Terms & Conditions for Foodland Charity Holiday Home

1.The promoter of this promotion is Foodland Supermarkets ABN 85 528 062 001 of 292 Grange Rd, FLINDERS PARK SA 5025 ("Promoter").

2.Information on how to enter the promotion and prize forms part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry.

3.Entry is open to all residents South Australia aged 18 years and over who satisfy the entry requirements as stated in terms 4 and 5. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, and their related bodies corporate are not eligible to enter.

4.To enter, into the major prize draw participants must first purchase any 2 specially marked products from their local Foodland store during the promotional period and enter either by

a. Mail: complete a form from in-store and post along with your original receipt to “WIN Foodland Charity Holiday Home”. LOCKED BAG 122 ADELAIDE SA 5001.

b. Web: or visit www.foodlandsa.com.au and follow the links to enter your details as prompted.  Entrants must keep an original copy of their receipt as proof of purchase.


The first correct entry drawn from each of the monthly draws will receive a token key and a $5,000 Foodland Shopping Voucher.  In the final month there will be a bonus key drawn. On completion of all monthly draws each of the 8 key winners will meet at the Foodland Charity House on the 21st November at 2.00pm for the final draw. In their winning order the 8 key winners will be asked to draw out a key each. The contestants will then be asked to try their key into the Foodland Charity House door. The contestant who’s key opens the lock becomes the winner of the Foodland Charity House. Should a winner not be able to attend the event then a representative nominated by the winner may attend the event in their place. The representative must be registered with Foodlands and may need to provide proof that they have been nominated.

5.The Promotion starts at 12:01 AM AEST 12th April 2010 and closes at 6:00 PM AEST on 31st October 2010 If entering by mail, your entry must be received by the last mail delivery 31st October 2010. ("Promotional Period").

Monthly winners (Cool and 160 consolation prize winners will be drawn at Salmat Interactive Level 17 Innovation Place 100 Arthur Street, North Sydney.

Draw 9 - The Major Prize Draw will be conducted at Lot 80 Offshore Drive, Middleton, Sunday 21/11/10 at 2pm and the winner will appear in The Advertiser on Wednesday 24th November 2010.

Draw winners will be notified by phone, consolation winners by letter and all winners will appear in The Advertisers “Public Notices” on Wednesday following the date of drawing.

6.There is 1 major prize, 8 minor prizes and 200 runner up prizes to be won

a. The major prize is a house and land package located at Lot 80 Offshore Drive, Middleton.
The Foodland Charity House will be on display for a further four months after the winning announcement and will be handed over to the major prize winner at the end of March 2011

i. The House Prize comprises house and land provided by Red Ochre Homes Pty Ltd and includes the right to become the registered proprietor of the property Lot 80 Offshore Drive, Middleton.  The House Prize winner takes the property subject to all reservations, easements and restrictions recorded on Title or otherwise affecting the land including any of the estate guidelines or other planning laws applicable to the land. 

ii. The land and house are valued at $450,000 as at 12 April 2010.  All fees payable in order to transfer the property into the House Prize winner’s name will be paid by Red Ochre Homes Pty Ltd  including stamp duty, Titles Office registration fees, and any adjustment required for municipal, water rates and land tax (if applicable).  Neither Red Ochre Homes Pty Ltd nor the Promoter make any warranties as to the liability for rates and other statutory outgoings on and from the date the property is transferred to the House Prize winner which remain the responsibility of the House Prize winner. The fees incurred will be approximately $23,000 (including stamp duty, registration fees, conveyancing costs).  The value of the prize is inclusive of GST and the House Prize winner acknowledges that it will not be entitled to any Tax Invoice for any supply made in respect of the House Prize.  The total House Prize value is up to $450,000 as at 12 April 2010

iii. The property will be transferred to the House Prize winner on 31/03/11.  The property will be used as a display home up to 31/03/11  All entrants acknowledge that there may be delays in the construction of the house and its completion for reasons beyond the reasonable control of either Red Ochre Homes Pty Ltd or the Promoter including but not limited to, inclement weather, industrial disputes or other factors.  Devine and the Promoter reserve all rights to extend the anticipated date of transfer having regard to any delays to construction of the house beyond the reasonable control of Red Ochre Homes Pty Ltd or the Promoter.

iv. Subject to the statutory rights and warranties reserved to the House Prize winner in respect of all applicable building laws, Red Ochre Homes Pty Ltd and the Promoter make no representations or warranties and will have no further liability in relation to the property or the house constructed on the property as from the date the property is transferred to the House Prize winner.  The property is transferred as at the date of transfer to the House Prize winner as is where is, except for any liability which cannot be excluded by law. The House Prize winner will be required to sign all documentation submitted by Red Ochre Homes Pty Ltd and or the Promoter in order to become the registered proprietor of the property within a reasonable time of being requested to do so. The House Prize winner acknowledges that by failing to sign the necessary documentation by 31/03/11 they will forfeit the House Prize. If the House Prize is forfeited the original winner will be notified and the House Prize will be awarded via an unclaimed prize draw.

v. All legal costs and disbursements of conveyancing relating to the House Prize will be paid by Red Ochre Homes Pty Ltd.  Legal work required to transfer the House Prize to the House Prize winner will be undertaken by the Promoter’s Solicitors, Red Ochre Homes Pty Ltd or such other Solicitors appointed by the Promoter its absolute discretion.  The entrant acknowledges that the Solicitors act generally on behalf of the Promoter and the House Prize winner will sign such acknowledgement or other document required under the Legal Profession Act 2004 required to enable Red Ochre Homes Pty Ltd or other Solicitors to comply with their obligations of disclosure of any potential conflict of interest.  The House Prize winner acknowledges that if he or she elects to obtain independent legal advice the same shall be obtained at his or her own expense.

b. There are 6 minor prizes to be won of a $5,000 Foodland voucher (Draws 1-6).

c. There are 2 minor prizes of $10,000 (Draws 7-8) (Win Groceries for a Year)

d. There are 160 minor prizes to be won of a $100 Foodland voucher.

e. Foodland vouchers

f. Total Prize pool valued at $520,000 including GST.


7.Entry Periods
All entries are cleared out after each draw is completed.
If your entry does not make it in time for the previous draw it will go automatically into the next draw.  For draws 7 & bonus draw 8 entries must be posted by 31/10/10.

8.Any prizes unclaimed will be entered into an unclaimed prize draw conducted at Salmat Interactive on Friday 1st April 2011 at 2:00pm AEST.

9.Winners must also make themselves available for marketing purposes for example, photography, TV and radio interviews.

10.No responsibility will be accepted for late, lost or misdirected entries and entry is deemed to be received at the time it is received in the Promoter's database and not the time of transmission by the entrant.

11.Any form of automated electronic entry that does not meet the entry requirements as per clause 4 will be deemed invalid and not counted as a valid entry.

12.One entry per eligible purchase (see term 4). Multiple entries are accepted however each entry must be made in relation to a separate purchase as per term 4.

13.All Web participants must retain the purchase receipt for the participating products as proof of purchase for all entries. Failure to produce any purchase receipt when requested may in the absolute discretion of the Promoter, result in invalidation of ALL of a participant’s entries and forfeits any right to a prize.  The Promoter reserves the right to verify the validity of entries.

14.This is a computerised electronic random draw. Drawn entries will be checked for validity against competition rules of entry as they are drawn. Any entries deemed not valid (as per term 4) will be discarded and the draw will continue until all prizes are allocated.

15.The Promoter's decision as to the winner is final and no correspondence will be entered into.
16.The winner may be required to sign an indemnity in a form approved by the Promoter in favour of the Promoter and all involved parties prior to participating. If they do not sign that indemnity form, they will not be able to participate in the Prize.

17.Foodland vouchers are subject to terms and conditions of use which can be found on each voucher.

18.Prizes are not transferable or redeemable for cash.

19.All entries remain the property of the Promoter. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information to contact you for future promotional, marketing and publicity purposes. Entrants' personal information may be disclosed to State and Territory lottery departments and the winner's name published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out above.

20.The Promoter and its officers, employees and agents will not be liable for any damage or loss (including but not limited to, indirect or consequential loss) arising from personal injury or death or loss of, or damage to property which is suffered or sustained in connection with the promotion or any prize, except to the extent that liability cannot be excluded by law.

21.The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation technical malfunctions or failures.

22.The Promoter is not responsible for any technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, or any other technical failures, including any injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this promotion.

23.If for any reason this promotion is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion to cancel, postpone or amend the promotion subject to the written directions of any competent authority.

24.The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
