1. Information on how to enter, mechanics of entry and the prize form part of these Conditions of Entry. Submission of an entry is deemed acceptance of these Conditions of Entry.

Entry is only open to Australian residents aged 18 years or over who are existing or who become Vodafone Mobile or 3 Mobile account holders and who are able to travel to Singapore for the period Thursday 23rd September 2010 and Monday 27th September (inclusive) (Eligible Entrants).
3. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers, participating retailers and agencies associated with this Promotion are ineligible to enter. PROMOTION PERIOD 4. Promotion commences 00:01 AEST Friday 20th August 2010. Entries close and must be received by 23:59 AEST on Sunday 5th September 2010 (the Promotional Period). The draw will take place at von Muenster Solicitors & Attorneys, 71 Albion Street, Surry Hills NSW 2010 on Friday 10th September 2010 at 10:00 AEST. The winner will be notified by telephone and at this time will be asked to provide his/her contact email address. The winner will then subsequently be notified in writing (email). To enter, Eligible Entrants must, during the Promotional Period, purchase one (1) of the following Mobile Internet Packs: a. Vodafone Mobile customers: Sign up to a $4.95 (50MB), $9.95 (250MB), $19.95 (1GB) or $39.95 (3GB) month-by-month 'Internet On Your Mobile Pack' or sign up to 12 month 'Internet on your Mobile Pack' for $4.95 per month (Total min cost $59.40 over 12 months), $9.95 per month (Total min cost $119.40 over 12 months), $19.95 per month (Total min cost $239.40 over 12 months) or $39.95 per month (Total min cost $479.40 over 12 months); or b. 3 Mobile customers: Sign up to a 12 month Mobile Internet membership pack for $8.00 per month (total min cost over 12 months is $96.00), $20.00 per month (total min cost over 12 months is $240.00), or $40.00 per month (total min cost over 12 months is $480.00), (each, an Eligible Purchase). 6.
Each Eligible Purchase made during the Promotional Period will automatically award the Eligible Entrant a maximum of one (1) entry into the Prize draw. Multiple entries accepted however each entry must be based on a separate Eligible Purchase and must independently comply with these Conditions of Entry.
7. For the avoidance of doubt, if, during the Promotional Period, an Eligible Entrant disconnects from their Eligible Purchase, or ceases to be a customer of Vodafone Mobile or 3 Mobile, their entry will be declared invalid.
8. The Promoter accepts no responsibility for late, lost, misdirected or invalid entries. Incorrect, incomplete or incomprehensible entries will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid
9. The Promoter reserves the right to verify the validity of entries and Eligible Entrants (including an Eligible Entrant's identity, age and address) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process (including but not limited to tampering by way of use of automatic entry software).

Eligible Entrants must retain the purchase receipt for each Eligible Purchase as proof of purchase. Failure to produce proof of purchase for each Eligible Purchase when requested by the Promoter may, in the absolute discretion of the Promoter, result in the invalidation of all of an Eligible Entrant's entries and forfeiture of any right to the prize. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. The Promoter's decision is final and no correspondence will be entered into.
12. If there is a dispute as to the identity of an Eligible Entrant, the Eligible Entrant will be deemed to be the person in whose name the corresponding Vodafone Mobile or 3 Mobile account is held.
13. Costs: Costs associated with accessing the Promotion's website remain an Eligible Entrant's responsibility and may vary depending on the Internet service provider used. DRAW
14. The first valid entry drawn from the pool of all entries received will receive (1) travel prize for the winner and one (1) travel companion (aged 18 years or older) to Singapore for the period Thursday 23rd September 2010 to Monday 27th September (inclusive) valued at up to $21,000.00 (Prize), comprising the following elements: a. 2 x adult return economy class airfares to Singapore from the Australian capital city airport closest to the ordinary residential address of the winner (inclusive of airfare related taxes and charges), departing Australia Thursday 23rd September 2010 and returning Monday 27th September 2010; b. 4 x nights four (4) star hotel accommodation, standard room, twin share in Singapore. The hotel chosen is to be decided at the discretion of the Promoter; c. 2 x VIP tickets to the 2010 Formula 1 SingTel Singapore Grand Prix™ for Friday 24th, Saturday 25th and Sunday 26th September 2010; d. return transfers for the winner and their travel companion to and from Singapore Changi Airport and hotel accommodation; and e. return transfers for the winner and their travel companion to and from hotel accommodation and 2010 Formula 1 SingTel Singapore Grand Prix™ on Friday 24th, Saturday 25th and Sunday 26th September 2010; f. tour of the Vodafone McLaren Mercedes Garage at the Marina Bay Circuit during the 2010 Formula 1 SingTel Singapore Grand Prix™; and g. 2 x Vodafone McLaren Mercedes merchandise packs, including 1x shirt and 1x cap, (together, the Prize).
15. Total maximum Prize value is up to $21,000.00 inc. GST (depending on point of departure). The Prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from Prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in Prize values.
16. Unless otherwise stipulated, the Prize, or any unused portion of the Prize, is not transferable, exchangeable or redeemable for cash.
17. All additional costs not expressly stated, but which may be incurred in acceptance and use of the Prize, are the responsibility of the winner and their travel companion. The winner and their travel companion will be responsible for making their way to and from their home to their nearest capital city airport or nearest regional airport in Australia. The winner and their travel companion is responsible for any further costs associated with redeeming the Prize which are not otherwise specified in these Conditions of Entry, including but not limited to, food and beverage expenses, room service, telephone calls, laundry services, spending money, other transfers, Government taxes including arrival and departure taxes (if applicable), insurance, travel insurance, passports and visas (if applicable) additional entertainment and/or miscellaneous expenses. For the avoidance of doubt, no "spending money" is included in the Prize.
18. The Prize is awarded on a twin-share basis and the winner and their travel companion must travel at the same time, must depart from the same capital city, are responsible for transport from their residence to their nearest capital city including airport transfers for flight departure and must share accommodation in Singapore, South East Asia.
19. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline for this Promotion.
20. A credit card imprint or cash deposit may be required from the Prize winner at check-in to the hotel included in their Prize, for all incidental charges.
21. It is the Prize winner and their travel companion's personal responsibility (at their own personal expense) to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination, in addition to recommended vaccinations and immunisations, and, if required, on or by a date nominated by the Promoter. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Prize winner and their travel companion. Proof of such documentation must be made available to the Promoter on demand at any time. Failure to do so may result in the Prize being forfeited.
22. The Prize must be taken for the period Thursday 23rd September 2010 – Monday 27th September 2010 (inclusive), otherwise the entire Prize is forfeited. All components of the Prize must be taken together and when offered or are forfeited. No extension or variation of the travel dates nominated by the Promoter is permitted. Use of the Prize and any passes or vouchers issued as part of the Prize may be subject to prevailing prize supplier terms and conditions of use. The Prize cannot be used in conjunction with travel discounts or special offers.
23. Acceptance of the Prize is subject to any prevailing terms and conditions of the 2010 Formula 1 SingTel Singapore Grand Prix™ for Friday 24th, Saturday 25th, Sunday 26th September 2010 (including but not limited to ground security and ticketing) as well as accommodation/transport/services/transfers or tour providers, and in particular, health, behaviour, age restriction and safety requirements. No compensation will be payable if the winner, or their travel companion, is unable to use any element of the Prize as stated for whatever reason, including refusal of entry or ejection from the 2010 Formula 1 SingTel Singapore Grand Prix™ for Friday 24th, Saturday 25th and Sunday 26th September 2010 or participation in certain activities for health, age, behaviour or safety reasons.
24. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
25. As a condition of accepting the Prize, the winner and travel companion may be required to sign a waiver of liability and indemnity form or forms as required by the Promoter and/or the Prize supplier or other 3rd parties.
26. The person whose entry was drawn in the Prize draw must confirm their eligibility to be awarded the Prize, and ability to take the Prize between Thursday 23rd September 2010 – Monday 27th September 2010 (inclusive), by 17:00 AEST on Tuesday 14th September 2010 otherwise their entry will be deemed invalid. If their entry is deemed invalid or if the Eligible Entrant is not able to be contacted by the Promoter by this time, the Prize will be awarded to the first reserve entry drawn in accordance with Conditions 27 and 28.
27. The Promoter will draw ten (10) additional reserve entries in the Prize draw (and unclaimed Prize draw, if required) and record them (in order) in case an invalid entry or ineligible Entrant is drawn. This may include where the Eligible Entrant drawn is unable to accept the Prize, or if the Eligible Entrant does not confirm their eligibility to be awarded the Prize, including where the Promoter is unable to contact the Eligible Entrant drawn, in the required time as detailed in these Conditions of Entry.
28. If the Prize cannot be awarded to the person drawn, the Promoter will contact the person whose entry was drawn as the first reserve entry in accordance with Condition 27, by telephone and at this time ask the person to provide their contact email address. The person will then subsequently be notified in writing (email). The person whose entry was drawn as the first reserve entry must confirm their eligibility to be awarded the Prize, and ability to take the Prize between Thursday 23rd September 2010 and Monday 27th September 2010 (inclusive) within eight (
hours of being contacted by the Promoter, otherwise their entry will be deemed invalid. If their entry is deemed invalid, or if the person whose entry was drawn as the first reserve entry is not able to be contacted within eight (
hours of the Promoter first attempting to contact them, the Prize will be awarded to the second reserve entry drawn in accordance with Condition 27, with this process continuing until the Prize is awarded. If after this process the Prize has still not been awarded, the Promoter will hold an unclaimed prize draw in accordance with Condition 31.
29. If for any reason whatsoever the Eligible Entrant does not redeem their Prize or an element of their Prize by the time stipulated by the Promoter, then the Prize or that element of the Prize will be forfeited by the Eligible Entrant and neither cash nor any other prize will be awarded in lieu.
30. Should an Eligible Entrant's contact details change during the Promotional Period, it is the Eligible Entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
31. The Promoter may conduct an unclaimed prize draw at the same time and place as the original draw as is necessary on Friday 17th September 2010 in order to distribute the Prize if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. The person whose entry was drawn in the unclaimed prize draw must confirm their eligibility to be awarded the Prize, and ability to take the Prize between Thursday 23rd September 2010 – Monday 27th September 2010 (inclusive), by 17:00 AEST on Monday 20th September 2010 otherwise their entry will be deemed invalid. The winner's name and locality will be published in The Australian on Monday 20th September 2010. If their entry is deemed invalid or if the Eligible Entrant is not able to be contacted by the Promoter by 17:00 AEST on Monday 20th September 2010, the Prize will be awarded to the first reserve entry drawn in the unclaimed prize draw in accordance with Conditions 27 and 28. In the event of a winner in the unclaimed prize draw, the winner will be notified by telephone within twenty-four (24) hours of the draw and at this time will be asked to provide their contact email address. The winner will then subsequently be notified in writing (email).
32. If the Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with an alternative prize (or part of the prize) to the equal or greater value, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
33. The Promoter reserves the right to request the Prize winner (and their travel companion) to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction at its sole discretion) in order to confirm their identity and age, and ability to travel, before issuing the Prize.
34. Force Majeure: In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any written directions made under applicable State or Territory legislation, the Promoter reserves the right to either provide an alternative Prize (including an alternative destination at an alternative date as specified by the Promoter) to the same value as the original Prize or to cancel, terminate, modify or suspend the Promotion.
35. Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotion's website or the information on the website, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Eligible Entrant, the Eligible Entrant agrees to indemnify the Promoter for those losses, damages and costs.
36. Except for any implied condition or warranty the exclusion of which from these Conditions of Entry would contravene any statute or cause any part of these Conditions of Entry to be void (Non Excludable Condition), the Promoter excludes from these Conditions of Entry all conditions, warranties and terms, implied by statute, general law or custom. Except for any liability in relation to a Non Excludable Condition, the Promoter (including its officer, employees and agents) excludes all liability whether arising in tort (including, without limitation, negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss or profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize values to that stated in these Conditions of Entry; (e) any tax implications; (f) the cancellation or postponement of the Event or flights component of the Prize; and/or (g) the Prize or use of the Prize.
37. Eligible Entrants can only enter in their own name. Eligible Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Promotion and all entries of an Eligible Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Eligible Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the Eligible Entrant's identity, age, residential address, eligibility to enter and claim the Prize before submitting their entry (if applicable), that the Eligible Entrant has a clear relationship with the end mobile device used to enter, and any information submitted by the Eligible Entrant in entering the Promotion, before issuing the Prize.
38. Copyright and privacy generally: An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter and 3 Mobile collects personal information about an Eligible Entrant to include the Eligible Entrant in the Promotion and, where appropriate, award the Prize. If the personal information requested is not provided, the Eligible Entrant cannot participate in the Promotion and is deemed ineligible.
39. An Eligible Entrant also agrees that the Promoter may, in the event the Eligible Entrant is the winner, publish or cause to be published the Eligible Entrant winner's name and locality in any media, as required under the relevant State or Territory legislation. An Eligible Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter's Privacy Officer in writing at: Vodafone Hutchison Australia Pty Limited of Level 7, 40 Mount Street, North Sydney NSW 2060. All personal information will be stored at the office of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
40. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
41. Right to verify: The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Eligible Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Eligible Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
42. Each Eligible Entrant consents, if the Eligible Entrant becomes the winner, to the Promoter using the Eligible Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further remuneration for the purpose of promoting this Promotion (including any outcome), the Promoter and or products/services supplied by the Promoter. The Eligible Entrant agrees that, in the event they are the winner, the Eligible Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents. ` 43.
