   1. Information on how to enter the Promotion and prizes form part of these Conditions of Entry.

   2. Entry into this Promotion is deemed to be acceptance of these Conditions of Entry.

   3. The Promotion is open to individuals who
         1. are residents of Australia aged 18 years and over; and
         2. are not employees (or immediate family of such employees) of the Promoter, or any of its related corporations or any of the agencies associated with the Promotion including Oxygen Marketing, The White Agency and Foxtel; and
         3. have not been discovered to have breached Conditions of Entry of previous contests run by the Promoter (“Entrants”).

      Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

   4. All Entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a prize to the ineligible person. Return of a prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.

   5. All prices stated are in Australian dollars, represent the recommended retail price (“RRP”) and include GST. All references to times and dates are to times and dates in Melbourne, which may be Australian Eastern Standard Time (AEST) or Australian Eastern Daylight Saving Time (AEDST) depending on the date. All times are stated using the 24-hour clock.

KEY DATES

   6. The promotion commences on 13/10/10 at 00:01.01 (AEDST) and concludes on 02/02/11 at 23:59.59 (AEDST) (“Promotion Period”). Final entries close on 02/02/11 at 23:59.59 (AEDST).

   7. Winners (up to the date of publication) of a prize valued over $250 will have their details (initial, surname and postcode) published in The Australian newspaper on 12/11/10, 10/12/10, 10/01/11 or 12/02/11.

   8. UNCLAIMED PRIZE DRAW: If a prize remains unclaimed or is forfeited for any reason the Promoter may conduct such further draws at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade, Cremorne VIC 3121 as are necessary at 10:00am on 12/05/11 in order to distribute any unclaimed prize by that date, subject to any written directions under relevant Lottery and Gaming Regulations. In the event of a winner(s) of a prize in the unclaimed prize draw, they will be notified by telephone and mail and their details (initial, surname and postcode) will be published in public notices section of The Australian Newspaper on 18/05/11.

HOW TO ENTER

   9. For the chance to win a prize instantly and automatically qualify for a free digital download from a select list (“free digital download”), an Entrant must purchase a specially stickered Warner Bros. Blu-ray or DVD from a participating outlet (“Physical Product”) OR purchase any of the following Warner Bros. movie titles from Foxtel Box Office; The Losers, A Nightmare on Elm Street, Jonah Hex, Superman Batman: Apocalypse or Lost Boys 3: The Thirst (“Digital Product”), during the Promotion Period (“Qualifying Purchase”) then:

         1. Physical Product only: Log on to www.warnerbros.com.au and click through to the promotion microsite to complete the online entry form in full, including the unique code (“Unique Code”) found under the sticker located on the Blu-ray or DVD pack, OR

         2. Digital Product only: Send an SMS to 199 901 99 (SMS cost is $0.55c) with their name and the keyword displayed on the television screen after the completion of their Foxtel Digital purchase. Entrants who successfully send an SMS will receive a reply message with their Unique Code. Entrants consent to receiving this message. SMS cost covers the entry (where 160 characters or less) and the reply message. Entrants must then log on to www.warnerbros.com.au and click through to the Promotion microsite to complete the online entry form in full, including the Unique Code.       ENTRY REQUIREMENTS & VERIFICATION

  10. Only one entry and free Digital Download per Unique Code will be permitted.

  11. All entries in the Promotion may be subject to verification by the Promoter, including:

         1. Entrants MUST retain their Unique Code and their purchase receipt(s) (evidencing their Qualifying Purchase) for all entries submitted as proof of purchase (“proof of purchase”). Entrants may be required to, within 7 days of being asked to do so, send their proof of purchase to the Promoter in order to validate their entry(ies). A reply paid address will be provided to entrants. Entrants must also retain a photocopy of the proof of purchase submitted for verification purposes. The Promoter recommends that Entrants send their proof of purchase via registered post, however, this is not a Condition of Entry; and

         2. All Entrants MUST also deliver to the Promoter (by a means reasonably determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win the Promotion, including but not limited to evidence of age, residence or identity (“additional documentation”). The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an Entrant must deliver requested copies within 7 days of being asked to do so.          4. Is found to be using multiple aliases, household addresses or email addresses; or
         5. Acts in a disruptive manner; or
         6. Fails to establish their entitlement to enter the Promotion to the Promoter's reasonable satisfaction; or
         7. Fails to produce items as required or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or
         8. Acts in violation of these Conditions of Entry.

ENTRY DETAILS

  13. Multiple entries per person per day will be permitted provided each entry is validated with a separate unique code and proof of purchase.

  14. Entrants can only enter in their own name.

  15. Entries are deemed to be received at the time of receipt in the Promotion database and NOT the time of transmission by the Entrant.

  16. Incomplete, illegible or incorrect entries, entries which are not in the required format or which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win a prize.

  17. A reply message will appear online for Entrants to let them know if they have submitted a valid entry. If an Entrant sends an entry with an incorrect Unique Code(s), a message will appear online to let them know that the Unique Code(s) is/are not recognised by the database. The Entrant will be asked to check the Unique Code(s) and to resubmit their entry.

  18. Digital Product only: Entrants who request a Unique Code by SMS will be notified immediately after their valid SMS has been successfully received. If an SMS request is not successful because it does not include a valid Keyword, the Entrant will be prompted to submit their entry again. If the Entrant elects to resubmit their SMS the entrant will be charged an additional $0.55 cents (including GST), covering the entry (160 characters or less) and the reply message. SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. Entrants must have premium SMS enabled with their telecommunications provider. Entrants must have the mobile phone bill payer’s permission to enter the Promotion or their entry will be invalid.

  19. Response times may vary and are subject to network coverage and availability, the number of entries received by the Promoter and any other technical problems.

PRIZE CONDITIONS

  23. All Instant Win prizes will be awarded in the form of a Bank Cheque made payable to the prize winner.

  24. Prizes must be taken as stated and are not transferable.

  25. Prizes will be delivered to the residential address as identified by the prize winners within 28 days.

  26. The Promoter is neither responsible nor liable for any change in a value of the free Digital Downloads occurring between the date of printing Promotion materials and the date the free Digital Downloads are claimed.

  27. If a prize is no longer capable of being redeemed, the prize winners will receive a prize, as determined by the Promoter, of equivalent value (as if the original prize had been awarded to that person, less any administrative expenses incurred by the Promoter), subject to the approval of the relevant Regulatory Gaming Authorities.

  28. The Promoter and the agencies and companies associated with this Promotion take no responsibility for prizes damaged in transit, or for any delay in delivery of prizes or for the prizes becoming lost or stolen after it has been collected by and released to the prize winner(s).

PRIZE WINNERS

  29. A prize will only be awarded where the prize winner’s proof of purchase and, if applicable, additional documentation fulfils all of the requirements of the Promoter’s verification tests and procedures. Verification tests and procedures are determined by the Promoter at its absolute discretion.

  30. If an Instant Win Prize winner selected is deemed not to comply with the Conditions of Entry of this Promotion, their entry will be declared invalid and a new prizewinner will be determined in the Unclaimed Prize Draw.

  31. To the full extent permitted by law, the Promoter and its associated companies and agencies including FOXTEL Management Pty Ltd (the “Relevant Parties”) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Entrant and/or prize winner in connection with the Promotion or prizes, including:

   1. any indirect, economic or consequential loss or loss of profits;
   2. any loss arising from the negligence of the Promoter, its associated companies and agencies;
   3. any liability for personal injury or death.

  32. The prize winners must, at the Promoter’s request, participate in all reasonable promotional activity (such as publicity and being interviewed and photographed) surrounding the winning of a prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

  33. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought by each winner.

GENERAL

  34. There will be a total of 2.5 million Unique Codes generated for the purpose of this Promotion.

  35. The free Digital Download offer does not extend any rights of ownership of the participating episodes to any prize winner. Warner Bros Entertainment Australia Pty Ltd are not liable for errors incurred during download of the free Digital Download.

  36. Incomprehensible, incomplete and illegible entries will be deemed invalid.

  37. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.

  38. Should an Entrant’s contact details change during the Promotional Period, it is the Entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

  39. It is a condition of accepting the free Digital Download that the recipient must comply with all of the Suppliers Terms and Conditions. Conditions of the Suppliers Terms and Conditions are available on the Suppliers websites. Please ensure we list these on the promotional microsite.

  40. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these Conditions of Entry, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

  41. The Promoter and FOXTEL Management Pty Ltd is not responsible for any incorrect or inaccurate information, either submitted or caused by an entrant or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the conduct or administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of claims, and reserves the right to take any action that may be available.

  42. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

  43. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the reasonable control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion , subject to any written direction given under State Regulation.

  44. Confirmation of printing errors and other quality control matters will not be used as a reason for refusing payment of a prize. Promotional materials are void if stolen, forged, mutilated or tampered with in any way.

  45. The Promoter assumes no responsibility for:

         1. any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; or

ENTRY DETAILS

PRIZE CONDITIONS

         1. are residents of Australia aged 18 years and over; and

KEY DATES

UNCLAIMED PRIZE DRAW: If a prize remains unclaimed or is forfeited for any reason the Promoter may conduct such further draws at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade, Cremorne VIC 3121 as are necessary at 10:00am on 12/05/11 in order to distribute any unclaimed prize by that date, subject to any written directions under relevant Lottery and Gaming Regulations. ENTRY DETAILS

PRIZE CONDITIONS
