Terms and Conditions
Information regarding prizes, how to enter and terms applicable to the particular promotion that you are entering, form part of these terms and conditions (Terms). By entering, you accept the Terms. By participating in any competition you are deemed to have accepted the Terms.
The Promoter is Kirstin Ash Pty Ltd (ABN 36 130 254 321) of co/Bell Partners Suite 602, Level 6, 2-8 Brookhollow Avenue, Norwest, NSW, 2153 (“Promoter”).
Nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any consumer rights under any applicable law including the Australian Consumer Law.
To take part in this promotion you must be an Australian resident aged 18 years or older. Directors, management and employees of the Promoter and associated companies and agencies as well as the immediate families of each of these people are not eligible to enter. If it is found out that a winner is in breach of any of these requirements, they will be automatically disqualified.
The promotions starts at 12 am on 19 February 2024 and finishes at 11.59 pm on 29 February 2024 (“Promotional Period”). All valid entries must be received by the Promoter during the Promotional Period.
Entry to the promotion is via the link on the kirstinash website where you can choose the promotion that you would like to enter. Details of how the promotion will be run including prize details, how to enter, time and method of draw will be on the kirstinash.com.au website.
To enter, you must:
(a) Visit the kirstinash website and click on the link, then fill out the entry form which will include entering your name, email, date of birth, telephone number and instagram handle (“Personal Information”)
(b) Follow @kirstinash, @theluxenomad, @bondeyeswim, @ereperezcosmetics and @anandathuvillas Instagram Accounts.
(c) For bonus entry, like the post on @kirstinash Instagram account promoting the Kirstin Ash Holiday Giveaway promotion, tag the friend you will take (should you be successful) in the comments section on this post and share the post to them.

Kirstin Ash Gift Voucher
The Kirstin Ash Gift Voucher is valid for three (3) years from the date of issue and valued at one thousand Australian dollars (AUD$1000). The Gift Voucher will be valid for use only at the kirstinash.com.au Australian online store. Total prize value is AU$1000.

The three night stay at the Anandathu Villas in Bali, Indonesia. The prize includes a stay at a two bedroom villa for up to four people only. This prize is inclusive of accommodation and airport > accommodation return transfer in Bali only and excludes meals and other transportation. This prize voucher is valid for one (1) year after the end of the Promotional Period. The Competition winner must pay separately for any additional night’s stay, meals and other rental items or services at the Anandathu Villas. This prize may be redeemed 30 days or less prior to arrival. Booking using this prize is subject to availability and can only be redeemed during normal and shoulder seasons. Block off dates apply. The prize may not be redeemed as an event venue. Prize is strictly non-transferable and cannot be extended, resold, exchanged, or converted to cash. The Ere Perez Gift Voucher is valid for three (3) years from the date of issue and valued at five hundred Australian dollars (AUD$500). The Gift Voucher will be valid for use only at the ereperez.com online store. If shipping costs are not included at checkout on the ereperez.com online store, these costs are the responsibility of the Winner. The All Eyes On You Bundle will be sent to the Kirstin Ash Holiday Giveaway Competition Winner by mail to the address nominated. Total prize value is AU$622.
The Kirstin Ash Holiday Giveaway Competition winner will be contacted via the email provided on 01 March 2024 at 10 am. The prizes will be sent via email. If a prize is required to be sent by post, the winner will be asked to provide their address details.
Any prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter is not liable if there is any variation in the value of any prize.
Multiple entries are accepted.
The Promoter is not liable in any way if your name, address, email address or any other information that you gave to the Promoter is incorrect or if you fail to comply with terms of any email or fail to collect the prize.
The Promoter reserves the right to void any entry that is in breach of these Terms at its sole discretion.
The winner will be randomly drawn by the Promoter.
For prizes that can be posted, they can only be sent to Australian addresses using the Australia Post network and the Promoter has no liability for any lost or damaged prizes once they are sent. The Promoter reserves the right to verify your identification prior to awarding the prize.
Only the winner will be notified by email and must respond within seven days of the notification email being sent by the Promoter. If the Promoter does not receive a response within this time, the prize may be re-allocated and given to one of the remaining entrants at the sole discretion of the Promoter.
If the prize is unavailable for any reason, the Promoter, in its discretion, reserves the right to substitute the prizes with gift/s of equal value and/or specification, subject to any written directions from a regulatory authority.
All entries in a promotion become the property of the Promoter. By entering the promotion, you consent to your name being disclosed on the @kirstinash Instagram page and the kirstinash.com.au website and on the websites or social media pages of any of the prize suppliers.
The following terms apply in relation to the collection and use of your Personal Information:
(a) the Personal Information is collected by the Promoter in order to conduct the Promotion;
(b) you consent to the Promoter disclosing the Personal Information to third parties including the prize suppliers and the Promoter’s agents, contractors, service providers and, if required, Australian regulatory authorities;
(c) unless you unsubscribe from the Promoter’s communications or notify the Promoter that you no longer wish to receive communications, by entering into the Promotion, you consent to the use the Personal Information for surveys or marketing purposes (including direct marketing communications which can include contacting you by telephone or electronic messaging), publicity, and for the use of analytics services to collect information regarding visitor behaviour and visitor demographics on our website and services;
(d) by entering the Promotion, you also consent to third parties, with whom the Promoter has shared the Personal Information, using the Personal Information as outlined in paragraph 23(c) above; and
(e) you can opt out at any time from receiving direct marketing communications by following the information for unsubscribing in the relevant communication.
The Promoter and its associated agencies and companies as well as the companies associated with this promotion will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
If the operation, security or integrity of the promotion is compromised for any reason beyond the Promoter’s reasonable control, including non-authorised human intervention or tampering, the Promoter may suspend, modify or terminate the promotion. If the promotion is terminated before its stated end date, the Promoter may award prizes based on the entries received before that date.
The Promoter is not responsible for any tax incurred by the winner as a result of the prize and is not responsible for any costs associated with the prize once the prize has been awarded.
The Promoter’s decision is final and no correspondence will be entered into.
The Kirstin Ash Holiday Giveaway Competition is in no way sponsored, endorsed or administered by, or associated with Instagram or any other platform operator (“Platform Operator”).
The following terms apply to the extent that the Promotion is conducted on, advertised or promoted on a social media platform owned by a third party:
a) each Entrant acknowledges and agrees that the Promotion is in no way sponsored, endorsed or administered by, or associated with, any Platform Operator;
b) each Entrant releases each Platform Operator and its associated companies from all liabilities arising in respect of the Promotion;
c) to the extent relevant to the Promotion, the Promoter agrees and each Entrant must agree to adhere to the prevailing terms and conditions of each Platform Operator;
d) Entrants understand that they are providing their information to the Promoter and not to the Platform Operator;
e) Entrants are solely responsible and liable for any content or information they transmit to other users of the Platform Operator; and f) any questions, comments or complaints about the Promotion must be directed to the Promoter not the Platform Operator
