Competition Terms and Conditions
This competition (the "Competition") is conducted by Avocados Australia, ABN 87 105 853 807, U8/63 Annerley Road Woolloongabba QLD 4102 (the "Promoter").
Entry instructions published by the Promoter form part of these conditions.
Entry into the Competition is only open to "Eligible Persons", being individuals who:
are
Australian residents;
are not employees of the Promoter or its related companies or agencies associated with the Competition; and
are not members of the immediate family of an excluded employee. "Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they live in the same household as the employee.
Persons under 18 years of age are eligible to enter the Competition, but their entitlement to any Prize is subject to the written consent of their parent or guardian (see condition 14).
Entry into the Competition commences at 8am on 1/05/2010 and closes at 11.59pm time on 8/09/2010 ("Competition Period"). All Competition times are Sydney time.
An Eligible Person may enter the Competition as many times as you like.
The Promoter takes no responsibility for any delays or failures in any voting.
The Promoter will reject invalid entries. Rejection may occur:
before or at the time the entry is made; or
at any later time, including after the draw is made.
The Competition draws will commence at 10am on 15/10/2010 at Level 2, 67-69 Murray Street Pyrmont NSW 2009.
There is one prize.
The Prize comprises a double pass to the NRL Grand Final, valued at approximately $240 and a jersey signed by the winning team, valued at approximately $360. The total value of each Prize is $600. The prize does not include any transport or accommodation.
Prizes are valued as at 11/2/2010. The Promoter takes no responsibility for any variations in Prize values.
Entrants will be notified by phone if their entry is drawn. The person entitled to the Prize is the person who:
has the name appearing in the drawn entry for that Prize
In order to be entitled to a Prize, an Eligible Person whose valid entry is drawn MUST, if requested by the Promoter, within 7 days of being asked to do so:
agree to, sign and return the Promoter's form confirming their eligibility to accept the Prize;
agree to, sign and return any liability release and/or indemnity form requested by the Promoter and/or any entity associated with this Competition. If the Eligible Person is under 18 years of age, in order to be entitled to a Prize, the Eligible Person must ensure that their parent or guardian also signs the documents referred to at (i) and(iii) above (if requested by the Promoter). An Eligible Person who does not comply with this condition forfeits the Prize.
The Promoter reserves the right to verify the validity of entries and to disqualify any Eligible Person who:
tampers with the entry process;
makes entries in breach of these conditions;
does not complete the full entry form;
subverts these conditions.
Any Eligible Person who is disqualified will lose any entitlement they may have to any Prize.
The names of the Prize winner will be published on
www.avocado.org.au/IHeartFooty Subject, where relevant, to any directions given under the legislation regulating the Competition, if any Prize is not claimed by an Eligible Person within 2 weeks of the draw, the Prize will be awarded to another Eligible Person from the same Region in another draw (the "Unclaimed Prize Draw") for that Prize. The Unclaimed Prize Draw will be made from all the other entries from that Region in the original draw. The Unclaimed Prize Draw(s) will commence at 10am on 29/9/2010 at Level 2, 67-69 Murray Street Pyrmont NSW 2010.
If any Prize is awarded to an Eligible Person and that Eligible Person then forfeits the Prize for any reason, including as a result of:
failure to comply with conditions of entry or
disqualification,
the Prize will be awarded to another Eligible Person in another draw for that Prize (which draw will be made from all the other Eligible Persons' entries allocated to the original draw for that Prize). The additional draw will take place immediately after the Unclaimed Prize Draw at the same place as the Unclaimed Prize Draw.
To the full extent permitted by law, the Promoter and its associated companies and agencies and any of their personnel (the "Relevant Parties") shall not be liable for any loss (including any damage, claim, injury, cost or expense) whatsoever which is suffered or incurred arising out of, or in any way connected with, the Competition or Prizes, including:
any indirect, economic or consequential loss;
any loss arising from any negligent act or omission of any of the Relevant Parties; and
any liability for personal injury or death.
All of the Promoter's decisions are final and no correspondence will be entered into.
Prizes and rights to receive Prizes, including any unused part of them, are not transferable or exchangeable and cannot be taken as cash, except with the written consent of the Promoter. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.
If for any reason the administration security, fairness, integrity or proper conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition. Any cancellation, termination, modification or suspension that relates to the Competition will be subject to the approval of the authorities that have issued permits for its conduct.
The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failures, theft or destruction or unauthorized access to, or alteration or non-receipt of Eligible Person's communications. The Promoter is not responsible for any problems or technical malfunctions (such as problems with telephone networks or lines, computer systems or software or internet service providers) to be received by the Promoter (whether as a result of technical problems).
In the event that any Prize is not available for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by an Eligible Person or any third party in the event that any scheduled Prize is unavailable for any reason.
Eligible Persons consent to the Promoter using the Eligible Person's name, likeness, image and/or voice in the event they are a winner of a draw (including any photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition, the Promoter or its products and services.
Eligible Persons' personal information will be collected by or on behalf of the Promoter to enable it to administer and promote the Competition and the winners of the Competition's draws. The personal information of winners may be provided to others assisting in the conduct of the Competition, including the Competition administrator, Prize suppliers and deliverers, and to authorities that regulate the Competition. Eligible Persons may contact the Promoter at the address above to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Eligible Person does not provide accurate personal information the Promoter may determine that they are not eligible to win a Prize.
