Win a luxury escape to Fiji, Bali or Tahiti or 1/200 Palmer's Pamper PacksTerms & ConditionsInformation regarding prizes and how to enter forms part of these Conditions of Entry. By entering this promotion, Eligible Entrants (as defined in clause 2 below) accept these Conditions of Entry.
Entry is open only to "Eligible Entrants" being individuals who are residents of Australia aged 18 years or over. Officers and employees (and their immediate families) of the Promoter or of the participating retailers, agencies or companies associated with this promotion are ineligible to enter.
The promotion begins at 12:01am (AEST) on 6 September 2010 and entries close at 11:59pm (AEDST) on 30 November 2010 ("Promotional Period").
To enter, Eligible Entrants must: (a) purchase any Palmers product from a participating retailer nationally between 6 September 2010 and close of business on 30 November 2010 ("Qualifying Purchase"); and (b) register their Qualifying Purchase before 11:59pm (AEDST) on 30 November 2010 by logging on to
www.palmersaustralia.com and following the prompts to register their purchase in the manner required. Eligible Entrants must provide all the requested mandatory details, including their title, first name, surname, date of birth, gender, postal address, telephone number, mobile telephone number (if applicable), current and valid email address, date of purchase, the full barcode number of the Qualifying Purchase, the receipt number of the Qualifying Purchase and the name and location of the participating retailer where the Qualifying Purchase was made. Eligible Entrants will also need to tick a 'check-box' to confirm that they are over 18 years of age and have read and accept these Conditions of Entry, and Eligible Entrants may also choose to tick a 'check-box' if they would like to opt-in to receiving future marketing material from the Promoter in accordance with Condition 36.
Eligible Entrants must retain a copy of their Qualifying Purchase receipt(s) for all entries as proof of purchase. When an entry is drawn in accordance with Condition 7 and the Eligible Entrant is notified, the Eligible Entrant must submit a copy of the Qualifying Purchase receipt to the Promoter (in the form requested by the Promoter) to verify the entry before any Prize (as defined in clause 7 below) will be awarded. Failure to provide this proof of purchase for all entries when requested may, in the absolute discretion of the Promoter result in invalidation of ALL of an Eligible Entrant's entries and forfeiture of any right to a Prize. Qualifying Purchase receipt(s) must clearly specify the store of purchase and that the Qualifying Purchase was made during the Promotional Period but prior to entry.
Multiple entries will be permitted, but each entry must be based on a separate Qualifying Purchase and must fully comply with these Conditions of Entry. For the avoidance of doubt, each Qualifying Purchase will entitle Eligible Entrants to ONE (1) entry only, regardless of the total value of that Qualifying Purchase.
The Prize draw will take place at 12 noon (Sydney time) on 2 December 2010 at Digital Stampede, 106 Alexander St, Crows Nest NSW 2065. The first valid entry drawn will win the Major Prize. The next 200 entries drawn will each win a Minor Prize (collectively "Prizes").

Each Major Prize option is valued at up to AU$12,500 (including GST), depending on date and point of departure.
The Major Prize winner's name and state/territory of residence will be published in The Australian newspaper and at
www.palmersaustralia.com on 9 December 2010.
All winners will be notified by phone and email using the details provided in their online registration by 4 December 2010.
The Major Prize must be taken by 30 November 2011 and is subject to booking and flight availability. Block out period includes 10 December 2010 - 15 January 2011 and 10 June 2011 -15 July 2011.
The Promoter is not obliged to supply substitute prizes where the Major Prize winner (and/or his/her companion) does not satisfy the conditions of use for any element of the Major Prize or does not accept an element of the Major Prize. The winner's companion must be aged 18 years or over.
The Major Prize winner (and his/her companion) must be in possession of a valid passport with a minimum of six (6) months validity on it prior to departure. The Major Prize winner (and his/her companion) is responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. The winner (and his/her companion) are responsible for ensuring that they have valid passports, any requisite visas, vaccinations and travel documentation. All other costs associated with the Major Prize (other than those included), including but not limited to, additional spending money, additional meals, additional taxes, passports, transport to and from departure point, additional transfers, items of a personal nature, and any other ancillary costs such as insurance and any applicable insurance excesses are the responsibility of the Major Prize winner (and his/her nominated companion) as incurred.
The Promoter recommends that the Major Prize winner (and his/her companion) take out travel insurance for their period of travel, however, this is not a mandatory requirement and any costs to do so, will be at the Major Prize winner's expense. The winner (and his/her companion) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Major Prize. The Major Prize winner may be required to present a credit card at time of accommodation check in. Major Prize is subject to standard terms and conditions of individual prize/service providers.
It is the Major Prize winner's responsibility to ensure that they (and this/her companion) are sufficiently healthy and fit so as to safely take the Major Prize. The Promoter reserves the right, acting reasonably, to deem that the Major Prize winner (and/or his/her companion) are not sufficiently healthy or fit to take the Major Prize.
All travel is subject to booking and flight availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partners. All bookings and documentation regarding the Major Prize will be made via Free-2-Travel Holidays Pty Ltd or their agents at least 60 days prior to travel. Entitlement to the Major Prize is conditional on the Major Prize winner's and their travelling companion's acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices.

Eligible Entrants acknowledge that there are inherent risks in some aspects of the Major Prize. By entering this promotion and accepting the Major Prize, entrants accept that risk.
At the request of the Promoter, the Major Prize winner (and his/her companion if applicable) must sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this promotion and/or providing the Prize prior to taking or using the Prize (or undertaking the activities included in the Major Prize if applicable). If the Major Prize winner (and/or his/her companion) does not sign the indemnity form within the time requested by the Promoter, the winner's entry will be deemed invalid and any entitlement to the Prize will be forfeited.
The winners (and his/her companion, if applicable) must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of a Prize. The winner (and his/her companion) agree to grant the Promoter a royalty-free, perpetual licence to use the footage and photographs from such promotional activities in all media worldwide for an unlimited period.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take a Prize (or an element of the Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.
If a Prize (or part of a Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter in accordance with the timeframes outlined above, otherwise the entry will be deemed invalid. Entries will be deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the Eligible Entrant. The Promoter accepts no responsibility for any late, lost or misdirected entries or correspondence.
Any costs associated with accessing the promotional website remain the responsibility of each Eligible Entrant and are dependent on the internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.
The Promoter has no control over mobile telephone communications, internet communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
Eligible Entrants can only enter in their own name. The Promoter reserves the right to request all Eligible Entrants to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm each Eligible Entrant's identity, age, residential address and email address, eligibility to enter and claim a Prize and any information submitted by the Eligible Entrant in entering the promotion, before issuing a Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entry has not been verified or validated to the Promoter's satisfaction within the time requested, that entry will become invalid. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this promotion or accepting, taking or using a Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
In the event of war, terrorism, state of emergency or disaster or if the promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
If an entry is deemed not to comply with these Conditions of Entry, the entry will be discarded and a new winner of that Prize will be determined by drawing a further valid entry in accordance with Condition 35. The Promoter's decision is final and no correspondence will be entered into.
The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the promotion or acts in violation of these Conditions of Entry, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
Prizes are not transferable or exchangeable and cannot be redeemed for cash. The Prizes must be taken as offered and cannot be varied. The Promoter is not responsible for any costs incurred by a winner in taking a Prize. The Promoter accepts no responsibility for any variation in the Prize value. The Promoter accepts no responsibility for any tax implications that may arise from the winnings. Independent financial advice should be sought.
If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory, where required.
In the event of a Prize not being claimed by 2 March 2011, the Promoter reserves the right to conduct such further draws at 12 noon (Sydney time) on 3 March 2011 at the same location as the original draw as are necessary to organise the unclaimed Prize, subject to any written directions given by any relevant authority. In the event of a winner(s), their name and state/territory of residence will be published in The Australian on 10 March 2011.
The information Eligible Entrants provide will be used by the Promoter for the purpose of conducting this promotion. The Promoter may disclose Eligible Entrants' personal information to its contractors and agents to assist in conducting this promotion or communicating with Eligible Entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. If an Eligible Entrant has marked the 'check box' on their online entry form, the Eligible Entrant consents to the storage of their personal information on the Promoter's database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter's products, including contacting the Eligible Entrant via electronic messaging.
