CONDITIONS OF ENTRY
1. Instructions on how to enter form part of these Conditions of Entry. Participation in this Promotion is deemed acceptance of these Conditions of Entry. The Promotion is open to all residents of Australia except employees of the Promoter, members of their immediate families and agencies associated with this Promotion.
2. Entry is only open to residents of Australia. Entrants who are 18 years and under must have permission from their parent or guardian to enter the competition. Employees of the Promoter, 5th Finger Pty Limited and their immediate families and all companies and agencies associated with this promotion are ineligible to enter.
3. The Promotion commences at 12:01am AEST on 6/09/10 and closes at 11.59pm AEST on 31/10/2010. The draw will take place at the Promoters premises. The Draw will begin on 4/11/2010 at 12.00noon AEST. The winner will be contacted by phone and in writing, using the details provided at time of entry. At the time of winner notification the winner will be asked to confirm their name, address mail details in order for prize to be delivered. The major prize winner’s names will be published in the Public Notices section of the Australian on 11/11/2010.
4. This is a game of chance, and skill plays no part in determining the winner. The winner will be selected by random.
5. To enter, individuals must purchase any product from the Jols range of products, and then either SMS their barcode, full name and contact phone number to 199 54 995, log online to the Jols Competition page at www.cosmopolitan.com.au and follow the prompts to enter. 7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’/ winners identity, age, place of residence, receipt (for proof of purchase) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Multiple entries permitted, subject to the following: (a) only one entry permitted per purchase requirement (b) each entry must be submitted separately and in accordance with entry requirements; and (c) each entry must be substantially unique. Entries will not be returned. 9. Incomplete, illegible and incomprehensible entries will be deemed invalid and will not be included in the judging.

Each minor prize Gift Pack will include the following items: Lip gloss, Nail polish, Jols pack 11. The prizes donot include any ancillary costs associated with redeeming the prize. These are the responsibility of the winner. Selection of Items included in prize (including but not limited to size, brand, product type, title etc) will be determined by the Promoter it its complete discretion. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the inclusion of the winners entry is delayed, postponed, rescheduled, relocated or cancelled for any reason whatsoever.
12. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash unless otherwise stated.
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant (f) redemption of the prize and/or (g) participation in the promotion.
17. Prizes valued in Australian dollars. Prize values mentioned are the recommended retail value as provided by the supplier and are correct at time of printing.
18. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. Each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant which does not infringe the rights (including copyright) of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The Promoter is entitled to use any of the entries submitted for any purposes at its discretion, including (but not limited to) for any future promotion, marketing and publicity purposes.
19. By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.
20. The collection, use and disclosure of personal information provided in connection with this competition is governed by the Privacy Notice .
