The promoter of the Just Car win $20,000 competition ("Competition") is Just Car Insurance Agency Pty Ltd (ABN 41 050 238 563) of Level 9, 616 St Kilda Road, Melbourne VIC 3004 ("Promoter"). Telephone: 13 13 26 during business hours.
Information on how to enter and the prize form part of these Terms and Conditions. Participation in this Competition is deemed acceptance of these Terms and Conditions.

The period of this Competition begins at 12:00:00am (AEST) on 17 October 2010 and end at 11:59:59pm (AEST) on 12 December 2010 ("Competition Period"). This means that Entries by way of Eligible Quote, Eligible Purchase (when that purchase is made online or by phone from the Promoter) and Eligible Request must be received by the Promoter by no later than 11:59:59pm (AEST) on 12 December 2010, while entries by way of Eligible Policy Purchase when that purchase is paid for by cheque or money order sent through the post will need to be posted no later than 30 November 2010 to ensure they arrive and are processed by the Promoter on time - see also clause 7(b).

Employees (and their Immediate Family Members) of the Promoter, or any related body corporate of the Promoter, as well as any agency associated with this Promotion are ineligible to enter. Immediate Family Members means any of the following: spouse, ex-spouse, de-facto, ex-de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

Subject to clause 4, entry is only open to any Australian resident aged 16 years and over who agrees to participate in the Competition and successfully:
obtains an eligible insurance quotation from the Promoter ("Eligible Quote"); or
purchases an eligible insurance policy from the Promoter ("Eligible Policy Purchase"); or
submits an sales information request on the Promoter’s website ("Eligible Request") within the Competition Period and under the additional terms explained in these Terms and Conditions; or
refers a friend in the manner explained in clause 12 and that friend then completes at least one of the other entry requirements explained in these Terms and Conditions ("Successful Friend Referral").


A successful entrant is referred to in these Terms and Conditions as an Entrant. All insurance quotations and policies provided by the Promoter are additionally subject to the Promoter's normal insurance acceptance criteria. The Entrant should first read and consider the relevant Product Disclosure Statement ("PDS") for the insurance product they are interested in, to ensure that it suits their individual needs. The Promoter’s PDSs can be viewed at its website: justcarinsurance.com.au or Entrants can call 13 13 26 and request a free copy to be posted to them.

To enter the Competition an Entrant must successfully obtain an Eligible Quote, make an Eligible Policy Purchase, submit an Eligible Request or effect a Successful Friend Referral during the Competition Period with respect to one of the following insurance products offered by the Promoter:
Comprehensive Car Insurance Policy; or
Third Party Property Damage Insurance Policy (whether extended to include fire and theft cover or not).


In the case of an Eligible Quote or Eligible Request, the first insurance product quoted or request made will enter the Entrant into the Competition.

Subject to sub-clauses 7(a) and 7(b), an Eligible Policy Purchase means a successful and complete purchase of a new insurance policy from the Promoter within the Competition Period, demonstrated by the Promoter receiving the full policy premium by no later then 11:59:59pm (AEST) on 12 December 2010.

An Eligible Policy Purchase does NOT include the:
renewal of an existing policy already held with the Promoter;
inception of interim insurance cover of any type (whether referred to as a ‘cover note’, ‘pay by account’ or similar); or
purchase of an insurance cover that was quoted by the Promoter before the Competition Period UNLESS that insurance cover is paid for online at the Promoter’s website or over the phone using an accepted credit/payment card by speaking to a staff member of the Promoter (call 13 13 26).

If an Entrant sends their premium payment by post (for example a cheque or money order), in order to guarantee that payment is received and processed on time, such that the Promoter includes the Entrant’s two entries into the prize draw, the Entrant needs to ensure that they post their payment to the Promoter no later than Tuesday 30 November 2010 (in that evening’s mail). The Promoter will not be liable for any loss caused by or arising from the delayed posting of a premium payment.

An Eligible Quote obtained online at the Promoter’s website (justcarinsurance.com.au) will only provide the Entrant with a valid entry into the Competition when the quote recipient agrees to enter the Competition AND provides an electronic instruction to the Promoter for the quotation to be emailed to their designated email address.

An Eligible Quote or an Eligible Policy Purchase can be made during the Competition Period either online on the Promoter’s website (justcarinsurance.com.au) or by calling the Promoter’s sales centre on 13 13 26 during its trading hours. An Eligible Quote can be obtained online and insurance cover based on that Eligible Quote can later be purchased online or through another payment channel offered by the Promoter - please see clause 7(b) for important information about paying earlier by post.

An Entrant will receive the following number of entries into the Competition, depending on their manner of entry:
one entry for obtaining their first Eligible Quote.
two entries for completing an Eligible Policy Purchase.
one entry for submitting their first Eligible Request.
one entry for each Successful Friend Referral.
For example, if an Entrant obtains an Eligible Quote, then makes an Eligible Policy Purchase and then makes two Successful Friend Referrals, that Entrant will receive a total of five entries into the Competition.

A maximum of one Eligible Quote OR one Eligible Request applies per Entrant. Additional quotes obtained or sales requests submitted by an Entrant during the Competition Period will not be awarded entries into this Competition.

Successful Friend Referral operates only on the basis of an electronic friend referral communication, which the Promoter will offer to:
its existing customers whose email addresses it holds and is permitted by law to offer the Competition to; and
Entrants who have agreed to take part in this Competition.

A Successful Friend Referral will be offered by the Promoter to the above persons via an email sent by the Promoter or by a website page presented to them upon completing an online quote. The above persons can then extend the offer to their friends via email or a social media network. A Successful Friend Referral only operates on the basis that its recipient accesses the Promoter’s website directly from the electronic communication they have received and completes the required transaction within the same unbroken internet session.

An Entrant either obtaining an Eligible Quote online or making an Eligible Policy Purchase online must provide the Promoter with their relevant insurance details, together with their first name, surname, email address, mobile telephone number AND consent to receive marketing communications from the Promoter (this consent can be freely withdrawn after the Competition Period - see clause 31). In the case of an Entrant entering the Competition by telephoning the Promoter’s sales centre (on 13 13 26) to obtain an Eligible Quote or make an Eligible Policy Purchase the same information and consent will be collected as well as the Entrant’s date of birth and residential address. An Entrant who submits an Eligible Request must provide the Promoter with their first name, surname, email address, mobile telephone number, the expiry date of their current car insurance AND consent to receive marketing communications from the Promoter (this consent can be freely withdrawn after the Competition Period - see clause 31).

In addition to the specific conditions explained in clause 7, the Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment. Entries into the Competition, whether by Eligible Quote or making an Eligible Policy Purchase will be deemed accepted at the time of receipt by the Promoter (including the receipt of any policy premium) and not at the time of submission by the Entrant.

The Promoter may, at its absolute discretion, declare any or all entries made by an Entrant invalid if the Entrant tampers with the entry process, benefits from such tampering or submits an entry that is illegible, incomplete or not in accordance with these Terms and Conditions.

An entry by way of Eligible Quote must be submitted by an Entrant manually, meaning not by any automated process. The Promoter reserves the right to reject online entries if it reasonably forms the opinion that they have been submitted using automated entry means or by use of a competition entry service.

The Promoter reserves the right, at any time, to verify the validity of entries and each Entrant (including each Entrant’s identity, age and place of residence) and to disqualify any Entrant who has breached the entry criteria explained in these Terms and Conditions and/or to conduct a re-draw of the prize. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Calling the Promoter on 13 13 26 costs the equivalent of a local untimed call from a landline. Calls from mobile or pay phones are likely to cost extra.

This is not a game of skill. The single prize winner will be selected by the Promoter at random.

The prize draw will take place at level 22, 385 Bourke Street, Melbourne, Victoria on 17 December 2010 at 12:00 noon (AEST).

The winner will be notified by telephone and in writing (mail or email) and their full name and suburb/town will be published in The Australian newspaper on 23 December 2010.

The Promoter’s decision is final and no correspondence will be entered into.

The first valid entry drawn will win $20,000 (Australian dollars) which will be awarded in the from of a bank cheque issued in the name of the winner (or in the name of joint account holders, including the winner, at the written and signed request of the winner) within 28 days of being notified they have won. The cheque will be posted to the winner by registered mail, at the Promoter’s cost.

The total prize value is $20,000 Australian dollars.

Subject to clause 23, the prize is not transferable or exchangeable and cannot be taken in any other form.
Subject to the unclaimed prize draw clause 27, if for any reason the winner does not take possession of their prize by the time stipulated by the Promoter, then the prize will be forfeited.

If a prize is still unclaimed after three calendar months of the original prize draw, the Promoter will conduct a further draw for the prize on 18 March 2011 at the same time of day and place as the original draw. The winner of this draw will be notified in writing and the winner’s name will be published in The Australian newspaper on 23 March 2011.

The winner consents to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording) in any media for an unlimited period without remuneration for the purpose of promoting this Competition or any of its products or services.

If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any website congestion or technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any use of a personal computer including downloading, uploading or transmitting materials related to this Competition; (c) any theft, unauthorised access or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or entrant; (f) use of the prize; or (g) in any way related to travel arising from the redeemed prize.

Privacy Statement. The Entrant agrees that they must provide and/or maintain their consent to receive marketing communications from the Promoter for the duration of the Competition Period. This is required to ensure that Competition entries are properly recorded, processed and the winner can be drawn. By entering this Competition, the Entrant understands and agrees that the Promoter collects their personal information in order to conduct the Competition as well as obtain information about the Entrant’s insurance needs. The Entrant also understands and agrees that the primary purpose of collecting information about the Entrant’s insurance needs is to enable the Promoter to contact the Entrant at a later date (by any permitted means including telephone, mail or SMS) to market its products and services. If the information requested is not provided the Entrant will not be eligible to participate in the Competition. By entering this Competition, the entrant understands and agrees that the Promoter may disclose the information provided by them to any state or territory gaming regulator (if necessary), as well as use their information for further promotional, marketing and publicity purposes. Subject to the required marketing consent during the Competition Period, an Entrant’s personal information is otherwise collected, used and disclosed in accordance with the Promoter’s privacy policy, which is available at justcarinsurance.com.au or by calling 13 13 26. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any website congestion or technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any use of a personal computer including downloading, uploading or transmitting materials related to this Competition; (c) any theft, unauthorised access or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or entrant; (f) use of the prize; or (g) in any way related to travel arising from the redeemed prize.
  32. Privacy Statement. The Entrant agrees that they must provide and/or maintain their consent to receive marketing communications from the Promoter for the duration of the Competition Period. This is required to ensure that Competition entries are properly recorded, processed and the winner can be drawn. By entering this Competition, the Entrant understands and agrees that the Promoter collects their personal information in order to conduct the Competition as well as obtain information about the Entrant’s insurance needs. The Entrant also understands and agrees that the primary purpose of collecting information about the Entrant’s insurance needs is to enable the Promoter to contact the Entrant at a later date (by any permitted means including telephone, mail or SMS) to market its products and services. If the information requested is not provided the Entrant will not be eligible to participate in the Competition. By entering this Competition, the entrant understands and agrees that the Promoter may disclose the information provided by them to any state or territory gaming regulator (if necessary), as well as use their information for further promotional, marketing and publicity purposes. Subject to the required marketing consent during the Competition Period, an Entrant’s personal information is otherwise collected, used and disclosed in accordance with the Promoter’s privacy policy, which is available at justcarinsurance.com.au or by calling 13 13 26. If the Entrant would like to access or correct the personal information that the Promoter holds about them, or if the Entrant wishes to opt out of receiving the Promoter’s marketing communications after the end of the Competition Period, the Entrant should inform the Promoter by calling 13 13 26 or sending an email to contactus@justcarinsurance.com.au
