1. AutoChic Pty Ltd

2. Who May Enter
i. The only persons who may enter and be awarded prizes are members of AutoChic.com.au who are residents of Australia, and who have attained the age of 18, who are not (i) employees of, or contractors to, autochic.com.au or any of its agencies involved with this competition, or (ii) members of the immediate family of such employees and contractors.
ii. "Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee/contractor.
iii. AutoChic reserves the right, at any time during or after the closing date of the competition, to verify the validity of entries and to disqualify any entrant who tampers with the entry process. Failure of AutoChic to enforce any of its rights at any stage does not constitute a waiver of those rights.
iv. AutoChic accepts no responsibility for late, lost or misdirected entries.
3. Entrants Bound By Conditions
i. By participating, entrants agree to be bound by these conditions and additional customised conditions for each competition.
ii. Information on "how to enter" and prizes form part of conditions of entry.
4. How To Enter
To enter, entrants must be an AutoChic member (membership is free), and click on the "Enter the Competition" link beneath each competition on www.autochic.com.au5. Limitations On Entry
Members may enter an unlimited number of times within each competition.6. Duration
The opening and closing dates of the competition are as outlined in the customised conditions for each competition.
7. Selection of a Winner
i. The first valid entry drawn via Random Number Generator on the date stipulated in the customised conditions for each competition will win the prize.
ii. An independent person will oversee the draw in accordance with the requirements of the Department of Gaming and Racing.
iii. AutoChic reserves the right to disqualify any entrant submitting an entry which, in the opinion of AutoChic, is invalid.
iv. The decision of AutoChic is final and no correspondence will be entered into.
The prize must be taken as offered and cannot be varied by the winner.
v. AutoChic may conduct such further draws at the same place as the original draw as are necessary on the date stipulated in the customised conditions for each competition in order to distribute the prize if unclaimed. Unclaimed prizes will be redrawn 1 month from the date stipulated in the customised conditions.
8. Prize
i. The prize is as outlined in the customised conditions for each competition.
ii. The total prize is valued at the amount stipulated in the customised conditions for each competition.
iii. The value of the prize is accurate and based upon the recommended retail price(s) at the date of publication as per the prize provider.
iv. All prize items are valued inclusive of GST* and AutoChic takes no responsibility for any variations in item values.
v. Unless specified otherwise, please allow up to 6-8 weeks for delivery of your prize.
vi. The prize is not transferable, exchangeable or redeemable for cash. The winner cannot sell, transfer, assign, exchange or take as cash the prize or any unused portion of the prize.
vii. In the event that any prize item is unavailable; AutoChic reserves the right to substitute a prize item of equal or lesser value.
iix. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.
ix. Spending money, meals, beverages, taxes (other than in circumstances specified above), incidental room charges, insurance (including standard commercial travel insurance), passports, visas, vaccinations, transport (other than in circumstances specified above) and all other ancillary costs in relation to the prize are the responsibility of the winner.
x. The winner and companion are responsible for ensuring that they have valid passports, and requisite visas, vaccinations and any other required travel documentation for a travel prize.
xi. The winner may be required to present a credit card at the time of check in at any accommodation prize for security purposes only and to cover any incidental expenses incurred that are not included as part of the prize.
xii. In the event that for any reason whatsoever a winner does not take the prize or an element of the prize at the time stipulated by AutoChic then the prize or that element of the prize will be forfeited by the winner and cash, prize-equivalent or other compensation will not be awarded in lieu of the prize or that element of the prize.
9. Disclaimer & Exclusion of Liability
i. AutoChic makes no representations or warranties as to the quality, suitability or merchantability of any of the goods or services offered as prizes.
ii. To the extent permitted by law, AutoChic is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by AutoChic, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner and, where applicable, to any family/persons accompanying the winner.
iii. If appropriate to prize, the winner and his or her guests must sign and return any liability release provided by AutoChic and/or its contractors as a condition of the prize being awarded.
iv. A winner and any guests under 18 years must be accompanied by a parent or guardian who signs any liability indemnity provided by AutoChic as a condition of the prize being awarded.
v. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner.
vi. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
vii. To the fullest extent permitted by law, any liability of AutoChic or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.
10. Winner Notification & Publication
i. The winners will be notified by telephone call and confirmation email, using the details provided in their entry, and the name, suburb and State or Territory of the winner will be published as specified on
www.autochic.com.auii. In participating in the prizes, the winners agree to participate and co-operate as required in all publicity and editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to grant AutoChic a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use.
11. Internet
i. If for any reason the competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of AutoChic which corrupt or affect the administration security, fairness, integrity or proper conduct of the competition, AutoChic reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
ii. AutoChic assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries.
iii. AutoChic is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by AutoChic on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.
iv. Any attempt to deliberately damage any website or the information on a website, or to otherwise undermine the legitimate operation of the competition, may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, AutoChic reserves the right to seek damages to the fullest extent permitted by law.
12. Privacy
Any personal or other information submitted by you to Autochic is subject to our Privacy Policy and may be subject to use by a 3rd Party associated with AutoChic.
13. Entire Agreement
i. These conditions and any customised conditions in relation to any individual competition constitute the entire agreement of the parties relating to the entry and the conduct of any AutoChic competition.
