1. Information on how to enter, how to claim and details of prizes for this competition (the Promotion) form part of these Terms and Conditions. Participation in this Promotion constitutes acceptance of these Terms and Conditions.
2. Entry to the Promotion is open to all individuals currently residing in Australia aged 18 years and over who fulfill the following entry requirements. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated with this Promotion are ineligible. “Immediate families” means spouse, ex-spouse, de-facto spouse, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, natural or adopted child, and sibling or step-sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.

Only one entry is allowed per person. Any entrant found entering more than once will be disqualified. Incomplete entries are invalid.
7. The entries will be judged by marketing and advertising professionals on their creativity and potential to reach as many people as possible. The response that is most creative and will provide the greatest reach will be the winner. This is a game of skill and chance plays no part in determining the winner.
8. The winner will be notified in writing and by phone or email by [27 October 2010].
9. The Prize will be dispatched within 60 days of the winner being decided and the winner agreeing to accept the Prize. Delivery is only possible within Australia.
10. The Prize is not transferable or exchangeable and cannot be taken as cash.
11. If the Promoter is unable to provide a winner with the Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize.
12. At the Promoter’s request, the winner must participate in all promotional activity (such as publicity and photography) surrounding the winning of the Prize, free of charge.
13. The winner consents to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in promotional material or in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
14. The Promoter reserves the right to request the winner to provide proof of identity and residency at the nominated prize delivery address before the Prize is provided. Identification considered suitable for verification is at the discretion of the Promoter.
15. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant:
a. fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction;
b. tampers with or benefits from any tampering with the entry process or the operation of the Promotion;
c. submits an entry which in the Promoter's opinion is not in accordance with these Terms and Conditions; or
d. acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
16. The Promoter’s decision regarding the disqualification of any entry and the judge's determination of the Major Prize Winner is final on all matters and no correspondence will be entered into.
17. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries.
18. To the extent permitted by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for personal injury, loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (g) use of a prize.
19. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to the Prize.
20. As a condition of accepting the Prize, the winner may be required to sign any legal documentation in the form required by the Promoter and/or Prize supplier in their absolute discretion, including but not limited to a legal release and indemnity form.
21. Any cost associated with accessing the promotional website is the entrant’s responsibility.
22. If for any reason winner does not redeem the Prize or an element of the Prize within 3 months of notification that the winner has won the Prize, then the Prize or that element of the Prize will be forfeited. In the event that any prize has not been claimed by date at least 3 months after decision of the winner, the Promoter reserves the right to select another winner.
23. The Promoter accepts no responsibility for any tax implications that may arise from winning the Prize. Independent financial advice should be sought.
24. All entries and their contents will be the property of the Promoter. This includes all copyright in the entry, which is assigned upon submission of the entry to the Promoter.
25. The personal information you provide will be used by the Promoter for the purpose of conducting this Promotion and otherwise in accordance with the Promoter's Privacy Policy or any consent provided by you. The Promoter may disclose your personal information to third parties, to its contractors and agents to assist in conducting and communicating with entrants for this Promotion and otherwise in accordance with the Promoter's Privacy Policy or any consent provided by you.
26. You consent to the Promoter, for an indefinite period, unless otherwise advised, being permitted to use and disclose to third parties, to its contractors and agents any personal information provided by you in connection with this competition (including entries) for promotional, marketing, publicity, research and profiling purposes, including sending commercial electronic messages to you or telephoning you about the products that SOUP promotes.
27. Entrants should direct any request to access, update or correct information to the Promoter.
