Terms & Conditions:
1. Promoter: The competition is promoted by Kobayashi Healthcare Australia Pty Ltd (ABN: 90 162
966 127), hereafter referred to as “the Promoter.”
2. Eligibility: Entry is open to Australian residents aged 18 years and over. Employees of the
Promoter and their immediate families are ineligible to enter. A person who submits an entry to the
competition is described in these Terms as a "Participant".
3. Competition Period: The competition commences on 30 May at 12:00am AEST and
concludes on 21st August 2024 at 11:59pm AEST.
4. How to Enter: To enter, Participants must submit an answer to the question “Tell me in 50 words
or less how HotHands keeps you warm during winter?” Entries must be submitted through the
competition page on the website –
www.myhothands.com.au along with the Participant's full name,
email address, and phone number. Participants need to keep a copy of the receipt of purchase or
evidence of purchase which will be requested from the winning Participant.
5. Participants are responsible for ensuring that complete and accurate contact details are provided
with their entry. The Promoter will use these details to contact the winning Participants. If a
Participant cannot receive the winning notification direct message due to their issues (including if
they have entered their email incorrectly or if their email filters the winning notification to their
'junk' mailbox), or if they do not register the necessary information for prize mailing by the deadline
indicated in the message, the prize will be invalidated and the Promoter may choose a new winner
6. Judging Criteria: This is a game of skill. Chance plays no part in determining the winners. Each
entry will be individually judged based on originality, creativity, and relevance to the prompt. The
judge’s decision is final and no correspondence will be entered into.
7. Prize: $10,000 Travel voucher for 1 person, and Kobayashi gift pack such as Clearwipe,
Hothands, One Drop etc as a weekly prize]. The AU$10,000 travel prize cannot be transferred or
exchanged, and cannot be taken as cash. Prizes involving delivery of Hot Hands / Clearwipes
product cannot be exchanged for other products supplied by the Promoter or for cash. Nothing in
these terms purports to exclude consumer guarantees which may apply to goods delivered as prizes
under the Australian Consumer Law.
8. Winner Notification: Winners will be notified by email within 7 days of the competition closing
date. Winners will have 5 days from the date of notification to claim their prize. If a prize is not
claimed within this period or the Promoter cannot deliver the prize after making reasonable
attempts to do so, the Promoter reserves the right to select a new winner based on the
competition’s judging criteria.
9. Entry Conditions: By entering this competition, Participants agree to be bound by these Terms and
Conditions. Entries must be the original work of the Participant and not infringe the intellectual
property rights of any third party. Participants shall not exercise moral rights of authorship against
the Promoter in relation to information submitted as part of an entry, and if an entry includes rights
of third parties, such third parties shall not exercise such rights (including but not limited to moral
rights of authorship) against the Promoter. Entries must not be offensive, defamatory, or in breach
of any law. If the Promoter, in its absolute discretion, determines that an entry breaches these
terms, it will be invalidated without notice.
10. Privacy: The Promoter collects Participants' personal information, and may disclose such
information to third parties, including its agents, contractors, service providers, prize suppliers and
related bodies corporate, in order to conduct, administer and publicise the competition. If a
Participant does not provide the personal information requested, they may not be able to enter the competition. The Promoter's privacy policy (available at
https://www.kobayashihealthcare.com.au/privacy_policy) contains information about how
Participant can contact the Promoter to gain access to or seek correction of their personal
information or make a privacy complaint. The Promoter may use comments provided as part of an
entry to advertise the Promoter's products. The Promoter will not use or disclose personal
information of the Participant in connection with such advertisement.
11. Liability: The Promoter is not responsible for any loss, damage, or injury suffered by any
Participant as a result of their participation in the competition, except for any liability which cannot
be excluded by law.
12. Promoter’s Rights: The Promoter reserves the right to cancel, terminate, modify or suspend the
competition or these Terms and Conditions at any time and for any reason.
13. Governing Law: This competition is governed by the laws of Victoria, Australia. Participants submit to the juastriction of the courts of Victoria
