The Promoter is Mars Australia Pty Ltd trading as Mars Petcare (ABN 48 008 454 313) of 1 Petcare Place, Wodonga, Victoria 3690, telephone 1800 649 111 (“Promoter”).
Information on how to enter and the prize(s) forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over.
Employees (and their immediate families) of the Promoter, Participating Stores (defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entries into the promotion open at 12:01am AEST on 08/05/24 and close at 11:59pm AEST on 18/06/24 (“Promotional Period”).
A participating store is any retail store (including instore or online) in Australia that is an authorised stockist of at least one (1) Optimum product range during the Promotional Period (each a “Participating Store”).
To be eligible to enter, individuals must purchase, in a single transaction, at least one (1) Optimum Dry pet food product, as listed in Annexure A (each an “Eligible Product”), from a Participating Store during the Promotional Period (“Qualifying Transaction”). If a staff member does not automatically hand the individual a purchase receipt after making a Qualifying Transaction, it is the individual’s responsibility to request such materials.
To enter, individuals must then, during the Promotional Period, complete the following steps:
Visit optimumpet.com.au/WINwithOPTIMUM or scan the QR code displayed on any promotional material and follow the prompts to the promotion entry page;
Input the requested details on the entry form (including but not limited to full name, valid email address, phone number);
Select the tick box to consent to receive promotional, marketing and research materials from the Promoter;
Upload a copy of their purchase receipt; and then
Submit the fully completed online entry form.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Entrants must retain a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the Optimum product/s purchased, the location of the Participating Store of purchase and that the purchase was made during the Promotional Period prior to entry.
Incomplete, indecipherable, or illegible entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction (regardless of the amount spent or Optimum products purchased in that transaction in excess of one (1)); and (b) each entry must be submitted separately and in accordance with entry requirements.
Limit one (1) prize per person (excluding SA residents).
This is a game of chance and skill plays no part in the determination of the winners. There will be a random draw conducted electronically. The draw will take place at Anisimoff Legal, G13, 3 Amy Close, Wyong NSW 2259 on 26/06/24 at 10:00am AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by email and phone within two (2) business days of the draw, and their names will be published online at optimumpet.com.au/WINwithOPTIMUM on 01/07/24. To claim their prize, a winner must respond to the Promoter’s email confirming their address and their nominated Optimum Dry dog or cat food diet preference and the size of their dog or cat by 11/09/24.
The Promoter’s decision is final and no correspondence will be entered into.
There are five (5) Major Prizes to be won. The first five (5) valid entries drawn will each win a year’s supply of Optimum Dry pet food, subject to clause 20 and valued up to AUD $1,800 each (“Major Prize”).
There are fifty (50) Minor Prizes to be won. The first fifty (50) valid entries drawn will each win a AUD $100 Prepaid Mastercard (“Minor Prize”).
The total prize pool is valued at up to AUD $14,000
Major Prize is subject to the following terms:
One year’s supply of Optimum Dry pet food is 12 months of dry food for one cat or one dog with the appropriate Optimum diet. The quantity defined as “1 year’s supply” is determined by the recommended feeding guide relevant to the recommended Optimum Dry pet food product and the size of the winner’s cat or dog, as prescribed on the back of the relevant product pack.
Subject to stock availability, the Major Prize winner can nominate their preferred cat or dog Optimum Dry food diet to be supplied. The Promoter will liaise with the winners to ensure the correct products and quantities are provided.
Products will be delivered to the winner’s nominated Australian mailing address, and cannot be delivered to a PO box, and a signature is required on delivery.

Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or element of a prize) at/by the time stipulated by the Promoter, then the prize will be forfeited.
If a prize (or any element of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or element of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Prizes are not transferable or exchangeable and cannot be taken as cash unless otherwise specified.
A draw for any unclaimed prizes may take place on 12/09/24 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and phone within two (2) business days of the draw and their names will be published at optimumpet.com.au/WINwithOPTIMUM on 16/09/24.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency, government lockdown, pandemic, technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

The promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform provider (including, but not limited to, the providers of Facebook, Instagram, TikTok and Twitter) or any of their related entities (each a “Media Provider”). Each entrant agrees to release any Media Provider from all liability in connection with, or in relation to, the promotion. These Terms and Conditions do not intend to conflict with, or derogate from, a Media Provider’s terms and conditions of use, statement of rights and responsibilities (if any), data use policy or any other terms and conditions imposed by the relevant Media Provider on entrants from time to time to use the relevant social media platform.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at
https://www.mars.com/privacy and is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth). In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
