CHANNEL [V] “PARKLIFE: DJ WITH MIX MASTER MIKE” COMPETITION TERMS AND CONDITIONS ENTRY INTO THE COMPETITION 1. Entry into the Channel [V] “Parklife: DJ WITH MIX MASTER MIKE” competition (the “Competition”) is open to all residents of Australia aged 18 years and over. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions. 2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter. 3. Competition begins at 9.00am (AEST) on Monday 6th September 2010 and closes at 11.59pm (AEST) on Sunday 19th September 2010 (the “Competition Period”). 4. To enter the Competition and be eligible to win, entrants must: (a) be over the age of 18 years; (b) register for membership online at www.vmusic.com.au; (c) complete the online entry form; and (c) in 200 words of less answer the following question, “Tell us five tracks that you would mix together into a playlist if you got the chance to DJ with Mix Master Mike and what would you call your playlist?” (the “Competition Question”) 5. All entries must include the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth to be eligible for entry. Incomplete entries or those with defamatory, copyrighted, pre-used or offensive content will be ineligible. It is the entrant’s responsibility to inform the Promoter if their residential address, email address or phone number changes during the Competition Period. 6. Only 1 entry per membership per day will be permitted. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice. PRIZE 7. There is 1 x Major Prize and 5 x Minor Prizes in total. The Major Prize consists of: • 2 x return domestic economy airfares from the Major Prize winner’s nearest capital city to Melbourne (“Flight”), valued at a maximum of $1500; • 2 x VIP Parklife tickets for Parklife Festival in Melbourne to be held at The Sidney Myer Music Bowl and the King’s Domain in Melbourne on Saturday 2nd October 2010 (“Event”), valued at a maximum of $500; • 2 x nights accommodation for two people in Melbourne, valued at a maximum of $400; • Airport – hotel – Event return transfers, valued at a maximum of $300; • 1 hour DJ masterclass with Mix Master Mike, this is a money cant buy prize (the “Major Prize”) The Minor Prizes consist of 2 x GA passes to a Parklife event as determined by the entrant (one double pass per Parklife event below is available to be won), valued at a maximum of $300 (the “Minor Prize/s”). Date Venue Saturday 25 September 2010 Gold Coast - Parklands Sunday 26 September 2010 Perth - Wellington Square Saturday 2 October 2010 Melbourne - The Sidney Myer Music Bowl and the King’s Domain Sunday 3 October 2010 Sydney - Kippax Lake, Moore Park Monday 4 October 2010 Adelaide - Botanic Park, Botanic Gardens of Adelaide All aspects of the Major Prize must be used at one time to coincide with the Event. The Major Prize and the Minor Prizes are together referred to as “the Prizes”. 8. The total maximum Prize pool value is $4200 (1 x Major Prize valued at $2700 + 5 x Minor Prizes valued at $300 each).The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars. 9. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes. The dates and venues selected by entrants cannot be changed at a later date. 10. Only one Prize per person will be awarded. JUDGING AND AWARD OF PRIZE 11. The Competition will be judged on the basis of creativity at Channel [V], Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Monday 20th September 2010 at 10.00am (AEST). Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via email or phone on Tuesday 21st September 2010 and their names published on the Channel [V] website from Wednesday 22nd September 2010. The Prizes must be claimed within 5 days of the publication of the Prize winner’s name. 12. If the Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize. AGE In order to be eligible to enter the Competition, entrants must be over the age of 18. The Major and Minor Prize winners and their guests must both be over 18 years old in order to participate in the Major and Minor Prizes. Entries received from entrants who are under 18 years old will be ineligible for entry. TRAVEL 13. It is a condition of entry that the Major Prize winner and their guest must be available to travel to and stay in Melbourne on the dates specified by the Promoter in Clause 7 to coincide with the Event detailed in Clause 7. 14. In the event that the Major Prize winner is a resident of Melbourne (which shall be determined at the absolute discretion of the Promoter), the flight component of the Major Prize will be forfeited in full and no substitute will be offered. The Major Prize winner’s nearest capital city will be determined at the discretion of the Promoter. 15. All ancillary costs incurred in taking and using the Major Prize (including but not limited to meals, mini bar, spending money, insurance and taxes) are the responsibility of the Major Prize winner and their guest. All ancillary costs incurred in taking and using the Minor Prizes (including but not limited to transport, spending money and accommodation costs) are the responsibility of the Minor Prize winners and their guests. Unless expressly stated as being part of the Prizes, all other expenses are the sole responsibility of the Prize winners and their guests. 16. Prize winners are advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize. 17. It is a condition of accepting the Prize that the Prize winners and their guests may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 18. The Promoter reserves the right to refuse to allow the Prize winners or his or her guests to take part in any or all aspects of the Major or Minor Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Major or Minor Prize. GENERAL 19. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered. 20. By entering the Competition, each entrant warrants that their entry, is their own original work and that they own all rights, including copyright in their entry. Each entrant indemnifies the Promoter in the event that this warranty is false. 21. No responsibility will be taken by the Promoter, Channel [V], FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize. 22. The Promoter reserves the right to cancel the award of prize/s to, and/or to disqualify any individual who, as determined in the sole discretion of the Promoter, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition. 23. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel the Competition or to vary or cancel the terms of the Competition or the award of the Prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion): (a) a Prize winner does not satisfy the Competition entry requirements; or (b) the Promoter cannot conduct the Competition or award the Prize for any reason beyond its control. 24.
