MASTERFOODS: WIN A PANTRY FULL OF MASTERFOODS PRODUCTS
1. Terms & Conditions: Information on how to enter forms part of the terms and conditions of this promotion. Entry to this competition is deemed acceptance of these terms and conditions.
Headings in this document are included for ease of reference and do not affect interpretation in any way.
2. Overview: This competition asks social media users to share a photo of their spice rack and tell us in 25 words or less why they love their spice rack. It must include the hashtag #ShowUsYourSpiceto be valid for entry.
3. Promoter: The promoter is Enthral Pty Ltd ACN 168 037 590 of 20 Market Street, Southbank VIC 3205.
The prize provider is Mars Australia Pty Ltd trading as Mars Food Australia ABN 48 008 454 313 (Prize Provider).
4. Promotion Period: The competition commences on 19 March 2024 and closes at 23:59:59 AEDT on 27 March 2024.
5. Who may enter: Entry is open to all social media users who have a public profile, are based in Australia, are 18 years or older, excluding directors, management, employees and their immediate families of the Promoter, the Prize Provider and their related bodies corporate.
Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
6. How to enter: To enter, eligible entrants must, during the Competition Period, post a photo of their spice rack in their personal Instagram feed and tell us, in 25 words or less, why they love their spice rack (Submission).
The Submission must include the hashtag #ShowUsYourSpice and tag @Masterfoods. Entrants must have their profile set to public.
Entrants may only enter this promotion once. If the Promoter receives more than one Submission from an entrant, only the first Submission received will be considered, and all others will be disregarded.
7. Time of entry: The time of entry will be deemed to be the time the eligible Submission is received by the Promoter.
The Promoter is not responsible for any transmission failures, any lost, late or misdirected Submissions, or any failure of an entrant to provide correct contact details (including their name, email address and phone number) when sending the Submission.
8. Verification: The Promoter reserves the right, at any time, to verify, or require that an entrant verifies, the validity of entries (including the originality of any Submission) and/or the eligibility of an entrant to enter this promotion.
The Promoter may, in its sole and absolute discretion and without limiting any other rights available to it, disqualify any person who tampers with or attempts to circumvent or breach the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Judging of entries: Entries will be judged based on the originality and creativity of the Submission. Judging will take place 10:00am AEDT on 3 April 2024 at the offices of the Promoter. Judging will be conducted by the Promoter and Talent, Sabina Read.
The judges’ decision is final and no correspondence will be entered into in respect of the selected winner. This is a game of skill. Chance does not play any part in determining the winner.
10. Notifying winners: Each winner will be notified by email on or before 5 April 2024. Winners’ details may also be displayed on the website or social media pages of the Prize Provider.
11. Prizes: There will be one prize awarded, being a pantry full worth of a selection of MasterFoods products (including from its range of herbs, spices and sauces) to be delivered by the Prize Provider.
The winner will have 2 weeks (10 business days) to respond and supply their delivery details. After the 2 weeks has passed if the winner has not replied, another winner will be selected.
The prize will only be awarded to the entrant whose Submission is judged to be the best, as set out in these terms and conditions.
Prize cannot be transferred or exchanged nor redeemed for cash.
The maximum value of the prize is up to $450RRP as at the start of the Promotion Period.
The estimate of the maximum notional value of the prize is provided for information purposes only. Neither the Promoter nor the Prize Provider accept any responsibility for any variation in the value of the prize.
12. Key conditions of prize:
(a) The prize winner must be 18 years or older.
(b) The prize winner cannot exchange the prize for money or sell products.
13. Limitations of liability:
(a) If, for any reason, the competition is not capable of running as planned, including, without limitation, due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter or the Prize Provider that corrupt or affect the administration, security, fairness or integrity, or proper conduct of the promotion, the Promoter and the Prize Provider: (i) each reserve the right in its sole discretion to disqualify any individual who tampers with the entry process or take any other action, including to cancel, terminate, modify, or suspend the promotion; and (ii) will not be liable for any failure to perform or delay in performing its obligations.
(b) The Promoter, the Prize Provider, each of their related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs, illness or personal injuries arising out of this promotion or the redemption of prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
(c) The exclusion of liability in this section does not apply to limit or exclude liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).
14. Warranties: Entrants agree that they are fully responsible for any materials they submit via the promotion including, without limitation, any Submission (Entrant Content). Each entrant warrants that:
(a) all Entrant Content they submit or otherwise supply complies with all applicable laws and regulations, including without limitation, those governing copyright, defamation and privacy;
(b) they will not submit any Entrant Content that is unlawful or fraudulent, or that the Promoter or Prize Provider may deem to be defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, or otherwise unsuitable for publication;
(c) their Entrant Content will not contain viruses or cause injury or harm to any person or entity; and
(d) the Entrant Content is their original work, does not infringe the rights of any third party, and the entrant has the right to grant the rights to the Entrant Content contemplated by these terms and conditions.
Without limiting any other terms set out in this document, each entrant agrees to indemnify and keep indemnified the Promoter and the Prize Provider for any breach by that person of this section.
15. Use of Entrant Content: As a condition of entering this promotion, each entrant:
(a) grants to the Promoter, the Prize Provider, Nationwide News Pty. Limited ACN 008 438 828 (Nationwide News) and their respective affiliates and sub-licensees, a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable licence and right to use, reproduce, modify, adapt, publish and display their entry (including any Entrant Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability;
(b) consents to any use of the Entrant Content which may otherwise infringe the entrant’s moral rights pursuant to the Copyright Act 1968 (Cth); and
(c) consents to the Promoter, the Prize Provider, Nationwide News and their respective affiliates and sub-licensees, using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any good, services or activities of the Prize Provider.
16. Privacy: Entry details remain the property of the Prize Provider.
Entrants consent to the Promoter and the Prize Provider using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prize (including disclosing their personal information to third parties involved in the promotion and any applicable statutory authorities) and to conduct marketing activities.
Personal information provided by entrants will be used by the Prize Provider for the purpose of conducting this Promotion and otherwise in accordance with entrants’ consent and the above conditions. Personal information will be stored on the Prize Provider’s database. The Prize Provider is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at
www.mars.com/privacy. The Prize Provider’s privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Prize Provider holds about them and how the entrant may complain about any potential breach by the Prize Provider of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Prize Provider collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Personal information collected from entrants will not be disclosed to any entity located outside of Australia.
17. Tax implications: Neither the Promoter nor the Prize Provider accepts any responsibility for any tax implications that may arise from participating in this competition and/or accepting or redeeming any prize. Independent financial advice should be sought.
18. General: The Prize Provider reserves the right to choose which products are sent to the winner. By participating in this promotion, you agree to be bound by all such terms and conditions.
The promotion is in no way sponsored, endorsed or administered by, or associated with Instagram/Meta. Each entrant agrees to release Instagram/Meta from all liability in connection with, or in relation to, the promotion. The terms and conditions of the promotion do not intend to conflict with, or derogate from, Instagram/Meta’s terms and conditions of use, statement of rights and responsibilities (if any), data use policy or any other terms and conditions imposed on entrants from time to time to use the relevant social media platform.
19. Governing Law: These terms and conditions are governed by the laws of New South Wales. The Promoter, the Prize Provider and all persons who enter, or seek to enter, this promotion irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales.
