TERMS AND CONDITIONS:

1. 1. KFC Adco Limited (ABN22 083 047 992) of 20 Rodborough Road, Frenchs Forest NSW 2086, telephone 1300 749 924 is the promoter (“Promoter”) of the promotion described as the “Kentucky Fly Chicken” (“Promotion”) in the terms and conditions set out below (“Terms and Conditions”). 
2. Information on how to enter the Promotion and the details of the prize forms part of the Terms and Conditions. 
3. Participation in this Promotion is deemed acceptance of the Terms and Conditions.
Eligibility to Enter
4. Entry into the Promotion opens at 4:00pm AEDST on 03/03/2024 and closes at 11:59pm AEDST on 18/03/2024 (“Promotional Period”).
5. To be eligible to enter, an entrant must be an Australian resident aged 18 years or over with:
* a) an Australian or New Zealand passport valid for international travel; and
* b) with 6 months or more validity until the expiry as at the date of travel set out in clause 15
* c) who meets the entry criteria in clause 7; and
* d) Who consents to the Promoter conducting an Australian national police check and such a police check returns no serious outcomes or matters against the entrant within the records of police services.

How to Enter
6. During the Promotional Period, the Promoter will include in the KFC app (“KFC App”) an image of a KFC menu item which is available in KFC restaurants in a country other than Australia (“Promotional Food Item”). For clarity, the image of the Promotional Food Item is included by the Promoter in the KFC App for the purposes of entry into the Promotion only and is not a real food item available for purchase at KFC restaurants in Australia. It will appear on the KFC App as costing $0. 
7. To be eligible to enter, individuals must undertake the following steps during the Promotional Period:
* a) visit the KFC App and log in or register to create an account;
* b) make sure that all personal account details are up to date and correct as they will be used to contact the individual in the event they are drawn as a winner;
* c) Select “pick up” or “delivery” and choose a preferred store;
* d) locate the image of the Promotional Food Item within the KFC App and click on it;
* e) follow the prompts that appear in the pop-up window to begin to create an entry into the Promotion;
* f) including:
* i. clicking to agree to these Terms and Conditions; and
* ii. clicking to confirm
* i. eligible to respond to the Promoter’s winner notification within 24 hours of the time the Promoter sends the notification;
* ii. available to travel to the prize destination as detailed in clause 15;
* iii. a holder of a valid Australian or New Zealand passport; and
* iv. over 18 years of age.
* g) click to add the image of the Promotional Food Item to their cart for $0;
* h) add a second item to their cart being any other food or beverage item available for purchase on the KFC App in Australia;
* i) ensure that the total cost of the cart meets the minimum spend required for entry being $1 for pick up; and
* j) purchase the items in the cart (including the image of the Promotional Food Item for $0) and as per the normal purchase completion process.

By agreeing to the above, when prompted, the Promoter will use the customers contact details from the KFC App for the purposes of the draw and winner notification where relevant.
8. A customer may submit multiple entries to the Promotion, subject to the following: a) only one (1) entry permitted per transaction; b) each entry must be submitted separately and in accordance with the entry requirements as set out in these Terms and Conditions; and c) only one (1) entry is permitted per person, per day.
9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and the results of any Police Check) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
10. Incomplete or illegible entries will be deemed invalid. Entrants whose police check returns any serious outcomes or matters, as determined by the Promoter in its sole and absolute discretion will also be deemed invalid.
11. Employees (and their immediate families) of the Promoter, its associated entities and franchisees and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant using reasonable means available to it.
Draw
13. The draw will take place at Anisimoff Legal, 3 Amy Close, Wyong NSW 2259 on 19/03/2024 at 1:00pm AEDST, in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified immediately in writing and by phone to the contact details that they used to log in or create an account on the KFC App, on the same date as the draw and their name will be published on the same date as the draw. The drawn winner will be deemed a provisional winner subject to verification by the Promoter that all Terms and Conditions have been satisfied and a Deed of Release signed. The drawn winner must respond to the Promoter's winner notification by email or phone within 24 hours of the time the Promoter’s winner notification was sent to the drawn winner in order to claim their prize, should they be deemed eligible. If a drawn winner is contacted and deemed invalid or ineligible, the Promoter will revert to a reserve entry (as indicated above) and the notification process will start again. If however, the drawn winner is unable to be contacted and/or fails to respond within 24 hours of the Promoter’s notification, the Promoter will conduct an unclaimed prized draw in accordance with Clause 24 and 25.
14. The Promoter’s decision is final and no correspondence will be entered into.
Prize and Prize Requirements
15. The first valid entry drawn will win a trip for themselves to Mexico City, Mexico valued at up to AU$16,815 depending on point of departure and with travel arrangements selected by the Promoter in its absolute discretion. The prize is for one (1) person and includes:
* • Return business class airfares from the winner's Australian nearest capital city to Mexico City, Mexico with flights departing on 23rd March 2024;
* • Six (6) nights in minimum 4 Star accommodation;
* • AUD $1000 spending money;
* • up to $5k of experiences to be organised by the Promoter, in accordance with clause 18 below; and
* • Travel insurance for the winner.
4. 
As part of accepting the prize, the winner agrees that they will be required to visit a KFC restaurant in the destination location during their trip to collect and try the Promotional Food Item. The winner agrees that the Promoter reserves the right to film this process for future promotional and marketing purposes. Filming may include, but is not limited to, videos and stills content of the winner in the relevant KFC location and/or surrounding landmarks. The winner acknowledges that KFC staff member/s may also form part of the filming process. Content created, may be used for KFC owned social and digital channels and KFC will own all copyright in any content collected.
Additional spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. 
16. The winner is responsible for ensuring that they have valid passport with at least 6 months validity at the time of travel, and any requisite visas, vaccinations and travel documentation. The winner must depart from and return to the same departure point. The itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
17. The winner will be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the winner, the winner agrees that it forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter’s nominated travel insurer, including but not limited to any limitations on the covered amount. The winner is deemed to accept the adequacy of the travel insurance provided by the Promoter. If the winner requires additional travel insurance to cover any risk or for any amount higher than the travel insurance provided by the Promoter’s nominated travel insurer, the winner must effect the additional travel insurance at their own expense. The winner, by commencing the trip, is deemed to have reviewed and determined the adequacy of the terms and conditions of the travel insurance organised by the Promoter or must notify the Promoter if they have effected additional travel insurance and the terms and conditions of same.
18. As part of the prize the entrant will have the option to redeem various experiences that will be offered by the Promoter for the duration of the prize, including without limitation tours, tickets to shows, dinners, lunches etc. Exact extent of the experiences will be determined between the winner and the Promoter. In the event that the winner does not redeem the entire value or any particular experiences, that value will be forfeited and will not be redeemed for cash.
19. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash. 
20. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
21. Subject to the unclaimed prize draw clause, if for any reason the winner does not take / redeem the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. 
22. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize (or part of the prize) to the equal value and/or specification, subject to any written directions from a regulatory authority.
23. Total prize pool value is up to AUD$16,815. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 
24. A draw for the prize, if unclaimed, may take place on 21/03/2024 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified immediately in writing and by phone using the contact details provided to login to or create their KFC App, on the same date as the draw and their name will be published online on the same date as the draw. 
25. The drawn winner in an unclaimed prize draw will be deemed a provisional winner subject to verification by the Promoter that all Terms and Conditions have been satisfied. The drawn winner in an unclaimed prize draw must respond to the Promoter's winner notification by email and phone within 24 hours of the time the Promoter’s winner notification was sent to the drawn winner in order to claim their prize, should they be deemed eligible. If a drawn winner in the unclaimed prize draw is contacted and deemed invalid or ineligible or fails to respond within 24 hours of the Promoter’s notification, the Promoter will revert to a reserve entry drawn in the unclaimed prize draw. If, after a reasonable attempt to determine a valid winner prior to the departure date, the Promoter has been unable to award the prize, the prize will be forfeited. 
26. Entrants consent to the Promoter using their name, likeness, image and/or voice (“Content”) in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration
