The Promotion commences at 9:00am AEDT on 09/10/2024 and closes at 11:59pm AEDT on 05/11/2024 (“Promotional Period”).
Entry is open to Australian residents (excluding NT residents) aged 18 years or over.
The Promotion is authorised under Permit numbers: ACT Permit No. TP24/ 01983. SA Permit No. T24/ 1494. NSW Authority No. TP/00032.
A Participating Store is any BWS store that stocks the Eligible Product (defined below) and displays advertising material for this promotion. For the avoidance of doubt, online purchases from a Participating Store are also eligible.
To enter, Eligible Entrants must complete the following steps during the Promotional Period:
• Spend $25 or more, in a single transaction, on any Wild Turkey or Howler Head products
(“Eligible Product”) from a Participating Store in Australia (“Qualifying Transaction”);
• Scan the QR code available in store or visit online.
• Locate the online entry form, input the requested details including first and last name, postal address, postcode, mobile number, upload a copy of the receipt; and
• Submit the fully completed entry form.
Eligible Entrants must retain a copy of their purchase receipt as proof of purchase. Failure to produce the proof of purchase when requested may result in invalidation of an entrant’s entry and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
Entries which in the reasonable opinion of the Promoter:
(a) are received outside the Promotional Period;
(b) contain defamatory, offensive or inappropriate content or infringe intellectual property rights; (c) are incomplete or indecipherable; or
(d) do not otherwise comply with these terms,
will be invalid and ineligible for any prize.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction regardless of the amount spent in excess of $25; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) only one (1) entry permitted per person per day.
5. The draw will be conducted at Anisimoff Legal, G13, 3 Amy Close, North Wyong NSW 2259 at 1:00pm AEDT on 11/11/2024 by way of an electronic random draw in the presence of an independent
MAJOR PRIZE
6. The first valid entry drawn will win that entrant (“Participant”) the opportunity to play a contingency game (“the Game”) for the chance to win a choice of either AU$160,000 cash or a RAM 1500 Laramie Sport valued at up to AU$160,000 (“Vehicle”) (both referred to as the “Major Prize”). If the winner selects the Vehicle as the prize, they will also have the option to have the Vehicle custom painted or wrapped to the colour orange which will be organised by the Promoter. For clarity, the custom paint or wrap option is strictly for the colour orange and is not available for any other colour.
7. The total prize value of the Vehicle includes registration, compulsory third party insurance, stamp duty, dealer delivery charges (which may vary State by State) and the custom paint or wrap. Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The winner must collect the prize from their nearest authorised RAM dealership.
8. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
MINOR PRIZES
9. The next twenty-five (25) valid entries drawn will each win an AU$200 BWS E-Gift Card.
10. Any ancillary costs associated with redeeming the BWS E-Gift Card are not included. Any unused balance of the BWS E-Gift Card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the BWS E-Gift Card.
GENERAL
11. The total prize pool is up to AU$168,900.
12. If any prize is unavailable (or any part of the prize), the Promoter may substitute the prize (or that part of the prize) with a prize of equal value and/or specification, subject to any written directions from a regulatory authority. Other than this, the prizes are not transferable or exchangeable, and cannot be taken as cash, unless otherwise specified.
13. Subject to the Re-draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
14. All cash prizes will be awarded in the form of an electronic funds transfer to the winner’s nominated Australian bank account.
Game
15. The Game will take place at The Crows Nest Hotel Sydney, 1 Willoughby Road, Crows Nest NSW 2065 on 28/11/2024 at 3:00pm AEDT. In order to participate in the Game, if the drawn Participant resides 100km outside of Sydney NSW, they will receive two (2) return economy airfares from their nearest capital city in Australia (one (1) for each the winner and their companion) to Sydney NSW and three (3) nights accommodation valued at up to AU$3,900 depending on point of departure.
16. If the drawn Participant resides within 100km of Sydney NSW, the Participant will be responsible for transport to and from the Game. Spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, transfers, items of a personal nature (including but not limited to in-room charges) and all other ancillary costs are not included. If the Participant cannot attend the Game, the Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided the Participant gives the Promoter written, signed notice to that effect before the start of the Game. If the Promoter has not been able to contact the Participant before the start of the Game, or the Participant or the nominated proxy is unable to attend the Game, a representative of the Promoter will select an envelope and participate in the Game on their behalf.

17. There will be fifty (50) envelopes on display at the start of the Game. One (1) envelope will contain a promotional message representing Major Prize. The other envelopes will each contain a promotional message representing AU$10,000 cash (“Consolation Prize”). The Participant/proxy/representative (“Attendee”) must choose only one (1) envelope without touching, handling or interfering in any way with any of the other envelopes on display. If the Attendee is found to have breached this condition, they will be disqualified. If the Attendee selects the envelope containing the promotional message representing Major Prize, then, subject to verification by the judges, the drawn Participant will win the Major Prize. If the Attendee selects an envelope containing a promotional message representing the Consolation Prize, then the Major Prize will not be given away and, subject to verification by the judges, the Participant will win the Consolation Prize.
18. The Participant and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The Participant may be required to present their credit card at time of accommodation check in. If the Participant resides within a 100km radius of Sydney NSW, the airfare component of the prize will be forfeited and not redeemable for cash.
Notification of Winner
19. The winners will be notified in writing and by telephone within two (2) business days of the draw. Their first initials, last names and postcodes will also be published on 13/11/2024. Winners must claim their Prizes by 11:59pm AEDT on 25/11/2024.
20. If any Prizes remain unclaimed by 11:59pm AEDT on 25/11/2024, a draw may take place on 26/11/2024 at the same time and place as the Draw, subject to any directions from a regulatory authority (Re-draw).
21. The winners of the Re-draw, if any, will be contacted in writing and by telephone within two (2) business days of the Re-draw. Their first initials, last names and postcodes will also be published on 28/11/2024. Winners of the Re-draw must claim their Prize by 11:59pm AEDT on 10/12/2024.
Privacy
22. The Promoter will collect, use, and disclose entrants’ personal information (“PI”) to conduct and manage the Promotion in accordance with its Privacy Policy, available at
https://www.camparigroup.com/en/page/privacy. The Promoter may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI overseas in accordance with the terms of its Privacy Policy.
23. Winners consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of same) in any media for a period of 12 months from the date the prize is awarded without remuneration for the purpose of promoting the Promotion. The Promoter will seek additional consent from entrants before using their name, image and/or voice for the purpose of promoting any products or services manufactured, distributed and/or supplied by the Promoter which are not connected to the Promotion. If requested by the Promoter, the entrant agrees to sign a separate release required by the Promoter to give effect to this arrangement.
Miscellaneous
24. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right to disqualify any individual who the Promoter reasonably believes has materially breached any of these terms, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
25. If there is a dispute as to the identity of an entrant, the Promoter may, in its sole discretion, determine the identity of the entrant.
26. The Promoter encourages consumers to enjoy liquor responsibly. Consumers of legal drinking age are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines (available at
www.nhmrc.gov.au).
27. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster or unforeseeable event beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
28. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason beyond the reasonable control of the Promoter including technical difficulties, unauthorised intervention or fraud, the Promoter may, to the extent permitted by law:
(a) disqualify any entry or entrant; or
(b) subject to any written directions from a regulatory authority, modify, suspend, terminate or cancel the Promotion or modify the Prize, as appropriate.
29. Nothing in these terms limits, excludes or modifies (or purports to do so) exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
30. Except for the Non-Excludable Guarantees and any other liability that cannot by law be excluded, the Promoter’s liability for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of accepting and/or using a prize or in relation to the Promotion, is limited to the value of the prize except to the extent the loss, damage or injury arises as a result of the fraud or wilful misconduct of the Promoter or its employees or officers.
31. Without limiting any liability which cannot be excluded by law, any prize supplied by a third party supplier is subject to the terms and conditions of that third party supplier. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of any third party supplier or otherwise as a result of the winner accepting and/or using a prize (even if caused by negligence) that is supplied by a third party. Nothing in these terms and conditions restricts, excludes or modifies any rights or remedies that cannot be excluded, restricted or modified under applicable law or any right to recourse you may have against a third party supplier.
32. Without limiting any liability which cannot be excluded by law, the Promoter will not be liable for any loss or damage associated with:
(a) any technical difficulties or equipment malfunction outside of the Promoter’s reasonable control;
(b) any theft, unauthorised access or third party interference;
(c) any late, lost, altered or misdirected entries due to any reason beyond the Promoter’s reasonable control;
(d) any variation in prize value to that stated in these terms;
(e) if the Game is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter;
(f) any tax liability incurred by a winner or entrant; or
(g) any damage to or delay in transit of the prize during delivery,
except to the extent caused or contributed to by the Promoter.
