CLUB MARINE MANDURAH BOAT SHOW COMPETITION
TERMS AND CONDITIONS
By entering the “Club Marine Mandurah Boat Show” Competition (“the Competition”), you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Western Australia aged 18 years or older.
2.2 Employees and their immediate families of Seven Network (Operations) Limited, Golden West Network, West Australian Newspapers Limited, Perth FM Radio Pty Ltd, Club Marine, Challenge Marine and Premiere Productions and their associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The Competition commences on Monday 4 October 2010 at 9.00am (Perth time) and concludes on Friday 15 October 2010 at 7.00pm (Perth time) (“Competition Period”).
3.2 Each Wednesday and Saturday from Wednesday 29 September to Saturday 9 October 2010 The West Australia will print a coupon. In order to enter the competition entrants must complete the coupon and:
a) post it to Mix 94.5, GPO Box 2945, Perth WA 6800 by 5pm (Perth time) on Tuesday 12 October 2010;
b) drop it off between 9am and 5pm (Perth time), Monday to Friday at Mix 94.5, 450 Roberts Road, Subiaco WA 6008, before 5pm (Perth time) on Wednesday 13 October 2010 ; or
c) drop it off between 9am and 5pm (Perth time) at The West Australian display at the Club Marine Mandurah Boat Show, being held from Friday 8 October to Sunday 10 October 2010. Entries dropped off at the Club Marine Mandurah Boat Show will go into bonus “Boat Show Only” draws being conducted at the Club Marine Mandurah Boat Show (as defined in Clause 5.4).
3.3 Entrants in the Competition may enter as many times as they like provided each entry is on an original entry coupon.4. PRIZES
4.1 There will be one (1) major prize winner and three (3) bonus “Boat Show Only” prize winners.

4.2 Prizes are:

4.3 The total prize value is $49,297. Prize values are correct as at the date of printing (inclusive of GST). The Promoters accept no responsibility for change in prize values between now and the ultimate date on which prizes are taken.
4.4 The winner of the major prize is responsible for all other expenses including transfer fees and all costs associated with collection of the prize from Challenge Marine.
4.5 The winners of the bonus “Boat Show only” prizes are responsible for all other expenses including all fees associated with the collection of their prize.
4.6 In accepting a prize, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to grant the Promoters a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use.
4.7 The winners agree they will not, and will ensure that their companions do not, sell or otherwise provide their story and/or photographs to any media or other organisation.
4.8 Prizes cannot be transferred nor redeemed for cash. Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.

5. HOW TO WIN
5.1 Every weekday at 9.30am from Monday 4 October to Thursday 14 October 2010, Mix 94.5 will draw seven names from the entries received by Mix 94.5. The first four names drawn will be announced on Mix 94.5 between 10am and 4pm (Perth time) and the remaining three names will be announced on Channel Seven Perth and the Golden West Network between 7pm and 9.30pm (Perth time) that day. Entries received as per clause 3.2 (c) will be included with the entries posted or dropped off at Mix 94.5 at 9am on Monday 11 October 2010 and will be included in all draws from that date forward.
5.2 Once a winner’s name is announced, the person will have 30 minutes to phone Mix 94.5 on 13 33 53 to be registered as a finalist and go into the draw to win the major prize. Should the person fail to contact the station within the designated time, he/she forfeits the right to be registered as a finalist. If Mix 94.5 announces the name of a person who resides outside the Perth metropolitan area at the time of the draw, they will automatically qualify to become a finalist and there is no requirement for them to ring Mix within the 30 minute timeframe.

5.3 The major prize draw will take place on Friday 15 October 2010 between 12pm and 4pm (Perth time) at Mix 94.5. The major prize winner will be announced on Mix 94.5 that day and will be notified via a phone call.
5.4 If a completed entry coupon is successfully submitted as per clause 3.2 (c) of these terms and conditions, it will be included in bonus “Boat Show only” prize draws conducted at the show. Each day at 5pm (Perth time) from Friday 8 October to Sunday 10 October 2010, a coupon will be selected to win the special “Boat Show only” bonus prizes as described in Clause 4.2. Winners will be notified by phone and letter.
5.5 The judges’ decision is final and the Promoters will not enter into correspondence regarding the result.
5.6 It is a condition of accepting the prize that the winners (and any companions) must comply with all the conditions of use of the prize and prize supplier’s requirements.
5.7 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoters in their absolute discretion.
5.6 The Promoters may in their absolute discretion deem entries invalid subsequently to the winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions, or does not otherwise comply with these terms and conditions.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters’ ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoters may in their absolute discretion cancel the Competition and recommence it from the start on the same conditions.
6.2 Seven Network (Operations) Limited, Golden West Network, West Australian Newspapers Limited, Perth FM Radio Pty Ltd, Club Marine, Challenge Marine and Premiere Productions and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail or entry coupons.
6.3 Seven Network (Operations) Limited, Golden West Network, West Australian Newspapers Limited, Perth FM Radio Pty Ltd, Club Marine, Challenge Marine and Premiere Productions and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the judging;
a) whilst undertaking any travel won on or connected with their entry into the Competition; or
b) in the acceptance of or participation in any prize;
d) as a consequence of late, lost or misdirected mail;
e) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person.

f) in relation to submitted coupons that are not received by the Promoters; or
g) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this Competition.
h) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this Competition.
6.4 The Promoters reserve the right to reasonably amend or vary these terms and conditions at their sole discretion, orally or in writing, for the purpose of Seven’s, GWN’s or Mix 94.5’s programming, scheduling or production requirements.

7.2 The sponsors are Club Marine Limited (ABN 12 007 588 347) of Mews Road, Fremantle WA 6160 and Australian Nautical Consolidated Pty Ltd trading as Challenge Marine (ABN 24 142 013 474) of 78 Reserve Drive, Mandurah WA 6210.
7.3 Perth FM Radio Pty Ltd (ABN 077 569 110) is collecting the entrant's personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying winners).
7.4 Entrant’s who opt-in to receive information in the future agree to have their information collected for the purpose of market research and agree to be contacted and receive marketing materials from Premiere Productions. All coupons/entries whereby the tick box is not ticked will be destroyed.
By ticking the box entrants agree to give Premiere Productions permission to keep their personal details on record for the use of a database and for market research.
