OPTUS Movie Rewards “Monthly DVD Draw” PROMOTIONTERMS AND CONDITIONS
Information on how to enter and prizes form part of these Terms and Conditions. Entry into this promotion is deemed acceptance of these Terms and Conditions by each Entrant (defined below).
Entry is limited to Australian residents who are current Optus Consumer Residential Customers and selected Small Business Customers who are current members or who register to become a member of Optus Movie Rewards (“Entrants”). Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
Promotion commences at 12:01am (AEST) on 01/09/2010 and closes at 11:59pm (AEDST) on 31/01/2011 (“Promotional Period”).
To enter, Entrants must, during the Promotional Period visit
www.optusrewards.com.au, register their details as requested or (in the case of Entrants who are already registered members of Optus Movie Rewards) login to the member’s page and click on the “Monthly DVD Promotion” link. The promotional page will then be displayed and Entrants will be required to enter their details.
The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable entries will be deemed invalid.
Entrants must be a current Optus Consumer Residential Customers or a selected Small Business Customer at the time of the draw to be eligible to win.Only one (1) entry permitted person.If there is a dispute as to the identity of an Entrant, the Entrant will be deemed to be the person in whose name the relevant Optus or Optus Movie Rewards account is held.
Entries are deemed to be received at the time of receipt into the promotional database and NOT at the time of transmission by the Entrant.
There will be one (1) draw for each month, five (5) draws in total. Entries close for each draw at 11:59pm AEST/AEDST (as applicable) on the following dates: 30/09/2010, 31/10/2010, 30/11/2010, 31/12/2010 and 31/01/2011. Non winning entries in each draw will NOT be entered into any subsequent draws.
All draws will take place at Optus, 1 Lyonpark Road, Macquarie Park, NSW 2113 on the below dates. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible Entrant is drawn. Winners will be notified by mail and winners’ names (of prizes over $250) will be published in The Australian on the corresponding dates below. The Promoter’s decision is final and no correspondence will be entered into.

The first valid entry drawn in each corresponding monthly draw will win $5,000 to be awarded in the form of a cheque made out to the winner. The next sixty (60) valid entries drawn in each corresponding monthly draw will each win a copy of the DVD being promoted that month. DVD prizes valued at $30.
Total prize pool is valued at $34,000. Prizes are not transferable or exchangeable.
A draw for any unclaimed prizes may take place on 08/05/2011 at 3pm AEST at the same place as the original draw, subject to any directions from a regulatory authority. Winners’ names (for prizes over $250), if any, will be published in The Australian on 15/05/2011.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the Entrant.
