TERMS AND CONDITIONS:

1. The Trustee for CW Media Trust ACN 606 548 298, ABN 43 913 252 975, 6 Albert Street Preston, Vic 3072, on behalf of the Chemist Warehouse and e-Pharmacy group.

2. Terms of Entry

Competition entries can be made from 00.01am AEST on Thursday 13 June 2024 until 11.59pm AEST on Wednesday 26 June 2024 (‘Competition Period’) through the promotional websites.

(a) Entries received outside the Competition Period will not be eligible or accepted.

(b) Entries that are incomplete, illegible or indecipherable will not be valid and will be deemed void.

Entry is conditional upon spending $40 or more on any L’Oreal Paris product(s) in one (1) transaction in-store or online at Chemist Warehouse, E-Pharmacy or My Chemist and entering via the applicable URL (based on where the qualifying purchase is made) by providing their personal details as requested and their purchase receipt number for the qualifying transaction. The entrant must be able to provide proof of the qualifying transaction in the form of a valid purchase receipt number.

The Promoter takes no responsibility for entries that are lost, stolen, illegible, misdirected or damaged however caused.

(c) Submitting an entry constitutes acceptance of these terms and conditions.

(d) Multiple entries by eligible entrants are accepted, subject to entrants holding multiple proof of purchases with different valid purchase receipt numbers, subject to the following conditions:

(i) only one entry allowed per day during the Competition Period; and

(ii) only one (1) entry permitted per qualifying transaction.

3. Who May Enter

(a) The Competition is open to Australian permanent residents over 18 years of age.

(b) The Competition is not open to:

(i) Employees of the Promoter.

(ii) Parties to whom the Promoter has contracted work in relation to this Competition;

(iii) Parties who are otherwise directly involved with this Competition; and

(iv) Any immediate family members or any of the above mentioned parties.

4. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Major Prize Conditions:

a) The winner must be able to available to attend the L’Oreal Paris Le Défilé show on Monday 23rd September 2024 (there is flexibility on the day they leave and return, but they must be able to attend the show). Travel dates are to be confirmed once the winner has accepted the prize.
b) Travel itinerary will be determined by the Promoter in its absolute discretion.
c) The winner must contact the Promoter in order to book travel.
d) Prize is subject to the standard terms and conditions of individual prize and service providers.
e) The winner and his/her travel companion must depart from and return to the same departure point and travel together.
f) Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
g) The prize is subject to booking and flight availability.
h) The winner and his/her travel companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
i) Frequent flyer points will not be awarded and do not form part of the prize.
j) Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs, unless otherwise specified in the prize description, are not included.
k) The winner may be required to present their credit card at check in.
l) If the selected winner is not able to attend the L’Oreal Paris Le Défilé show on Monday 23rd September 2024, another winner will be re-drawn (as set out below).
m) If the winner wants to add further stops/extend their holiday, they will need to arrange at their own expense.

Tickets Prizes Conditions:
a) The Event tickets are subject to the event venue and ticket terms and conditions, including any applicable age restrictions. The Promoter and event organisers hereby expressly reserve the right to eject any winner and/or his/her companion for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
b) All costs associated with travel to and from the Event will be the responsibility of the winner and their guest for the prize.
c) Any ancillary costs associated with redeeming the VISA cash card are not included. Any unused balance of the VISA cash card will not be awarded as cash. Redemption of the VISA cash card is subject to any terms and conditions of the issuer including those specified on the VISA cash card.

5. Selecting the Winner

The Competition winners will be drawn at 3.00pm AEST on Thursday 27 June 2024.

(a) The Competition winners will be randomly selected by the digital team using random number generator software. The Competition will be drawn at 6 Albert Street, Preston VIC 3072 at 3:00pm AEST.

(b) The first eleven (11) valid entries drawn will win the prizes outlined above.

(c) The prizes will be drawn in descending order of value.

(d) The draw conductor may draw additional reserve entries in case an invalid entry or entrant is drawn.

(e) The Competition winners will be notified by SMS and email by 5.00pm AEST Thursday 27 June 2024. Whilst the Promoter will use its best endeavours to contact the winners within the abovementioned time, the decision not to award an entrant who cannot be contacted a prize is at the sole and absolute discretion of the Promoter and can be made at any time after the Competition winners have been selected.

(f) A person purporting to be a prize winner may be required to provide proof of identity and to verify any other eligibility requirements. In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.

(g) Subject to the unclaimed prize draw clause (outlined below), if for any reason a winner does not take/redeem the prize (or an element of the prize) within a reasonable time at/by the time stipulated by the Promoter, or is unavailable at the designated time for the Event or at the time stipulated by the Promoter for travel then the prize (or that element of the prize) will be forfeited.

(h) The supplier must contact the major competition winners within 7 days of the prize being drawn to facilitate travel arrangements and flight bookings.

6. Publication of winner’s details

The Promoter will publish the Competition winners on the Websites (outlined above) on Thursday 27 June 2024 and that information shall remain posted for at least 28 days.

Unclaimed Prizes:

Major Prize: If within one month after the determination of the Major Prize winner of the lottery, the prize has not been claimed by the winner, the Promoter will conduct a re draw for the prize on Monday 29 July 2024 at 10.00am AEST at 6 Albert Street, Preston VIC, 3072 and publish these details on the Websites (outlined above) on Monday 29 July 2024 by 5.00pm. The redraw winner will be contacted in writing on Monday 29 July 2024.

Minor Prize: If within two (2) months after the determination of the Minor Prize winners of the lottery, a prize has not been claimed by the winner, the Promoter will conduct a re draw for the prize on Wednesday 28 August 2024 at 10.00am AEST at 6 Albert Street, Preston VIC, 3072 and publish these details on the Websites (outlined above) on Wednesday 28 August 2024 by 5.00pm. The redraw winner will be contacted in writing on Wednesday 28 August 2024.

Privacy and use of personal information

(a) In accordance with the Privacy Act (1988) (Cth), the Promoter notifies entrants that entry to the Competition involves the collection of personal information about entrants, such as their name, address, mobile phone number and email address. This is collected for the purpose of establishing eligibility, carrying out the Competition and notifying the winner. If the information is not provided, the entrant may not participate in the Competition. Entrants’ personal information may be disclosed to State Lottery agencies and winners’ names published as required under the relevant lottery legislation.

(b) Each entrant consents to the Promoter using their personal information provided in connection with their entry, for the purposes of undertaking any investigation in connection with verifying the identity of an entry or any suspected tampering.

(c) Each entrant consents to the Promoter and its authorised licensees using the entrant’s name, likeness, image and/or photograph and voice in the event that they are the winner, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of promoting the outcome of this Competition.

(d) Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address stated in the Promoter section of these conditions. The Promoter's Privacy Policy, located at https://www.chemistwarehouse.com.au/aboutus/privacy, contains information about : (a) how entrants can seek access to the personal information the Promoter holds about them and seek the correction of such information; and (b) how entrants can complain about a privacy breach and how the Promoter will deal with such a complaint.

7. Discontinuation of the Competition or Disqualification of an Entrant

(a) Subject to State legislation; The Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute discretion may cancel, terminate or modify the Competition without the need to provide compensation to entrants or attempted entrants.

(b) The Promoter reserves the right, in its sole and absolute discretion to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with (or whom the Promoter reasonably suspects has tampered with) the entry process or the winner selection process or who has otherwise been misleading or fraudulent in the course of the Competition.

8. Exclusion of Liability

(a) The Promoter makes no representation nor provides any warranties as to the quality or suitability of the prizes offered.

(b) The Promoter is not responsible for any losses associated with any change to the value of any prizes.

(c) The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Competition or accepting or using any prize (or recommendation). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).

(d) The Promoter accepts no responsibility for any tax implications arising from a winner receiving a cash prize and the entrant must seek their own independent financial advice. If, for GST purposes, this Competition results in any supply being made for non-monetary consideration, entrants must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

(e) The Promoter’s decision on all matters relating to this Competition will be final.

(f) The Promoter is under no obligation to provide reasons for any of its decisions.

(g) The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants, or their representatives, in any matters relating to the Competition.

9. Entrants must keep their proof of purchase specified in the Terms of Entry section for each entry as proof of purchase ("Proof of Purchase"). If an entrant fails to produce the Proof of Purchase for a specific entry or each entry, as and when requested by the Promoter, the Promoter has the right to invalidate the entrant's respective entry/entries for which Proof of Purchase cannot be provided and/or all entries submitted by that entrant and/or forfeit the entrant's right to a prize. Purchase receipt(s) must clearly specify: (a) the store of purchase as an eligible store; (b) the required product/s or service/s to be purchased for entry; and (c) that the purchase was made during the Competition Period and prior to entry.

10. No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.

11. If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority.

12. Each prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

13. For the purposes of public statements and advertisements, the Promoter may only publish the winner's surname, initial and State/Territory or postcode of residence.

14. It is a condition of accepting the prize that a winner and their travel companion may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.

15. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry in the event of any inconsistency. To the extent permitted by law the Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.

16. If for any reason any aspect of this Competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Competition and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

17. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

18. Unless otherwise specified, a prize is a single event for the winner (and where relevant their guest) and cannot be separated into separate events or components.

19. L'Oreal is the prize supplier of this Competition only and takes no responsibility and accepts no liability for the conduct of the Competition.
