Terms and Conditions
1. Information on how to enter and prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to Australian residents over the age of 16 years (Entrants). Employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
3. Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the promotion and provide personal information about themselves. All entries of Entrants who are under the age of 18 years and enter the promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental consent (as and where required) will be deemed invalid. These Conditions of Entry will bind the Entrants and any parent or legal guardian who gives their consent (for Entrants aged 18 years and under). 5. Woolworths/Safeway Dirt Bike Draw Entry: To enter the Woolworths/Safeway Dirt Bike Draw, Entrants must, during the Promotional Period, purchase any one (1) Lynx product from a participating Woolworths or Safeway store during the Promotional Period (Eligible Purchase) and either:

6. All Entrants who enter the Woolworths/Safeway Dirt Bike Draw via the Dirt Bike Promotional Website (as outlined in Condition 5a) may choose to be entered into the Lynx Lodge Draw. In order for this to occur the Entrant must tick the box on the Dirt Bike Promotional Website to accept entry into the Lynx Lodge Draw. All Entrants who enter the Woolworths/Safeway Dirt Bike Draw via the SMS entry mechanic (as outlined in Condition 5b) will automatically be entered into the Lynx Lodge Draw.
7. Lynx Lodge Draw Entry: To enter the Lynx Lodge Draw, Entrants must, during the Promotional Period, either:
a. enter the Lynx Lodge Draw as described in clause 6 of these Conditions of Entry by entering the Woolworths/Safeway Dirt Bike Draw via the Dirt Bike Promotional Website (as outlined in Condition 5a) and choosing to be entered into the Lynx Lodge Draw. In order for this to occur the Entrant must tick the box on the Dirt Bike Promotional Website to accept entry into the Lynx Lodge Draw; or
b. log on to
www.lynxlodge.com.au (Lynx Lodge Promotional Website) and complete all requested details in full and submit in the manner required, the online entry form, including entering the last four (4) digits of the barcode of any one (1) Lynx product (barcodes found on the reverse of the Lynx product); or
c. send a SMS in the required format to 1999 7777. The required format is: “ELIGIBLE ENTRANT’S FIRST NAME” + SPACE + “LAST 4 DIGITS OF ELIGIBLE PURCHASE’S BARCODE”. Entries are deemed accepted at the time of receipt and not at the time of transmission.
8. Each Entrant must retain and may be required to present proof of each Eligible Purchase in order to claim a prize. For the Woolworths/Safeway Dirt Bike Draw Entry, an Entrant is required to keep original or copies of all Eligible Purchase receipt’s as proof of purchase. For the Lynx Lodge Draw, an Entrant is required to keep the original Lynx product from which barcodes were used to enter. An Entrant may be required to provide to the Promoter proof of purchase for all entries made. If for example you enter 10 times, you may be required to provide proof of purchase for all 10 entries. If an Entrant is unable to provide proof of purchase for all entries made within the required timeframes, then all the entries of that Entrant will be ineligible and deemed invalid and the prize will be re-drawn in accordance with these Terms and Conditions.
9. Maximum of five (5) entries per person, per day, and each entry must be based on a separate Eligible Purchase or Lynx product (whichever is applicable), submitted separately and must independently comply with these Conditions of Entry. Per person will be defined as the Entrant’s email address submitted on the online entry form, and the registered holder of the mobile number used by the Entrant to enter via SMS. 10. Prize Draws: The Lynx Lodge Draw will take place at Mass Media Studios, Level 4, 68 – 72 Wentworth Ave, Surry Hills NSW 2010 at 11.00am AEDT on 19th October 2010. 12. Lynx Lodge Prize must be taken between 8/11/2010 – 14/11/2010, for a period of up to six (6) nights (Prize Period) or the Lynx Lodge Prize is forfeited. The Lynx Lodge Prize winner may choose to take the Lynx Lodge Prize for the entire Prize Period or may choose to use only part of the Prize Period. The Lynx Lodge Prize winner will be required to notify the Promoter as to the part of the Prize Period they will be taking as a condition of accepting the Prize. Should the Lynx Lodge Prize winner, or any of their companions be under the age of 18 years, they must be accompanied by a responsible adult, who is over the age of 18 years, for the duration of the Lynx Lodge Prize. If a responsible adult is required, this person will constitute one of the companions. Redemption of the Lynx Lodge Prize is subject to availability and may be dependent on travel class availability. All components of the Lynx Lodge Prize must be taken together and when offered or are forfeited. 13. All additional costs not expressly stated, but which may be incurred in acceptance and use of the Lynx Lodge Prize, are the responsibility of the winner and companion/s (if any). Such additional costs include, but are not limited to, meals, beverages, telephone calls, spending money, transport to and from airport departure point, other transfers, taxes including arrival and departure taxes (if applicable), insurance and travel insurance (if applicable).

15. Total prize pool is valued at up to AU$44,920.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. A prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST.
16. If the Lynx Lodge Prize remains unclaimed as at 25th October 2010 then the Promoter may conduct a further draw at the same time and place as the original draw as is necessary on that date in order to distribute any prize unclaimed by that date, subject to any written directions from a regulatory authority. In the event of any winner in the Lynx Lodge unclaimed prize draw, the winner will be notified by telephone and mail or email and their name will be published in The Australian on 29th October 2010
17. If a Woolworths/Safeway Dirt Bike Prize remains unclaimed as at 20th January 2011 then the Promoter may conduct a further draw at the same time and place as the original draw as is necessary in order to distribute any prize(s) unclaimed by that date, subject to any written directions from a regulatory authority. In the event of any winner in the Woolworths/Safeway Dirt Bike unclaimed prize draw, winners will be notified by telephone and mail or email and their name will be published in The Australian on 26th January 2011
18. The winner(s) and their travel companion(s) acknowledge that the taking of the prize(s) in this promotion may involve a dangerous activity, which may result in injury or death, and participates at their own risk. The winner and their travel companion(s): (a) must attend, undergo and pass any appropriate training, briefings, safety demonstrations, required medical tests and other requirements (including blood alcohol testing) of the Promoter and a prize supplier as determined by them in their absolute discretion; (b) must declare to the Promoter or a prize supplier (as applicable) any health-related issues that may affect his/her safe participation in any part of any prize and obtain a written clearance from their doctor in this respect; (c) must not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in any part of the prize; (d) must not be under the influence of any drugs or alcohol; (e) must comply with all directions of the Promoter, a prize supplier and race officials; and (f) must wear all safety and other equipment required. The Promoter and a prize supplier in their absolute discretion (a) reserve the right to refuse to allow the winner or companion(s) to take part in any or all aspects of any prize if they reasonably believe the winner or their travel companion(s) poses a safety risk or for any other reason; (b) may cancel the relevant component of any prize if the conditions are deemed dangerous. No compensation will be payable if the winner, or their travel companion(s), are unable to use any element of the prize as stated for whatever reason, including refusal of participation in certain activities for health, age, behaviour or safety reasons.
19. The Promoter reserves the right to verify the validity of entries, at any time during or after the promotion, and reserves the right to disqualify any Eligible Entrant (and ALL entries submitted by that Eligible Entrant) for tampering with the entry process, including but not limited to the use of techniques designed to avoid payment of call costs, for submitting an entry which is not in accordance with these Terms and Conditions, or if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
20. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted from that source and by those Entrants invalid.
21. Cost of accessing the Internet is the Entrant’s responsibility. Any costs associated with accessing the Dirtbike Promotional Website or Lynx Lodge Promotional Website are the Entrant’s responsibility and are dependent on the internet service provider used. Any contact details entered incorrectly shall invalidate the entry. The Promoter is not responsible for receipt of incomplete, indecipherable or incomprehensible entries. All such inaccurate entries will be deemed invalid. No responsibility is accepted for late, lost or misdirected entries. Any entry that does not comply with these Terms and Conditions will be invalid.
22. SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. Entrants must have the bill payer’s permission to enter the promotion or their entry will be deemed invalid. Any form of automated entry using the Internet or any other device or software is invalid. Maximum SMS cost $0.55 (including GST). Standard carriers' SMS costs may apply. Standard carrier SMS costs remain the responsibility of each Entrant and are dependent on the carrier used and an Entrant’s mobile phone plan. 23. In the event that a prize or part of a prize is not available despite the Promoter’s reasonable endeavours, the Promoter reserves the right to substitute a prize of equal recommended retail value, subject to any written directions from a relevant Regulatory Authority.
24. The Promoter and its associated agencies and companies are not liable for any loss or damage whatsoever which is suffered in relation to the prize or otherwise (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the promotion, taking or using a prize or any act or omission (whether negligent or not) of the Promoter and any person associated with it, except for any liability which cannot be excluded by law. The Promoter does not provide any product warranty in relation to the Prize and excludes any implied warranty or condition as to the quality or fitness for any particular purpose of the Prize to the extent permitted by law.
25. It is a condition of accepting the Lynx Lodge prize that the winner and their travel companion(s) (as the case may be) will be required to sign a legal release or rereleases in a form determined by the Promoter in its absolute discretion. If the winner and/or a travel companions is aged under 18 years their parent or legal guardian will be required to sign a legal release or rereleases in a form determined by the Promoter in its absolute discretion. In order for the winner and their travel companion(s) to take the Lynx Lodge prize, they must accept the terms & conditions set out in the legal release. The winner and their travel companion(s) must sign the legal release as acceptance of the terms & conditions and the legal release. If the winner and their companion(s) do not accept the terms & conditions set out in the legal release, the winner cannot accept the prize.
26. It is a condition of accepting the Woolworths/Safeway Dirt Bike Prizes, that the winners will be required to sign a legal release in a form provided by the Promoter. The Winners must sign the legal release as acceptance of the terms & conditions and the legal release. If the winner is aged under 18 years his or her parent or legal guardian will be required to sign a legal release or rereleases in a form in a form provided by the Promoter. If a winner does not accept the terms & conditions set out in the legal release, the winner cannot accept the prize. The terms & conditions set out in the legal release, will be determined by the Promoter in its absolute discretion, and will include, but may not be limited to, the following Terms & Conditions:

c. Children under the age of 16 years should always be accompanied by an adult whilst riding or operating this vehicle.
d. These Vehicles are to be used on private property only.
e. Pregnant persons should not use the vehicle.
f. Vehicle does not conform to federal motor vehicle safety standards and is not intended for operation on public pedestal walkways, street, road, lane, highway or freeway.
g. Vehicle should not be operated or ridden under the influence of alcohol or medication.
h. Winners should read the user manual before operating the vehicle and follow all safety rules and requirements of your local council and traffic authority.
27. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from a relevant Regulatory Authority.
28. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the telephone or internet user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to Entrants or any other person’s computer related to or resulting from participating in or downloading any materials in the promotion.
