COINXCHANGE COMPETITION TERMS AND CONDITIONS

This document sets out the terms and conditions that govern the draw to win a 2017 Planetary Coin Set valued at $4,000, 2024 Rubiks cube 2oz Silver Antiqued coin valued at $500 and 2024 War Animals Silver Proof Coin valued at $250 run by Coinxchange Pty Ltd ABN 17 675 654 538 (Coinxchange). By entering the Competition, you agree to be bound to these terms and conditions.

1 APPLICABILITY

(a) Information on how to enter and prizes (including any details set out on our platform or website or any other channel on which the Competition is advertised) form part of these conditions. To the extent of any inconsistency, the terms and conditions contained in this document prevail over those contained on our website or any other channels).

(b) By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.

2 COMPETITION PERIOD

(a) The Competition will commence on 27/11/2024 at 9:00AM AEST and end on 22/01/2025 at 5:00PM Australian Eastern Standard Time.

3 ELIGIBLE ENTRANTS

(a) Entry is open to any person that:

(i) is an Australian resident permanently residing in any Australian state or territory; and

(ii) is over 18 years of age.

(Eligible Entrants).

(b) Each person that complies with clause 3(a) will be an “Eligible Entrant” for the purposes of these terms and conditions.

(c) Each Eligible Entrant must read and agree to the terms and conditions and privacy policy of the Platform, available here: www.coinxchange.com.au/privacy-policy

(d) There is no maximum number of entries per Eligible Entrant for the duration of the Competition.

(e) Upon entry, participants will have access to a leaderboard that displays those with the most entries in the competition. However, a leading position on the leaderboard does not guarantee winning any prizes.

4 COSTS

The Competition requires no purchase or payment to enter. Eligible Entrants are responsible for all expenses to submit an entry.

5 SUBMITTING AN ENTRY

(a) To enter the Competition, Eligible Entrants mustsubscribe to the Coinxchange email list and receive 1 entry in the Competition.

(b) Eligible Entrants may gain the following additional entries into the Competition for each criteria satisfied below:

(i) Refer a friend who subscribes to Coinxchange email list for 50 entries;

(ii) Join the Coinxchange Facebook Group for 50entries;

(iii) Share the Coinxchange Instagram video to their own Instagram Story for 50 entries;

(iv) Share the Coinxchange Facebook video to their own Facebook timeline for 50 entries;

(v) Like the Coinxchange Facebook Business page for25 entries;

(vi) Follow the Coinxchange Instagram Page for 25entries;

(vii) Follow the Coinxchange Tik Tok Page for 25entries;

(viii) Like the Instagram post for 10 entries

(ix) Like this Facebook post for 10 entries

(x) Like this Tik Tok post for 10 entries

(xi) Follow Alex on Instagram for 5 entries

(xii) Follow Doug on Instagram for 5 entries

 

(c) Eligible Entrants may obtain an unlimited number of entries into the Competition by satisfying the Competition criteria in clause 5(a) and clause 5(b).

(d) Once the Eligible Entrant has submitted an entry in accordance with clause 5(a) and clause 5(b) an entry will only be taken to have been officially accepted by Coinxchange as a valid entry once we have provided express confirmation to the Eligible Entrant via our giveaway software. Once an entry has been acceptedas a Valid Entry, no changes to or withdrawal of the Valid Entry will be permitted.

6 DRAW

(a) The Competition will be run for the Competition Period, and a draw will be run on or after the End Date, where via completely random means, three of the Eligible Entrants will be selected as the first, second and third place winners.

(b) Unless specifically stated otherwise, there is only one draw and three Winners in the Competition.

(c) This draw will take place on 22/01/2025 at Malvern East, Vic, 3145.

(d) An Eligible Entrant can only become the Winner of the Competition once per Competition Period.

7 PRIZES

(a) The prizes that will be given to the Winners of the Competition are 1st place – 2017 planetary Coin setvalued at $4,000, 2nd place 2024 2oz Silver Rubiks Cube Coin valued at $500, third place 2024 Silver proof War Animals $2 coin valued at $250.

(b) If applicable, the value any Prize is in Australian Dollarsand all Prizes are valued by us in our sole discretion.Given the nature of the Prize, the value may change between the time of an entry to the Competition and the time that the Prize is received by the Winner.

(c) All taxes and local government fees (excluding GST) that may be payable as a consequence of receiving the Prize are the sole responsibility of the winners.

(d) Coinxchange is not liable for any loss or damage (even if caused by negligence) as a result of any winner accepting and/or using the Prize, except for any liability which cannot be excluded by law.

(e) Eligible Entrants acknowledge that Coinxchange makes no promise or guarantee regarding the suitability of the Prize. If the winners have an issue or complaint with any organisation associated with the Prize, Coinxchange is not responsible for resolving the issue (though they may choose to do so).

8 ANNOUNCEMENT OF WINNERS

(a) Coinxchange will announce the winners of the Prize on Coinxchange Instagram, Facebook and Tik Tok pages on the End Date being 22/01/2025.

(b) The Winners will also be notified by way of:

(i) a phone call or text message on their phone number used by the Eligible Entrant to subscribe to the Coinxchange platform.

(c) Once notified, the Winners must provide Coinxchangewith their preferred postal address.

(d) Coinxchange will arrange for the posting of the Prize via registered mail to the Winner’s Postal Addresseswithin 7 days of receiving confirmation of the details in clause 8(c).

9 PRIZE SUBSTITUTION

(a) In the event that any part of the Prize becomes unavailable for reasons beyond Coinxchange’s control, Coinxchange may, at its absolute discretion, substitute the Prize (or the relevant part of the Prize) with a prize of equal or greater value.

(b) The Prize is not redeemable for cash or credit under any circumstances.

10 UNCLAIMED PRIZES

(a) Coinxchange will use their best endeavours to contact the winners of a Prize using the contact details provided in their entry. However, Coinxchange will not be liable for the winners’ failure to receive a notification of winning if they provided incorrect contact details..

(b) If the Winners fail to comply with the instructions in a written Notification on claiming the Prize within 1 month from the End Date, the following will occur:

(i) all of the Winner’s entries will be disqualified, and they will not be entitled to the applicable Prize; and

(ii) the Prize will be redrawn 1 month after the end date which will be 22/02/2025 at 7pm AEST.

(iii) The location of this draw will be Malvern East, Melbourne, Victoria, 3145.

11 USE OF ELIGIBLE ENTRANTS’ PERSONAL INFORMATION

(a) Personal information including Eligible Entrants’ names, addresses, telephone numbers, emails, social media details and postal addresses, will be collected and used for the purpose of conducting this Competition. This may require disclosure to third parties, including local regulatory authorities and Coinxchange agents or third-party service providers, for the purposes of conducting the Competition or for promotional and marketing purposes, including on social media (Purpose).

(b) By entering this Competition, the Eligible Entrants consent to the use of their personal information for the Purpose, and that Coinxchange may contact them for future marketing and material purposes without payment. Eligible Entrants agree that Coinxchangemay use this information for that purpose and disclose it to other organisations or persons, including overseas service providers that may use it in any media for the Purpose.

(c) Coinxchange may contact the Eligible Entrants to participate in publicity, photography and any other promotional activity as Coinxchange reasonably require without any compensation.

(d) Eligible Entrants may access, change and/or update their personal information by emailing Coinxchange at support@coinxchange.com.au. A copy of Coinxchange’s Privacy Policy is available at www.coinxchange.com.au/privacy-policy. The Privacy Policy contains information about how individuals may access or correct personal information or make a privacy related complaint.

12 GENERAL CONDITIONS

(a) Coinxchange accepts no responsibility for late, lost or misdirected entries or other communications.

(b) Should an Eligible Entrant’s contact details change during the Competition Period, it is the Eligible Entrant’s responsibility to notify Coinxchange. A request to access or modify any information provided as part of the redemption of a prize should be directed to Coinxchange.

(c) Coinxchange may at their absolute discretion request verification of any personal information of Eligible Entrants provided for the purposes of the Competition and arranging a prize.

(d) Coinxchange reserves the right to disqualify any individual who breaches these terms and conditions, submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the fair and proper conduct of this Competition. Failure by Coinxchangeto enforce any of its rights does not constitute a waiver of those rights.

(e) By entering this Competition, Eligible Entrants acknowledge and agree that these terms and conditions, the Competition and the consequences of receiving a prize may be subject to the terms and conditions of third-party service providers such as social media platforms and video platforms (Third Party Terms). Provided that Coinxchange have made it clear that it uses such third party suppliers and those suppliers’ Third Party Terms apply, Coinxchange will not be liable for any damage or loss suffered by the Eligible Entrants in connection with such Third Party Terms.

(f) Participants in the Competition may have rights under the Competition and Consumer Act 2010 (Cth) and other similar legislation which cannot be excluded, restricted or modified by Coinxchange. These terms and conditions do not exclude, restrict or limit those statutory rights in any way.

(g) However, to the maximum extent permitted by law and subject to clause 12(h), the total liability of each party in respect of loss or damage sustained by the other party in connection with these terms is limited to the amount equivalent to the competition prize.

(h) Clause 12(g) does not apply to any Participant’s liability in respect of loss or damage sustained by Coinxchangearising from a Participant's breach of:

(i) clause 3 (Eligible Entrants); or

(ii) clause 12 (General Conditions).

(i) Coinxchange will not be liable for performance delays or for non-performance due to causes beyond their reasonable control, including any decision of a government authority in relation to COVID-19. If the Competition is not capable of running as planned, the Coinxchange reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Competition, or amend these terms and conditions, unless to do so would be prohibited by law.

(j) These terms and conditions are governed by the laws applying in Victoria
