01/10/22 and close at 11:59pm local time on 31/12/22 (“Entry Period”).
7. To enter, entrants must, during the Purchase Period, spend at least $1,000+GSTand any Luxury Car Tax on any fitted Volvo Genuine accessories at any Participating Retailer (“Qualifying Transaction”). If Volvo Genuine accessories are purchased for fitting to a new vehicle, full payment must be made for the new vehicle and Volvo Genuine accessories within the Purchase Period. Upon completing their Qualifying Transaction, entrants will automatically receive one (1) entry into the draw at that relevant Participating Retailer. Each Participating Retailer will log in to the Volvo Store site (www.volvostore.com.au
) with their unique log in to access their own account. Each Participating Retailer will access the Promotion page and enter the details for each eligible entrant, following their Qualifying Transaction, including their name, address, date of purchase and details of purchase. The Participating Retailer must also upload a copy of the proof of purchase to verify the validity of the entrant.
8. Only one (1) entry is permitted per person.
9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
10. Incomplete or indecipherable entries will be deemed invalid.
11. If there is a dispute as to the identify of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
12. The Promoter’s decision on all aspects relating to the promotion is final. However, the Promoter will consider any dispute concerning the conduct of the promotion or claiming a prize and endeavour to resolve the dispute.
13. There will be one (1) draw conducted by each Participating Retailer located in a major metro area. Each draw will take place at the registered office of The CBD Group, Level 6, 123 Eagle Street, Brisbane, QLD, 4000 on 12/01/23 at 12:00PM local time. Each draw will be conducted electronically using a random number generator in front of an independent person not involved with the management, conduct or promotion of the lottery.
14. There will be one (1) draw conducted for the following regional or rural Participating Retailers in the same State or Territory:
a) New South Wales:
i. Volvo Cars Central Coast
ii. Volvo Cars Central West
iii. Volvo Cars Riverina
iv. Volvo Cars Southern Highlands
v. Volvo Cars Tamworth
i. Volvo Cars Cairns
ii. Volvo Cars Sunshine Coast

15. Each draw will take place at the registered office of The CBD Group on 12/01/23 at 12:00PM local time. Each draw will be conducted electronically using a random number generator in front of an independent person not involved with the management, conduct or promotion of the lottery.
16. Entrants may attend the draw in person but do not have to be present when the lottery is drawn to win a prize.
17. The pool of entries for each draw will comprise of all valid entries in respect of a Qualifying Transaction at a Participating Retailer, or entries pooled into a single draw from more than one nominated regional or rural Participating Retailers under the Terms and Conditions.
18. Each entry in each draw will have a random and equal chance of being drawn the winner.
19. Each Participating Retailer may draw up to two (2) additional reserve entries and record them in the order in which they are drawn in case an invalid entry or ineligible entrant is drawn as the winner.
20. Winners will be notified of the prize they have won and the particulars of how the prize is to be delivered or collected by email and by telephone within seven (7) days of the draw. The Promoter will take all reasonable steps to notify the winner(s) of the results of the draw.
21. The first initial, surname and postcode of the winners will be published on the Promoter’s website and social media pages within seven (7) days of the draw for a period of at least three (3) months (except for any winner who has requested that their name and postcode not be so published). The Promoter’s website and social media pages are listed in Schedule B to these Terms and Conditions.
22. If, for any reason, a winner does not claim the prize within 3 months from the draw date, and only after the Promoter takes reasonable steps to notify them, the prize will be forfeited, and the Promoter will undertake an unclaimed prize draw in accordance with clause 28.
23. The first valid entry drawn in each Participating Retailer or nominated regional or rural Participating Retailer will each win one (1) Orbea VIBE H30 bicycle, valued at $4,499 RRP.
24. Winners must collect the prize from the relevant Participating Retailer, or as otherwise agreed between the Participating Retailer and the winner.
25. If any prize is unavailable, the Promoter may substitute the prize with a prize of the same or greater value either:
a) if the winner agrees in writing; or
b) if the original prize is unavailable due to circumstances beyond the control of the Promoter and the Promoter makes reasonable attempts to reach agreement with the winner.
26. The prize pool value in each Participating Retailer is $4,499. The prize pool value for the promotion in its entirety is 25 x $4,499 = $112,475.
27. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
28. An unclaimed prize draw for any prize, if unclaimed in a Participating Retailer, may take place on 12/04/23 at 12:00PM local time at the registered offices of The CBD Group, subject to any directions from a regulatory authority.
29. Winners of the unclaimed prize draw, if any, will be notified of the prize they have won and the particulars of how the prize is to be delivered or collected by email and by telephone within seven (7) days of the unclaimed prize draw. The Promoter will take reasonable steps to notify the winner(s) of the results of the unclaimed prize draw and clause 21 will apply to notification of the winner.
30. As a condition of entering this promotion, entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
31. If the Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including because of war, terrorism, pandemic, epidemic, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or if necessary to provide alternative prize(s) to the same value as the original prize(s), subject to any written directions made under applicable Australian State or Territory legislation.
32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law (“Non-Excludable Guarantees”).
33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner; or (f) use of a prize.
35. The Promotion is authorised as required by law. The relevant permits and/or licences issued in relation to this promotion are:
