1. By participating in the Win a Kimberley Cruise Competition (Promotion), you will be deemed to have:

a) accepted these Terms and Conditions; and
b) expressly consented to our use of your personal information under the Privacy Act 1988 (Cth), Spam Act 2003 (Cth), and other related communication and privacy legislation for marketing and other Heritage Expeditions (2018) Ltd business purposes.

2. The promotor is Heritage Expeditions, trading as Heritage Expeditions (2018) Ltd NZBN 9429046722225 of 53B Montreal Street, Sydenham, Christchurch 8023, New Zealand (Promotor).
3. The Promotion commences at 6:00pm (Sydney time) on 1 May 2023 and entries close at 11:59pm (Sydney time) on 4 June 2023 (Promotional Period).
4. Entry is open to Open Road readers over the age of 21 years
5. To validly enter the Promotion, entrants must:
a) Be over the age of 21 years during the Promotional Period;
b) Enter via the QR code or URL (www.heritage-expeditions.com/open-road/) as featured in the May/June 2023 issue of Open Road, or link received in an EDM from NRMA and tell us in 25 words or less why you want to join Heritage Expeditions Kimberley Explorer voyage. Entrants must personally and manually submit an Entry using an internet browser.

6. Only one valid entry per person permitted.
7. All entries, once submitted, become the property of the Promotor.
8. This is a game of skill and chance plays no part in determining the winner. All entries will be judged individually on their merits based on the Judging Criteria. The Promotor's decision is final and any dispute in relation to these Terms and Conditions or the Promotion will be determined at the sole discretion of the Promotor.

Eligibility

9. Entry is free to enter for Open Road readers aged 21 years old or over.

10. Employees of the Promotor and its Related Bodies Corporate (as this term is defined in the Corporations Act 2001 (Cth) and their immediately family, and any person involved in the management of the Promotor and their immediately family, are prohibited from taking part in the Promotion.

11. To protect the integrity of the competition, the Promotor reserves the right, at its sole discretion, to verify, at any time (including after the closing of the Promotion) the validity of all entries (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits invalid, incomplete, indecipherable, or illegible entries, or tampers with the entry process, or uses any automated entry software or any other mechanical or electronic means to submit repeated entries.

Judging Criteria
12. Judging Criteria is based on originality and creativity.

a) Judging will take place at the premises of the Promotor, being 53B Montreal Street, Sydenham, Christchurch 8023, New Zealand at 1:00pm (Sydney time) on Monday 5 June 2023. Entries will be judged by a panel of three (3) judges appointed by the Promotor.

b) The Participant who submits the best entry (as determined by the judges) will win the Prize (winning Participant). The judges' decision is final, and the Promotor will not enter into correspondence regarding the result.

Prize
13. There is one (1) prize to be won (Prize) by the winning Participant. The total value of the Prize is $23,900 including GST (as at 30.03.2023) in Australian dollars.

14. There are no bonus prizes awarded in this Promotion.

15. The prize value is correct at the time of publishing and the Promotor accepts no responsibility for any subsequent variation in the prize value.

16. The Prize consists of 1 x Deck 4 Superior Stateroom, twin share on Heritage Expeditions Kimberley Explorer voyage departing Darwin on 20 August 2023 and concluding in Broome on 30 August 2023.

17. The Prize includes:

Landing fees
Post cruise transfer to a central Broome hotel or to Broome International Airport
All on board ship accommodation with meals
House wine, beer and soft drinks with lunch and dinner
All expedition shore excursions (excluding optional excursions)
Programme of lectures by noted naturalists.

17. The Prize does not include items of a personal nature, laundry, drinks, WiFi, gratuities, international or domestic flights, optional helicopter excursion, visas or travel insurance. This remains the responsibility of the winning Participant and their guest.

17.1 Travel or entry documentation (Visas) and arrival fees are the responsibility of the winning Participant and their travel companion. It is the winning Participant's responsibility to check with all government travel advisory and immigration authorities regarding travel requirements and eligibility. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements will be the sole responsibility of the winning Participant and their travel companion.

17.2 Any mandatory conditions related to taking the prize are the responsibility of the winning Participant and their travel companion. If the winning Participant or their travel companion have not complied at the time of travel, boarding may be denied and the prize duly forfeited. This includes any third-party vaccination requirements from any travel operator required to take the prize. If travel and quarantine restrictions imposed by the Australian Government, the winning Participant's ability to take the prize as stated, Heritage Expeditions will make every effort to defer the departure date to a date of their choosing.

17.3 All elements of the Prize must be taken together. Travel restrictions may apply. The winning Participant and their travel companion must travel together. Any meals or tips which are not included in the Prize, transfer fees, passports, visas, telephone charges, laundry, additional nights or upgrades or any other personal expenses, travel insurances and return flights are the responsibility of the winning Participant and their travel companion. If for any reason the winner is unable to accept the Prize as stated, and within the date indicated, the winner will forfeit that Prize and no compensation will be given in lieu.

17.4 Any travel or entry documentation and arrival fees are the responsibility of the winning Participant and their travel companion. It is the winning Participant's responsibility to check with all government travel advisory and immigration authorities regarding travel requirements and eligibility. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements are the sole responsibility of the winning Participant and their travel companion.

17.5 If any portion of the Prize is unavailable, for whatever reason, the Promotor reserves the right to substitute the Prize, or that element of the Prize, for a Prize of similar theme and of equal value, subject to State regulation and subsequent approval.

17.6 In the event of war, terrorism, state of emergency, pandemic, disaster or any other circumstance beyond the control of the Promotor, the Promotor reserves the right to either provide an alternative travel destination to the same value as the original Prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion. The Promotor and the associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the winning Participant and guest to first check with all government travel advisory information regarding the safety.

17.7 The Promotor is not responsible for any cancellation, postponement, delay or rescheduling of transport and any costs incurred as a result, including, without limitation, any accommodation costs will be the sole responsibility of the winning Participant and their travel companion.

18. If the Prize is unavailable, the Promotor reserves the right to substitute the Prize with a prize of equal value or specification, subject to any written directions given by the applicable regulator. No responsibility or liability is accepted for any variation in the value of the Prize. The Prize is not transferable or exchangeable and cannot be taken as cash. The Prize must be taken as offered and cannot be varied. If for any reason the winner is unable to accept the prize as stated, the winner will forfeit the prize and no compensation will be given in lieu.

19. The winning Participant will be notified by the Promotor with a phone call, followed by a confirmation email by 5:00pm on the dates outlined in paragraph 12, and their name published on www.mynrma.com.au. Only the winning Participant will be notified.

20. The winning Participant must claim their prize within 2 weeks of being notified by email. Winners who do not claim their prize within this period will be disqualified and their prize made eligible for redraw under these Terms and Conditions. If there is no winner that information will be published on www.mynrma.com.au.

21. Subject to any directions from the applicable regulator, any re-selection of a winner which occurs as a result of an unclaimed prize will take place at 4:00pm (Sydney time) on Tuesday 13 June 2023.

22. Standard terms and conditions of travelling with Heritage Expeditions Apply. See Booking and Travel Conditions at www.heritage-expeditions.com/terms-conditions/ which all guests are bound by.

Personal Information and Privacy
23. The details contained in each Participant's entry are protected by security safeguards as detailed in the Promotor's Privacy Policy, which is available at www.heritage-expeditions.com. Personal information will only be used in accordance with the Promotor's Privacy Policy and these Terms and Conditions.

24. Participants can contact the Promotor's Privacy Officer if they would like details of the personal information about them held by the Promoter, or to exercise any of their rights under the Privacy Act 1988 (Cth):

25. The Promotor and its related companies may, for a reasonable period, unless otherwise advised, use a Participant's personal information (such as name, age, mobile phone number or email address) and any other information provided to the Promotor pursuant to this Promotion without remuneration or compensation to the Participant for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning for marketing purposes (for example by promoting the Promotor, its business and related companies).

Limitation of Liability

26. Subject to any applicable guarantee, warranty, right or condition which cannot by law be excluded or limited, or the exclusion of which would invalidate some or all of these Conditions of Entry, including without limitation under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (Non-excludable Condition), the Promotor is not responsible for and excludes all liability (including negligence) for and in relation to any loss or damage (including loss of opportunity, loss of profit, and any indirect, special or consequential loss) arising in any way suffered or incurred (including without limitation death or injury) by reason of any act or omission, including without limitation negligence, by the Promoter in connection with the Promotion. Without limitation, this applies to:

a) any technical errors or equipment malfunction including any interruption, defect, or delay in operation or transmission or a carriage service, communications line or network (whether or not under the Promotor's control);
b) any unauthorised access to or third party interference with the Promotor's CAD;
c) any entry that is late, lost, altered, deleted or misdirected (whether before or after receipt by the Promoter) due to any reason beyond the reasonable control of the Promotor; and
d) any tax or other regulatory liability incurred by a Participant in relation to a Participant's participation in the Promotion.

27. The Promotor and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any Prize or using any Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

28. Subject to any Non-excludable Condition, all guarantees, representations, conditions and warranties of any nature are expressly excluded.

29. Subject to any Non-excludable Condition, the Promotor may:

a) modify or suspend the Promotion if all entrants participating in the competition until that point are notified of the changes to these Conditions of Entry, upon notification of any such changes, the affected entrants may terminate their participation in the competition without any liability to the entrant; or
b) suspend, terminate, or cancel the Promotion, and the Promotor will not be liable to any person for any such modification, suspension, termination, or cancellation.

30. The Promotor has no liability to any person for any dispute between a Participant or its officers, employees, agents, contractors, or consultants in relation to the Promotion.

31. Failure by the Promotor to enforce any of its rights at any stage does not constitute a waiver of those rights.

32. The Promotor does not guarantee or otherwise make any representation that a Participant will receive any, or a specific, prize under the Promotion.
