Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Promotion commences on 12/10/10 and closes 11:59pm AEDST on 16/11/10 (“Promotional Period”).
To enter Individuals must, during the Promotional Period either:

(b) If they received the promotional, email, click on the link provided, follow the prompts to the competition entry page, input the requested details including first name, surname, age range, address including suburb, state and postcode and submit the fully completed entry form.
Incomplete or illegible entries will be deemed invalid.
Only one (1) entry permitted per person.
The draw will take place at Anisimoff Legal, Suite 1, Level 1, 34 Chandos Street St Leonards NSW 2065 on 30/11/10 at 10:00am AEDST. Winner will be notified by phone and email and the winner’s name will be published in The Australian on 07/12/10. The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn will win the prize which is a P&O Food and Wine Cruise for two (2) adults departing on 29/04/11, Sydney NSW valued at up to AUD$2,798 (“Prize”). Prize includes three (3) nights on board Pacific Jewel in an outside twin cabin (category DD), all main meals (with the exception of those restaurants which have a cover charge) and a seven (7) course degustation for one (1) night. If the winner is a NSW resident the winner will be responsible for all travel costs associated with travel to and from the departure point in Sydney NSW. If the winner is a resident of any State/Territory in Australia other than NSW the winner will also receive return economy class airfares for two (2) adults from their nearest Australian capital city to Sydney, NSW.
Any Alcohol including wine or beer tasting will not be included as part of the prize. Cheese tasting will not be included as part of the prize. Spending money, additional meals, taxes, insurance, passports, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Frequent flyer points will not form part of the Prize.
Standard terms and conditions of travelling on P&O Cruises Pacific Jewel cruises will apply. Winner’s (and their companions) travel will be subject to the booking and passage conditions of the relevant brochure which must be signed by the winner and their companion(s).
A credit card imprint or cash deposit will be required from the winner at check-in in order to board Pacific Jewel, for all incidental charges.
It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller(s).
The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to $2,798.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
A draw for the prize, if unclaimed, may take place on 02/03/11 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner will be notified in writing and the winner’s name will be published in The Australian on 16/03/11.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
As a condition of accepting a Prize, the winner (and any companion/s) must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
