TERMS AND CONDITIONS
PARTICIPATION
1. This competition (“Competition”) is conducted by TV1 General Entertainment Partnership, ABN 19 094 282 021, of Building 208, Lang Road, The Entertainment Quarter, Moore Park NSW 2021 (“Promoter”).
2. Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
3. The Competition is only open to “Eligible Entrants”, being individuals who: (i) are residents of Australia; (ii) are aged 15 years or over; (iii) are not employees of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iv) are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee. Entrants under the age of 18 years must seek permission to enter the Competition from their parent or guardian.
4. Competition entry commences at 12:01AM AEDST on Sunday 12 September 2010 and closes at 11:59PM AEDST on Saturday 25 September 2010 (“Entry Period”).
ENTRY TO COMPETITION
5. To enter, Eligible Entrants must, during the Entry Period, visit
www.scifitv.com.au, follow the directions to the competition page and fill in all the required details including first and last names, postal address, e-mail address and phone number and submit the fully completed entry form.
6. Subject to the other provisions of this condition, entry is only open to a person who, at the time of entering: (i) has a valid subscription to a television service licensed to carry SCI FI; or (ii) is a friend or relative of a Subscriber living in the same household as a Subscriber who is authorised by that Subscriber, in accordance with these conditions, to enter the Competition.
7.
To enter, Eligible Entrants must, during the Entry Period, indicate on the online entry form that they are available to travel between 14 October 2010 and 19 October 2010. 8.
Only one (1) entry permitted per person. 9. Incomplete, indecipherable or illegible entries will be deemed invalid.
10. All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any telecommunications service or equipment.
11. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
12. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's satisfaction; or (ii) tampers with the entry process or benefits from such tampering; or (iii) submits an entry which in the Promoter's opinion is not in accordance with these Terms and Conditions. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
13. Any costs associated with accessing the Competition website are the responsibility of the Eligible Entrant and are dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
DRAW AND PRIZES
14. The draw will be held at 11AM AEDST on Monday 27 September 2010 at Salmat Interactive Pty Ltd Level 17, 100 Arthur Street North Sydney NSW 2060.
15. The promoter reserves the right to select reserve entries and record them in order to be used in the case of an invalid entrant being determined as the winner.
16. The first valid entry drawn will win a trip for two (2) people to Los Angeles, CA, USA valued at up to AU$10,000 depending on date and point of departure including return economy airfares from winner's nearest capital city, five (5) nights twin share accommodation at a first class hotel with return private airport transfers and two (2) tickets to the 2010 Scream Awards in LA at the Greek Theatre on 16/10/10 with return private transfers to and from the event plus two (2) one (1) day passes to Universal Studios Hollywood theme park.
Spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken in order to coincide with the 2010 Scream Awards on 16/10/10, and flights must depart on 14/10/10 subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or peak periods.
17. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
18. Prize is subject to the standard terms and conditions of individual prize and service providers, including any applicable age restriction. Frequent flyer points will not form part of the prize. Winner may be required to present credit card at time of accommodation check in.
19. The 2010 Scream Awards tickets are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
20. If for any reason the winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash. Prize must be taken as is, no alternative will be offered subject to the absolute discretion of the promoter.
21. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
22. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on behalf of the winner.
23. Total prize pool value is up to AU$10,000. Prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
25. All prizes are valued as at 20 August 2010. The Promoter takes no responsibility for any variations in prize values.
26. If the prize (or part of the prize) is unavailable for any reason, the Promoter reserves the right, in its absolute discretion, to substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition.
WINNER
27. The winner will be notified by telephone within two days of the draw to the number indicated in the entry and in writing which will be sent: (i) by post to the address indicated in the entry or (ii) by e-mail to the e-mail address indicated in the entry. The notification may include instructions as to how the winner is to claim the prize.
28. The name of the winner will be published in the Public Notices section of The Australian newspaper on Thursday 30 September 2010 and on the SCI FI website at
www.scifitv.com.au.
29. In order to be entitled to any prize, the winner must, if requested by the Promoter, agree to and sign: an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize; and a liability release in favour of the Promoter and/or any person or other entity associated with this Competition. A winner who does not comply with this condition forfeits their prize.
GENERAL
30. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law,(a) to disqualify any entrant or (b) to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
31. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
32. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH AN ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
33. All of the Promoter’s decisions are final and no correspondence will be entered into.
34. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the competition. Entrants should obtain independent tax and financial advice.
35. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death; (iv) any theft, unauthorised access or third party interference; or (vi) use of a prize.
36. The winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
37. Eligible Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winners. The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers, agents, contractors, deliverers, and to regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. Persons may contact the Promoter by post at the address stated in condition 1 or by visiting
www.scifitv.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
