Terms and Conditions – Witchery – WIN TWO $1,000 WARDROBES – one for you and one for a friend

Competition means the referral Competition as described in these Terms and Conditions. The Competition Name is ‘Win Two $1,000 Wardrobes – one for you and one for a friend’.

Competition Commencement Date means Tuesday 9th April 2024 at 9.00am AEDT.
Competition Closing Date means Friday 19th April 2024 at 11.59pm AEDT.

Entrant means either an Initial Entrant or an Invited Friend.

Ineligible Entrant means:

Directors, management, officers, employees and contractors of the Promoter and associated agencies, retailers, suppliers and companies, and their immediate families.
"immediate families" includes his or her spouse, ex-spouse, de facto spouse, child, step child, adopted child, parent, step-parent, grandparent, uncle, aunt, siblings, step-siblings, or first cousin, whether or not they live in the same household as the director, manager, officer, employee or contractor.
Initial Entrant means entrants who satisfy the requirements of clause 2 and who have received a Witchery email invitation in accordance with clause 6.

Invited Friend means the individual invited by the Initial Entrant.

Prize means an AU$1,000 Witchery Rewards credit added to the Witchery Rewards member account of the winning Initial Entrant and an AU$1,000 Witchery Rewards credit added to the Witchery Rewards member account of the winning Invited Friend.

Promoter means Witchery Fashions Pty Ltd ABN 70 006 897 230 of Building 2, 572 Swan Street, Burnley VIC 3121, Australia.

Team has the meaning given to it at Clause 7.

Information on how to enter and Prizes form part of these conditions of entry. Entry into this competition is deemed to be acceptance of these conditions.
The Competition is open to legal residents of Australia and New Zealand, who have reached 18 years of age as of the Competition Commencement Date, and who are not an Ineligible Entrant. To be eligible to win a Prize, Entrants must be a Witchery Rewards member on the date on which the winners are drawn.
No purchase is necessary to enter the Competition. The Competition is subject in all instances to compliance with applicable law.
The Competition Period runs from the Competition Commencement Date to the Competition Closing Date. No entries will be accepted after this time.
The Competition is running across the website: comp.witchery.com.au (the ‘Competition Forum’).
To enter, each Entrant must, during the Competition Period (each an ‘Entry’):
An Initial Entrant, having received the email invitation to the Competition (the ‘Entry Form’), must complete all mandatory fields of the Entry Form, and submit the Entry Form per the instructions before the Competition Closing Date;
Upon successful submission of the Entry Form, the Initial Entrant will receive a unique link that must be sent by email to another individual (the Invited Friend). The Initial Entrant must have the consent of the Invited Friend to send them this message;
The Invited Friend, having received the email invitation to join the Initial Entrant in the Competition, must complete all mandatory fields of the Entry Form and submit the Entry Form per the instructions before the Competition Closing Date.
To earn one (1) Entry in the Competition, the Initial Entrant and the Invited Friend (collectively referred to as a ‘Team’) must have completed all the mandatory fields of each of their respective Entry Forms and submitted them prior to the Competition Closing Date. An Initial Entrant is allowed a maximum of fifty (50) Team Entries, provide each “Team” has a different Invited Friend.
Upon successful registration as a Team, each Invited Friend will then receive their own unique link by email giving them the opportunity to send this to a different friend and form a new Team for an additional Entry.
As a condition of entry, all Entrants must opt in to sign up as a Witchery Rewards member.
By entering the Competition, entrants agree to subscribe to Witchery’s marketing emails and consent to Witchery’s Privacy Policy.
In each scenario, each individual Initial Entrant and Invited Friend will only be allowed to form a Team once, as an instance of one Entry. The Invited Friend must be a different person from the Initial Entrant. Any attempt or suspected attempt to form a Team more than once with the same person by using multiple email addresses or pennames, or any use of robotic, automatic, programmed or any entry methods not authorized by these rules, shall be deemed as tampering and will void all Entries of that Initial Entrant and/or Invited Friend.
All Entries that are incomplete, illegible, damaged, contain an erroneous email address or do not conform to or satisfy any condition of the rules may be disqualified by the Promoter.
This Competition is a game of chance and skill plays no part in determining the winner.
Winners are determined by way of a prize draw (the ‘Prize Draw’). The Promoter will draw a random Team Entry from all valid Entries received during the Competition Period as the winner (‘Winner’). The Prize Draw will take place on Monday 22nd April 2024 at 1pm AEDT at the Promoter’s Head Office - Building 2, 572 Swan Street, Burnley VIC 3121, Australia. The Prize Draw will not take place publicly. The Winning Initial Entrant and Invited Friend will be notified by email (to the email addresses registered with the Promoter) on the date of the Prize Draw. Each Winner must claim their Prize by responding via email. It is the Entrant’s responsibility to ensure their email address is up to date on the Witchery Rewards profile. The Promoter will take no responsibility if a Winner’s details are incorrect or incomplete and the Winner cannot be contacted.
The Promoter will publish the results and the Winners’ names on its Facebook and Instagram feeds, on or before Friday 26th April 2024.
The determination of the Winners will be undertaken in a fair and transparent manner with each Entrant having an equal chance of winning. The Promoter’s decision is final and binding on all persons who enter this Competition, and no correspondence will be entered into.
In the event of the Prize being unclaimed by Monday 27th May 2024, the Winner of the Prize Draw will be deemed to have forfeited the Prize and the Promoter reserves the right to appoint a new Winner by conduct a Second Chance Draw. The Second Chance Draw will take place to determine replacement Winners on Tuesday 28th May 2024 at 11am AEDT at the Promoter’s Head Office. The draw will not take place publicly. The replacement Winners will be notified by email on the same day. The replacement Winners must claim their Prize by responding via email. The Promoter will publish the replacement Winners’ names on its Facebook and Instagram feeds, on or before Thursday 30th May 2024.
In the event that the winner of the Second Chance Draw cannot be contacted within 30 days or if the Prize cannot be redeemed by a Winner of the Second Chance Draw, that Winner will be deemed to have forfeited the Prize.
The Prize is an AU$1,000 Witchery Rewards credit added to the Witchery Rewards member account of the winning Initial Entrant and an AU$1,000 Witchery Rewards credit added to the Witchery Rewards member account of the winning Invited Friend.
Total prize pool value is AU$2,000. The Promoter reserves the right to substitute any component of the Prize if such component becomes available for any reason.
The Prizes must be accepted as awarded and are not transferable or otherwise redeemable for cash. The Prize must be taken as stated and no compensation will be paid if a winner is unable to use the Prize. In the event that the Prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a Prize, or element of it, of equal or greater value.
The Prize must be redeemed within 12 months after the Competition Closing Date. The Prize is redeemable at any Witchery store in Australia or New Zealand, online at https://www.witchery.com.au/ and on the Witchery app.
The odds of winning the Prize depend on the number of eligible Entries received. Upon acceptance of the Prize, the Winners agree to provide reasonable cooperation to allow the Promoter to use their name and/or likeness for advertising and publicity purposes for an unlimited period of time without remuneration in connection with this Competition including but not limited to publication of their name and photograph on the Promoter’s website, Facebook and Instagram feeds.
This Competition may be promoted through third party websites, like Facebook. Entrants must at all times comply with the terms of service for those third-party websites when using them to participate in this Competition. This Competition is in no way sponsored, endorsed, or administered by, or associated with those third-party websites.
Entrants who provide incorrect or fraudulent information are ineligible to participate in the Competition. The Promoter reserves the right to request at its sole discretion, appropriate photo identification or other documentation in order to confirm an Entrant’s eligibility to enter and claim a Prize, before issuing a Prize. If the documentation required by the Promoter is not received by the Promoter or its nominated agent, or the identity of an Entrant has not been verified or validated to the Promoter’s satisfaction, then that Entry will be deemed invalid.
Any costs associated with accessing the promotional website or entering the Competition are the responsibility of each Entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, or any other technical failures, including but not limited to any injury or damage to participants’ or any other person's computer related to or resulting from participation in or downloading any materials in this Competition. If for any reason this Competition is not capable of running as planned (including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to cancel, postpone, or amend this Competition.
The Promoter as well as its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with the Prize or use of the Prize. This excludes any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
If any of the provisions of these terms and conditions are held to be invalid or unenforceable in whole or in part that part shall be severed from the remainder of the provisions and the validity of the other provisions and the remainder of the provision in question shall not be affected.
These terms and conditions shall be governed by the laws of Victoria; Australia and any dispute shall be subject to the exclusive jurisdiction of the Australian courts.
The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s identity and age). Verification is at the discretion of the Promoter.
The Promoter also reserves the right to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Subject to the Promoter’s obligations at law, once the Team has received their Prize, the Promoter shall not accept any requests for exchanges or refunds for change of mind or other reason.
The Promoter collects personal information in order to conduct the Competition and also in order to conduct advertisements, publications, media statements and other promotional material associated with the Competition. The Promoter may, for these purposes, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional upon providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants may access, correct, change and/or update their personal information and obtain a copy of the Promoter’s privacy. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this Competition is governed by the Promoter’s privacy policy, available at https://www.witchery.com.au/help/privacy-policy/ .
If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
to delete any Entry;
to disqualify any Entrant from the Competition; or
subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
The Promoter accepts no responsibility for late, lost or misdirected entries or other communications.
Except any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following:
any theft, unauthorised access or third party interference;
any Entry or purchase of the Prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
any variation in Prize value to that stated in these Terms and Conditions; or
any tax liability incurred by an Entrant.
This Competition, or any aspect of it, may be changed or withdrawn by the Promoter at any time without prior notification.
Any attempt to deliberately damage the Promoter's promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this Competition may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of Entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
