The contest is sponsored by Eclipse Records, Inc. (“Sponsor”) and one (or more) of the bands we represent (“Co-Sponsor”). This contest is governed by these rules (“Official Rules”). By participating in the contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the contest, as determined by Sponsor and its agents, are final in all respects. The contest is subject to all federal, state and local laws and regulations and is void where prohibited by law. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, or any other third party. Any questions, comments or complaints regarding the promotion will be directed to Sponsor, not Facebook.
Eligibility
Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations. Sponsor has the right to verify the eligibility of each entrant. Entry is for one (or more) chances to win a prize. Winning is not guaranteed. Open only to persons 13 or older upon entering who are legal residents of, and physically located within, any country located within territories known as The Americas (USA, Canada, South America), Europe (any country within the EU or the UK), Oceana
(Australia, New Zealand) herein known as (collectively, “Territory”) and not employees of Sponsor; its parent, subsidiary, affiliated or successor companies; affiliated recording artists; or the advertising, promotional or fulfillment agencies of any of them (individually and collectively, “Entities”); nor members of their households or immediate families. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider, Website or other connections; telephone or cell phone availability or accessibility; miscommunication; failed computer, satellite, telephone or cable transmissions, lines or technical failure; jumbled, corrupted, scrambled, delayed or misdirected transmissions; computer hardware or software or text message malfunctions, failures, technical errors or difficulties; unauthorized human intervention; traffic congestion; undelivered emails resulting from any form of active or passive email filtering; insufficient space in entrant’s email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified and any attempt by a person to use multiple Accounts to register more than once, or incorrectly follow directions on certain entry actions, or to undo any actions required to enter the Contest, or individuals who enter by way of referral from designated “contest farm” or “sweeper hangout” or “sweepstakes listing” websites, may result in disqualification at Sponsor’s sole discretion.
Contest Announcement
The post on the Sponsor website announcing the Contest shall be referred to herein as the “Contest Announcement”.
Contest Period
The Contest will begin on the date & time that the Contest Announcement is published. The Contest shall end on the date specified within the Contest Announcement at 12:00 Noon, EST, (“Contest Period”) unless otherwise specified. All entries (submissions) must be received on or before the time stated during that submission period. Sponsor reserves the right to extend or shorten the contest at their sole discretion.
How to Enter
You can enter the Contest through the Sponsor website (
www.eclipserecords.com), through the Sponsor Facebook Page (
www.Facebook.com/EclipseRecords), or through any other valid link or location. You can find the instructions within the Contest Announcement, which typically consists of instructions to take certain actions such as subscribing to Sponsor’s newsletter, following various social accounts, watching a video, liking or commenting, sharing, tweeting, or providing your email address in order to be eligible to participate in the contest. Some actions may require you to have an account with a paid service (such as Spotify for example) however; it will make no difference if you have a premium or free membership. After submitting the required information, the entrant will receive one (1) or more entries into the drawing. Entrants may like, share, or comment the Contest Announcement as many times as they choose, however (depending upon the contest) doing so may or may not result in additional entries.
Winner Selection
All eligible entries received during the Submission Period will be gathered at the end of the Submission Period. Any contest entries through the use of automated applications, scheduled posts or spamming of social networks, dummy accounts, or bots of any sort will be deemed void. A winner will be chosen at random. The winners will be announced on or about the end of the Contest Period (typically within the next 7-14 days, herein referred to as the “Notification Date”). Sponsor may notify the winner(s) by sending an email, by replying to the Contest Announcement, or through one of several social media messaging systems. Winner(s) must reply to Sponsor’s email within three (3) days of the Notification Date in order to receive instructions on how to claim the prize, or forfeit their winning. Each entrant is responsible for monitoring his/her email &/or Facebook account for prize notification and receipt or other communications related to this Contest. If a potential prize winner cannot be reached by Administrator (or Sponsor) within three (3) days, using the above mentioned methods, or (if after mailing) the prize is returned as undeliverable, that potential prize winner shall forfeit the prize. After Winner(s) have been notified and shipped their prize, they will be announced via the Contest Widget located on Sponsor website. Sponsor may also elect to announce Winner(s) via other methods. Upon the request of the Sponsor, the potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form and IRS W-9 form. If a potential winner fails to comply with these official rules, that potential winner will be disqualified. Prizes may not be awarded if an insufficient number of eligible entries are received. Prize will be shipped to winner via standard first class mail to the address specified by Winner upon acceptance of winning the contest. If Winner would like their prize shipped using additional services such as Priority Mail, Tracking, or Insurance, Winner must notify Sponsor of said request, and Winner must first pay additional fees as necessary to do so.
Prizes
The Prize(s) shall be specified within the Contest Announcement. Terms and conditions may apply. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. With specific regards to prizes such as clothing (any items that may come in various sizes), Sponsor will try to accommodate Winner with requested size, however Winner accepts and acknowledges (before entry) that the item(s) may not be available in requested size and whatever size is available will be shipped instead. With specific regards to prizes such as a Spotify Premium Subscription or Spotify Gift Card, said prize may not be an actual physical card, but a code or PIN which will be emailed by Sponsor to said Winner, and which may be redeemed at this location. With specific regards to prizes such as free tickets to any event, said prize shall be limited only to the ticket(s) themselves, and shall not include transportation, and winner must provide his/her own transportation to the event. Sponsor may rely upon third parties who commit to donate one or more items to the Prize Pool (“Affiliate”) to ship said items on behalf of Sponsor. In the event Affiliate fail to ship item(s) as agreed upon, Winner will hold Sponsor, Releasees, and Affiliates free from any claims whatsoever. Sponsor or Affiliate will ship the Prize to Winner without insurance or tracking, unless requested (and paid for in advance) by Winner. Sponsor and its Affiliates are not responsible for any loss or damage of the Prize(s) by third parties during transit. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.
