TERMS & CONDITIONS OF ENTRY
By entering the Win an Xtreme Weekend At Albert Park Thanks To Gates XtremeRunner Competition (“Competition”) you are agreeing to the following Terms & Conditions:
GENERAL TERMS
Information on how to enter (Competition) and prize details form part of these Terms & Conditions of entry.
Participation in the Competition constitutes acceptance of these Conditions of entry. Entrants must comply with these Terms & Conditions of entry to be valid.
PROMOTER’S DETAILS
The promoter is Gates Australia Pty Ltd of 200 National Drive, Dandenong South VIC 3175. (“Promoter”).
WHO CAN ENTER
The Competition is open to registered trade mechanical workshops within Australia with a valid ABN who are legally eligible to enter a contract Employees of the Promoter or the Promoter’s associated agencies or companies directly involved in the Competition and their immediate family members are ineligible to enter. Government Officials are also ineligible to participate as defined below
“Government Official” is defined as anyone who: (i) holds a legislative, administrative or judicial position of any kind whether elected or appointed; or (ii) performs public functions in any branch of local or national government; or (iii) is an employee, agent, or instrumentality of any government, public agency, or state-owned enterprise (including businesses that are fully or partially state owned enterprises, political parties, and candidates for office); or (iv) is an official for a public international organization
Those under the age of 18 are not permitted to enter the lottery.
HOW TO ENTER
The Competition commences at 9:00am Sunday 1st October 2024 (AEST) and entries close at 11.59pm Tuesday 31st December Australian Eastern Daylight Time (AEDT). (“Promotional Period”).
Participants can gain an additional ten (10) entries for every Gates XtremeRunner product purchased, by uploading proof of each purchase via the website

HOW TO WIN
Entrants will be selected by via random draw, conducted via randomdraws.com.au.
All prizes will be drawn at 10:00am AEDT on Monday 6th January 2025 at Gates Australia Pty Ltd of 200 National Drive, Dandenong South VIC 3175.;
The number of winning entries will be the same as the total number of prizes specified.
The list of winners shall be final and binding and no correspondence with entrants or any other person will be entered into.
Winners will be contacted via the email address or phone number supplied via the form.

TOTAL PRIZE POOL: $9,135.40
The prizes (including any unused portion) must be taken as stated, and are not transferable, exchangeable or redeemable for cash. The Promoter shall not be liable in the event that the winning entrants do not take, or are unable to use, the prize or any portion of it for any reason.
Entrants grant the Promoter permission to communicate with them by email and/or telephone in order to provide instructions as to how the winning entrant is to claim the prize and establish his/her entitlement to it.
If the prize is unavailable for reasons beyond the Promoter’s control, the Promoter, in its sole discretion reserves the right to substitute the prize with a prize of equal or greater value, subject to any written directions from a regulatory authority.
In participating in the Competition, the winner agrees to participate and co-operate as required in all editorial and media/PR activities relating to the Competition, including but not limited to being interviewed and photographed. The winner authorises the Promoter to use such footage and photographs together with the winner’s name, voice, video entry, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation or further reference to the winner.
The winner of the draw will be notified in writing within seven days of the major prize draw.
The winner’s details (last name, first initial and postcode) will be published on the Gates Promotional website within 30 days of the major prize draw.
UNCLAIMED PRIZES
Subject, where relevant, to any directions given under the legislation regulating the Competition, if the prize is:
Not claimed by the winning entrant by 10:00am (AEDT) Wednesday 15th January 2025 of the draw; or
Forfeited for any reason; or
The winner is not available;
The prize will be deemed unclaimed and a new winner will be chosen at based on the pre-set selection criteria
The unclaimed prize will be re-drawn at 10.00am AEDT on Thursday 16th January 2025 at Gates Australia Pty Ltd of 200 National Drive, Dandenong South VIC 3175. The new winner will be notified in writing within seven days and the winner’s details (last name, first initial, postcode) will be published within 30 days on the Gates Promotional website.
NO LIABILITY
The Promoter and its associated agencies and companies assume no responsibility for any incorrect or inaccurate information, either caused by an entrant or due to any of the equipment or programming associated with or utilised in the Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
If for any reason, the Competition is not capable of running as planned (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition), the Promoter reserves the right, in its sole discretion, to disqualify any entrant who undermines the fairness of the competition (by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants), to take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any direction given under state regulations, or any written directions given by a relevant regulatory authority.
Once the prize has left the Promoter’s premises via courier, the Promoter and its associated agencies take no responsibility for the prize being damaged, stolen or lost.
The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
9. PRIVACY CONSENT
All entries remain the property of the Promoter. The Promoter collects personal information in order to conduct the Competition, to assist in providing the products or services an entrant has requested (if any), and to improve its products and services. The Promoter or any of its related companies may use the information for promotional, marketing, publicity, research and profiling purposes, and may be in touch by any means (including telephone, email or SMS) at any time to let you know about products, services or promotional activities which may be of interest to you until you inform the Promoter otherwise.
The Promoter may also share your information with other persons or entities who assist it in providing its products or services or running competitions or trade promotions (including administering the competition or trade promotion or distributing prizes). The Promoter may also disclose your personal information in accordance with these terms and conditions if you are the prize winner, and as required, to Australian regulatory authorities.
The Promoter is not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorized access to or alteration of entries.
The Promoter is not responsible for lost, late, incomprehensible or incorrect entries in the competition. The Promoter also accepts no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek independent financial advice about such matters.
In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, the promoter is entitled to cancel, terminate, modify or suspend the competition – subject to any written directions from any applicable regulatory authority.
The winners release the Promoter, and its related bodies corporate from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the winner as a result of any loss or damage to any physical property of the winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoter, the promotion or the prize.
The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth).
10. COMPLIANCE :
Participation in this program is subject to compliance of applicable laws, including, without limitation, international, national and local anti-corruption laws, including the United States Foreign Corrupt Practices Act of 1977 and the U.K. Bribery Act of 2010. In addition, individuals and entities are ineligible to participate in the program if they are subject to sanctions or otherwise designated on any list of prohibited or restricted parties, or owned or controlled by such a party, including but not limited to the lists maintained by the United Nations Security Council, the US Government (e.g., the US Department of Treasury’s Specially Designated Nationals list and Foreign Sanctions Evaders list and the US Department of Commerce’s Entity List), the European Union or its member states, or other applicable government authority. Participants in the program may not directly or indirectly export, re-export, transmit, or cause to be exported, re-exported or transmitted, any Gift Cards or Claim Codes to any country, individual, corporation, organization, or entity to which such export, re-export, or transmission is restricted or prohibited, including any country, individual, corporation, organization, or entity under sanctions or embargoes administered by the United Nations, US Departments of State, Treasury or Commerce, the European Union, or any other applicable government authority
Waiver and Indemnity:
By using the prizes you agree, to the extent permitted by law, to indemnify and hold harmless promoter and promoters’ directors, officers, employees, affiliates, agents, contractors, and licensors, with respect to any claims arising out of your breach of these terms, your use of the prizes, or any action taken by promoter as part of its investigation of a suspected violation of these terms or as a result of its finding or decision that a violation of these terms occurred. You agree that you shall not sue or recover any damages from Promoter, and Promoter’s directors, officers, employees, affiliates, agents, contractors, and licensors as a result of its decision to remove or refuse to process any information or content, warn or not warn you, suspend or terminate your access to prizes or use of the prizes, or take any other action during the investigation of a suspected violation or as a result of apple’s conclusion that a violation of these terms has occurred. This waiver and indemnity provision applies to all violations described in or contemplated by these terms.
Governing Law
Except as to the extent expressly provided in the following paragraph, these Terms and the relationship between you and us shall be governed by the laws of Australia.
