TERMS AND CONDITIONS
PARTICIPATION
1. This competition ("Competition") is conducted by Metro Transport Pty Ltd, ABN 57 082 564 510 of 190 Pyrmont Street, Pyrmont, Sydney NSW 2009 ("Promoter").
2. Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
3. The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 18 years or older as at time of entry; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
4. Notwithstanding any other provision of these conditions, a person "Person" is not entitled to enter this Competition if:
a. the Promoter has formed the opinion that the Person has breached the conditions of entry of a previous contest run by the Promoter; and
b. the Person has been given written notice by the Promoter stating that, as a result of such opinion of the Promoter, the Person is prohibited from entering competitions conducted by the Promoter (and the prohibition stated in that notice has not been lifted by a subsequent notice to the Person from the Promoter).
5. Competition entry opens at 07:00 hrs on 1/8/10 and closes at 24:00 hrs on 31/10/10 "Entry Period". All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date. All times are stated using the 24 hour clock. 00:00 hrs is the start of a day and 24:00 hrs is the end of a day.
ENTRY
6. To enter, an Eligible Entrant must purchase, from any Monorail Station in Sydney, an appropriate fare and complete competition questions on the form provided at time of purchase. 7. Subject to the other conditions, an Eligible Entrant may enter the Competition more than once subject to ticket purchase. 8. Entry can only be made via the internet. To submit an entry, an Eligible Entrant must use a compatible browser to visit
www.monorail.com.au/treasurehunt "Competition Website"). The Eligible Entrant must then follow the directions at the Competition Website. The Eligible Entrant will be required to provide an e-mail address, first and last names, postcode, age bracket and a mobile or landline phone number. In order to submit an entry, the entrant must use a compatible browser to visit the Competition Website and, in accordance with the directions at the website, provide for each entry:
(a) the information listed above; and
(b) the 15 answers to the questions listed on the form provided at the time of ticket purchase. All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any telecommunications service or equipment.
9. For each and every ticket purchase an entrant uses to submit an entry, he/she MUST retain the ticket stub or receipt as proof of purchase. 10. All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition.
a. An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the ticket stubs/receipts which condition 9 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
b. An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
11. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's satisfaction; or (ii) fails to produce items as required by condition 9 or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's opinion, submits an entry which is not in accordance with these conditions.
12. An entry by more than one person (ie a joint entry) is invalid.
13. On any one day an Eligible Entrant may submit no more than 5 entries.
14. Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
15. Eligible Entrants must make their entries manually using an internet browser. The Promoter may reject entries if it reasonably forms the opinion that they have been entered using automated entry means, by use of a competition entry service.
PRIZES
16. There will be 1 prize draw
17. Each entry received will be allocated to the Draw. The Eligible Entrant who submitted the first valid entry drawn will win a family trip to the value of $5,000 through authorised travel agency, Escape Travel.
18. The Draw will be held at 190 Pyrmont St, Pyrmont NSW 2009. The Draw will commence at 11:00 hrs on 15/11/10.
19. The maximum total value of the prize is $5,000.
20. The prize is valued as at 11/07/10. The Promoter takes no responsibility for any variations in value of a prize.
21. If the prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if the prize is unavailable for any reason.
22. A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment.
The Prize
23. The family holiday is valid for 12 months from 15/11/2010 and is non-transferable and cannot be redeemed for cash. 1 x holiday for 2 Ad/2Ch (children 11yrs and under) to the total value of $5,000.
24. The Travel Prize must be arranged by Escape Travel. The winner must give at least 60 days notice of proposed commencement of travel. All travel must be completed no later than 15/11/11. The Prize is subject to availability at the time of booking and, if any component of the travel is unavailable on the dates proposed by the winner, the Promoter will consult with the winner to determine alternative dates on which travel will be booked. All aspects of the Travel Prize (including travel and accommodation) are for two adults and two children travelling together.
25. Once tickets have been arranged by the Promoter, changes to the travel or accommodation arrangements are at the expense of the Travel Prize winner. If such changes are made, the winner may incur a change fee per passenger plus all additional costs resulting from any change.
26. All components of the Travel Prize must be taken together as a single trip to be booked by Escape Travel. Any part of the Prize that is not taken for any reason is forfeited.
27. The Prize does not (except as expressly stated) include: a. any transport between a traveller's residence and the departure airport;
b. any overnight accommodation while travelling to the departure airport;
c. any other travel or accommodation;
d. any meals;
e. any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages);
f. any spending money;
g. any insurance (such as travel or health cover);
h. any costs associated with any passport, visa, health or other requirements for entry into any foreign country and return to Australia;
i. any vaccinations or other medical or health related services;
j. any other ancillary costs which may be incurred by the winner or his/her familiy in relation to the holiday prize.
28. The Travel Prize cannot be exchanged for other travel or accommodation at other destinations.
29. The winner of a Travel Prize and his/her family are responsible for compliance with any health, passport, visa and other requirements for entry into their chosen destination, any country en-route and return to Australia and bear all risks associated with any refusal of entry into any country. No compensation will be payable if a winner or their family is unable to use the Travel Prize (or any part of it) as stated for whatever reason.
WINNER
30. . The winner will be notified in writing sent by e-mail to the e-mail address indicated in the entry. The notification may include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
31. The name of the winner in the Draw held on or before 15/11/10 will be published on the promoters website

32. Subject, where relevant, to any directions given under the legislation regulating the Competition, if any prize is not claimed by a winner within 3 months of the prize being awarded, the prize will be awarded to another Eligible Entrant in a redraw commencing at 3pm on 23/2/11 at 190 Pyrmont Road, NSW 2009. If there is a redraw, the name of the winner in the redraw of the Prize will be published on the promoters website
www.monorail.com.au 33. . In order to be entitled to the prize, the winner (and any person accompanying the winner on the Travel Prize) must, if requested by the Promoter, agree to and sign:
(i) a Statutory Declaration and/or an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize and/or participate in the prize; and
(ii) a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Competition.
GENERAL
34. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
35. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise).
36. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
37. All of the Promoters decisions are final and no correspondence will be entered into.
38. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
39. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties" exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant or any winner's family on the Travel Prize in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death.
40. The winner and their family of the Travel Prize consent to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
41. Entrants' personal information and that of any winner's family on the Travel Prize will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s) and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner and their family on the Travel Prize may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter or by visiting
www.monorail.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
