Terms and Conditions
1. Information on how to enter and prizes form part of these terms and conditions. Any entry not complying with these terms and conditions will be deemed invalid and will not be included in the judging. Participation in this competition is deemed acceptance of these terms and conditions of entry.
2. Entry is only open to residents of Australia aged 3-10 years. Employees of the Promoter, and their immediate families and agencies associated with this competition are ineligible to enter
3. The competition commences on 24 August 2010 & closes last mail received on 26 October 2010 (“Competition Period:)
4. To be eligible to enter, entrants must do one of the following
a) Download and print the flyer from
www.Smarties-Australia.com.au. Colour in the black and white image on the page. Send the flyer to: “SMARTIES 8 Colours of Fun Competition”, PO Box 441, Eastern Suburbs MC, NSW, 2004. Valid entries must also include the entrant’s full name, age, mail address and phone number
OR
b) Colour-in the black and white image on the Competition page/flyer found in one of the Promoter’s participating publications. Complete the entry form and send the flyer to: “SMARTIES 8 Colours of Fun Competition”, PO Box 441, Eastern Suburbs MC, NSW, 2004. Valid entries must include the entrant’s full name, age, mail address and phone number
5. The Promoter reserves the right to verify the validity of all entries (including entrant’s identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process, Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable or illegible entries will be deemed to be invalid
6. This competition is a game of skill and chance plays no part in determining the identity of the winner. All valid entries received during the Competition Period will be individually judged based on creative merit and originality. Judging will take place at the Promoter’s premises and will commence on the 29th of October 2010. Winners will be notified by mail using contact details provided in their entry
7. The 500 best valid entries as determined by the judges will receive a Smiggle prize pack valued at $17.20 recommended retail price (“RRP”). Prize includes a Smiggle A4 Maze Puzzle Notebook and a Smiggle Fat Pencils Tube
8. Total prize pool is valued at $8,600 RRP. Prize does not include any ancillary costs associated with redeeming the prize and will be the responsibility of the winner. Prize will be sent to the entrant at the address provided in their entry. The Promoter shall not be liable for any prize that has been lost, stolen, damaged or tampered with in any way
9. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right (subject to all relevant state and territory regulations) to either provide an alternative prize to the same value as the original prize or to cancel, terminate, modify or suspend the competition.
10. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant (f) redemption of the prize and/or (g) participation in this competition
11. Each entry becomes the property of the Promoter. Entry details and entries will not be retained by the Promoter and they will be destroyed 90 days after the competition closes and prizes have been sent to winners.
12. Promoter’s decision in relation to all aspects of this competition is final and binding on all who enter and no correspondence will be entered into.
13. In the event that the prize is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.
14. Entries are deemed to be received at the time and date of receipt into the Promoter’s PO Box. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant
