TERMS AND CONDITIONS
1. Information on (a) how to enter and (b) the prizes form part of these terms and conditions ("Terms and Conditions"). Participation in this Mastercard x David Jones x Latitude Financial Services – Win a trip to Paris promotion ("Promotion") is deemed acceptance of these Terms and Conditions. Entries must comply with these conditions to be valid.
2. The Promoter is Mastercard Asia/Pacific (Australia) Pty Ltd (ABN 95 108 603 345) of 72 Christie Street, St Leonards NSW 2065, Australia, telephone 1800 120 113 ("Promoter").
Eligibility
3. Any person who enters the Promotion is an "Entrant". Valid entry is only open to Australian residents (or temporary residents who legally have the right to work in Australia and intend to stay for at least 12 months after this Promotion) aged 18 years or over ("Eligible Entrant(s)").
4. Employees (and their immediate families) of the Promoter, David Jones, Latitude Financial Services, Mastercard and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
5. Entries into the Promotion open at 12:00am AEDT on 26 February 2025 and close at 11:59pm AEDT 30 March 2025 ("Promotional Period"). No entries will be accepted after this time.
Entry Requirements
6. New Customers
To be eligible to enter, Eligible Entrants who do not already have a David Jones Prestige or Premiere Credit Card must, during the Promotional Period, apply for and be approved for a David Jones Prestige or Premiere Credit Card. The approval and issuing of a David Jones Prestige or Premiere Credit Card will be deemed as one (1) valid entry into the draw.
For clarity, Eligible Entrants who are existing cardholders will not receive an entry on the approval and issuing of a David Jones Prestige or Premiere Credit Card for the purposes of this Promotion.
7. Existing Cardholders
To be eligible to enter and receive one (1) entry into the draw for Eligible Entrants who already have a David Jones Prestige, Premiere or Icon Credit Card ("David Jones Card"), the existing cardholder must:
a) Either;
i. Receive a promotional message from Latitude Financial Services inviting them to participate in this Promotion and click on the 'Activate Offer' button within the promotional message; or
ii. Click on a promotional tile featuring this Promotion within the Latitude Financial Services App and then enter their account number when prompted to activate the Promotion; and then
b) Spend AU$2,500 or more during the Promotional Period, using their David Jones Prestige, Premiere or Icon Credit Card on Eligible Transactions (as defined below) anywhere Mastercard is accepted. To confirm, the spend amount can be made over multiple transactions, however the full amount must be spent during the Promotional Period.
8. For the purposes of the Promotion, "Eligible Transactions" do not include cash advances, cash equivalent transactions, card fees or charges, credits, refunds, reimbursements, interest and balance transfers into an account.
9. Only one (1) entry is permitted per David Jones Card cardholder during the Promotional Period.
10. The Promoter, reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
11. Incomplete transactions, transactions that have been refunded prior to the Prize Draw date and/or transactions that are not finalised during the Promotional Period, will be deemed invalid.
12. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
Prize(s) and Prize Redemption
13. There will be one (1) "Prize Draw", which will take place at Anisimoff Legal, 3 Amy Close Wyong NSW 2259 on 14/04/2025 at 11:30am AEST, in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing by email and phone within three (3) business days of the Prize Draw. The Winners will have their details (first initial, surname and postcode) published online at

14. The Promoter's decision is final and no correspondence will be entered into.
15. The first three (3) valid entries drawn (each a "Winner") will each win a trip for two (2) adults to Paris for a priceless sporting experience valued at up to AU$35,000 depending on date and point of departure ("Prize"). Each Prize is for two (2) adults and includes:
Two (2) x return Economy airfares from winner's nearest Australian capital city to Paris, France;
Four (4) nights' accommodation (4 star) in Paris, France;
Return airport to hotel transfers in a private car;
Two (2) VIP tickets, courtesy of Mastercard to a priceless sporting experience in Paris; and
AU$1,500 available to customise the trip with experiences available via priceless.com with any remaining balance loaded as Euros onto a prepaid Mastercard Travel Card.
The total approximate Prize pool value is up to AU$105,000.
Spending money, additional meals, insurance, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the priceless sporting experience in Paris which takes place between 25 May 2025 and 08 June 2025 and is subject to booking and flight availability. Exact dates of travel will be determined by the Promoter in its absolute discretion. The winner and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The Winner(s) may be required to present their credit card at time of accommodation check in. The Winner(s) and their companions must satisfy all immigration and biosecurity requirements for the territory where the Prize is facilitated.
16. Subject to the provisions herein, if for any reason a Winner does not take the Prize (or an element of the Prize) at the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited and will not be redeemable for cash.
17. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend, substitute or modify a Prize, subject to any written directions from a relevant regulatory authority.
18. If any Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. The priceless sporting experience in Paris tickets are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the Winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Prize.
20. Prizes, or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
21. The Promoter will not be held responsible for the Winners and/or their companions not taking advantage of the Prize due to health or any other reason.
22. A draw for any unclaimed prizes may take place on 05 May 2025 at the same time and place as the original Prize Draw, subject to any directions from a regulatory authority. 23. Sale, transfer or exchange of any part of a Prize is strictly prohibited. Any attempt to sell, transfer or exchange any part of a Prize will result in the Prize being withdrawn by the Promoter and the Prize will be declared null and void.
24. Winners and/or companion(s) agree to participate in related publicity accompanying or resulting from the Promotion without further recompense. This may include but is not limited to photographs taken which may be used for publicity purposes. By accepting a Prize, Winners and their companion grant the Promoter the absolute and irrevocable sublicensable right and permission to use, publish, publicly display, perform, transmit, exhibit and reproduce their name, statements, video, voice, recordings, interviews, photographs or other visual or audible representations or likeness, in whole or in part, individually or in conjunction with other material, including without limitation, text, photographs or images in any medium (whether now known or hereafter invented) including, but not limited to the internet and other electronic and social media and for any and all purposes, publicity, Promotion, packaging and trade throughout the world without restriction as to manner, frequency or duration of use or any other purpose whatsoever in connection with this Promotion or in connection with the marketing of the products of the Promoter, or otherwise. Winners and companions further agree that all materials produced pursuant to the rights set out above shall and will remain the property of the Promoter.
25. If this Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to, a Covid-19 lockdown, infection by computer virus, bugs, tampering, unauthorised intervention, acts or omissions of third parties, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion.
26. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
27. The Promoter reserves the right to cancel, suspend, terminate or modify the Promotion if fraud, technical failures or any other factor beyond the Promoter's reasonable control adversely affects the Promoter's ability to conduct the Promotion as contemplated in these Terms and Conditions, subject to state or territory regulation. In such event, the Promoter reserves the right to award the Prizes to one of the Eligible Entrants received up to the time of the cancellation or modification in accordance with the judging criteria set out herein. The Promoter also reserves the right to disqualify any individual it finds to be tampering with the Entry process or the operation of the Promotion or to be acting in breach of these Terms and Conditions or in breach of any law. Any attempt by any person to deliberately cause damage or undermine the operation of the Promotion may be a violation of criminal and civil law.
28. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all Entries submitted by that Entrant invalid.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
30. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the priceless sporting experience in Paris is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a Winner or Entrant; or (g) use of a Prize.
31. As a condition of accepting the Prize, each Winner (and their companion/s) must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a Winner's companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
32. Latitude Financial Services (ABN 42 008 583 588) collects personal information ("PI"), on behalf of the Promoter, in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to the Promoter, agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. Latitude Financial Services and the Promoter will also use and handle PI as set out in their respective privacy policies, which can be viewed for Latitude at

33. These Terms and Conditions may be changed, varied, modified and/or deleted (subject to the applicable state and/or territory trade promotion legislations, approvals, and applicable notification requirements) by the Promoter in its sole and absolute discretion at any time and from time to time. The Promotor will notify participants where reasonably practicable. Each Entrant irrevocably and unconditionally accepts any such changes, variations, modifications and deletions.
34. For any questions concerning legal interpretation of these Terms and Conditions, the laws of New South Wales, Australia apply to this Promotion, except to the extent that a different state or territory's trade promotion legislation applies.
35. If any of the provisions of these Terms and Conditions becomes or is invalid, illegal or unenforceable in any respect under applicable law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired and such invalid, illegal or unenforceable provisions shall be deemed severed from these Terms and Conditions and Mastercard shall be entitled to replace such severed provisions with such other provisions as it may deem fit.
36. The headings to the clauses of these Terms and Conditions shall not be taken into consideration in the interpretation or construction thereof or of these Terms and Conditions.
37. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. In the event of any inconsistency between the English language version of these Terms and Conditions and any other language version, the English language version shall prevail.
