VITTORIA COFFEE WIN A ‘LONG BLACK’ AUDI Q7 3.0TDI V6 WITH A BOOT PACKED WITH VITTORIA COFFEE TERMS & CONDITIONS
HOW TO ENTER
1.To be eligible to enter, individuals must purchase any pack of Vittoria Coffee from any Woolworths or Safeway store nationally during the Promotional Period.
2.To enter, entrants must then, during the Promotional Period, either:
a.Fully complete the official original on-pack or on-shelf entry form and send to ‘Vittoria Coffee Promotion’, PO Box 72, Potts Point NSW 1335;
or
b.Visit www.vittoriacoffee.com/winalongblack, follow the prompts to the competition entry page, input all of the requested details and submit the fully completed entry form.3.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
4.Entry is only open to Australian residents aged 18 years or over who have a valid and current Australian State or Territory driver licence.5.Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin
6.Promotion commences 0:00am AEST on 20/09/2010 and entries close last mail received on 12/11/2010 for mail entries and 5:00pm AEDST on 12/11/2010 for online entries (“Promotional Period”). The draw will take place at Aura Digital 14/372 Wattle Street, Ultimo NSW 2007 on 19/11/2010 at 12 noon AEDST.
7.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8.Incomplete, indecipherable or illegible entries will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.
9.Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with the entry requirements. 10.Entrants must retain their original Woolworths/Safeway purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Woolworths/Safeway purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
11.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
12.The winner will be notified personally and by mail and the winner’s name will be published in The Australian on 25/11/2010.
13.The Promoter’s decision is final and no correspondence will be entered into.
14.The first (1) valid entry drawn will win:
15.1 x Black Audi Q7 3.0TDI V6 with manual transmission valued at up to AU$104,536.00 including GST, all compulsory insurance and on‑road costs (which may vary State by State) and;
16.30kg of Vittoria Ground Espresso Coffee (awarded in 1kg packs) valued at up to AU$1,100.00 including GST. 17.For the Audi Q7 3.0TDI V6 element of the prize, additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The Audi Q7 3.0TDI V6 is black in colour. The Promoter takes no responsibility for any mechanical, body or paint repairs from the date and time of collection of prize. The winner must collect the prize from their nearest authorised Audi dealership. The winner will be responsible for any expenses incurred in getting to and from their nearest authorised Audi dealership to collect the prize.
18.The winner must have a current valid Australian driver’s licence. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then such winner may assign the Audi Q7 3.0TDI V6 vehicle prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before possession of the car is provided to the winner.
19.Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu.
20.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with an alternate prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
21.Total prize pool value is up to AU$105,636.00 (including GST).22.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
23.If required, a draw for any unclaimed prize may take place on 21/02/2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner will be notified by mail and the winner’s name will be published in The Australian on 25/02/2011.
24.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
26.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
27.Unless expressly stated within these Terms and Conditions regarding all prizes, all other expenses become the responsibility of the winner.
28.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
29.Except for any implied condition or warranty the exclusion of which from these Terms and Conditions would contravene any statute or cause any part of these Terms and Conditions to be void (“Non Excludable Condition”), the Promoter excludes from these Terms and Conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Condition, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax implications; and/or (f) a prize or use of a prize.
30.As a condition of accepting a prize, te winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
31.The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, under Australian lottery legislation or any other Australian regulatory authority. Entry is conditional on providing this information. Unless the entrant “opts out” at the time of entry, the Promoter may, for an indefinite period, unless otherwise advised, also use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
