Terms and Conditions – Win an Aspen Snowmass ski/board holiday Promotion

Information on how to enter and prize details forms part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions.
Entry is open to all permanent residents of Australia (except South Australia) and New Zealand who are 18 years of age or over. The Promoter has the right to verify the eligibility of each entrant.
The Promotion commences at 12.01am (AEDT) December 1, 2022 and closes at 11.59pm (AEDT) December 31, 2022 (“Promotional Period”).
This promotion is a game of chance. Lottery permit numbers: NSW Authority No. TP/02327; and ACT Permit No. TP 22/02333
To enter, individuals must, during the Promotional Period, visit the promotional website (either advertised on www.SnowsBest.com, www.instagram.com/misssnowitall or www.facebook.com/misssnowitall); follow the prompts to the Promotion entry page; and fully complete and submit the online entry form with their personal details (legal name, country of residence, postcode and email address).
This Promotion is in no way sponsored, endorsed or administered by or associated with Facebook or Instagram. You acknowledge that all information and material that you submit to enter this Promotion is submitted to the Promoter and not Facebook or Instagram and you agree that Facebook or Instagram shall not be liable to you in any way in respect of this Promotion.
Entries are limited to one per person.
The winner will be drawn at Suite 14, 332 Bong Bong St, Bowral, NSW 2576 at AEDT 10.30am on January 3, 2023. The winner’s name will be published at www.facebook.com/misssnowitall, www.instagram.com/missnowitall and SnowsBest.com by January 3, 2023. Winners will be notified in writing within seven (7) days of the draw.
If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance.
The draw conductor may draw additional reserve entries in case an invalid entry or entrant is drawn.
The prize must be claimed by 12:00pm AEDT on March 3, 2023.  In the event of an unclaimed prize, the prize will be redrawn on March 6, 2023 at 10.30am AEDT at Suite 14, 332 Bong Bong St Bowral, NSW 2576. The winner of the redraw will be notified by email within two (2) business days of the redraw and published at facebook.com/misssnowitall, www.instagram.com/missnowitall and SnowsBest.com by March 8, 2023.
The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
Entries must be received by 11.59pm AEDT December 31, 2022. The time of entry will in each case be the time the online entry is received. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
There is one prize / one winner. The prize is a trip to Colorado for the winner and a friend which consists of the following:
7 nights’ four star accommodation in a Fireplace Studio Suite at Aspen Square Condominium Hotel, Colorado,USA;
2 x 6 day lift passes with Aspen Snowmass;
2 x 6 day ski/board rental from Aspen Snowmass and AspenX;
2 x AspenX ski sweaters; and
An AUD $4,000 flight voucher from Travelplan (flights must be booked through Travelplan).
The total prize value is up to AUD$15,500 (depending on date and point of departure). All values are in AUD and correct at time of printing.

(a) Travel insurance is highly recommended to protect against additional costs incurred in the event of unforeseen circumstances. It is the winner’s responsibility to ensure that you and your travel companion (if any) have the requisites visas, vaccinations, valid documentation (including but not limited to valid passports and visas) which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.

(b) Passports and visas are the responsibility of the winner and your travel companion (if any). You must be travelling together for all sectors of the flights, no stopovers permitted. Flights must be booked through Travelplan.

The Promoter makes no representation as to the safety of the United States of America (“USA”) and it is the responsibility of the winner and your travel companion (if any) to check the travel advice issued by the Department of Foreign Affairs and Trade at www.smartraveller.gov.au and assess the safety of the USA prior to travel. It is your sole responsibility to ensure entry into the USA, at your own expense, including but not limited to ensuring all necessary passports are valid for 6 months from date of travel and visas, travel authorisations including an Electronic System for Travel Authorization (ESTA) (if applicable), medical advice and recommended vaccinations and immunisations have been obtained prior to travel.
(a) The prize is subject to availability and non-transferable or exchangeable nor redeemable for cash. Spending money, additional meals, taxes, insurance, items of a personal nature, in-room charges and all other ancillary costs, unless otherwise specified in the prize description, are not included in the prize.  If the Travelplan voucher does not cover the full cost of the flights (based on the date/time and provider selected for travel) any remaining costs will be the responsibility of the winner.  If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification, subject to any written directions of a regulatory authority.

(b) Travel must be taken by April 16, 2023. Accommodation is subject to availability and is non-transferable. Selected blackout dates include Christmas holidays, Presidents Weekend and Martin Luther King weekend.

(c) Prize is subject to the standard terms and conditions of individual prize and service providers.

(d) The prize is subject to booking and flight availability.

(e) The winner may be required to present their credit card at accommodation check in.

Notwithstanding clause 12b, if the prize winner is unable to redeem the prize due to any Australian or USA Government COVID-19 border restrictions on tourism travel, then all components of the prize will continue to roll over year to year, until such restrictions are eased.
Subject to clause 13, if for any reason the winner does not claim the prize (or an element of the prize) by the time stipulated by the Promoter, that date being April 16, 2023, then the prize (or that element of the prize) will be forfeited.
In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with SnowsBest.com or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone or computer user or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Snowsbest.com and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to any written direction given under State Regulation (Australia).
All entries become the property of the Promoter. Entrants’ personal information will be collected by the Promoter for the entrant to participate in this promotion.

Each Party is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and their individual privacy policy which is located at https://www.snowsbest.com/privacy-policy/ (for the Promoter), https://www.delta.com/us/en/legal/privacy-and-security (for Aspen Snowmass), https://aspenx.com/pages/privacy-policy (for AspenX), https://www.travelplan.com.au/about-us/privacy-policy (for Travelplan) and https://www.aspensquarehotel.com/privacy-policy (for Aspen Square Condominium Hotel). Each privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Party holds about them and how the entrant may complain about any potential breach by the Party of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. Each Party collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants’ personal information to third parties including their contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.
