CONDITIONS
PARTICIPATION
1. This competition (“Competition”) is conducted by Estee Lauder Pty Ltd, ABN 63 008 444 719, of 21 Rosebery Avenue Rosebery NSW 2018 (“Promoter”).
2. The Competition is a game of skill in which chance plays no part.
3. Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
4. The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who at the time of entry: (i) is a resident of Australia; (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iv) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
5. Competition entry opens at 9am on 11/8/10 and closes at 5pm on 30/8/10 ("Entry Period"). All times and dates are times and dates in Sydney.
ENTRY
6. Subject to the other conditions, an Eligible Entrant may enter the Competition no more than once.
7. To submit an entry, an Eligible Entrant must use a compatible browser to visit
www.esteelauder.com.au ("Competition Website") and follow the directions there to provide: (i) a statement, in no more than 25 words, that tells us which key fashion pieces you would buy to complete your new Pure Color look (the "Statement"); and (ii) all other details required at the Competition Website, including the entrant’s first and last names, postal address and e-mail address.
8. Each entrant's Statement must:
(i) be original and must have been written by the entrant;
(ii) not be offensive or be likely to cause offence to other persons;
(iii) be free of any claims, including copyright claims, by other parties; and
(iv) not have been published previously or have won a prize or award in any other competition.
9. By entering this Competition, each entrant:
(i) authorises the Promoter, its related bodies corporate and their agencies, without any restriction or royalty, to: (i) use the entrant's Statement (including in an edited form) in material promoting the Promoter's products and/or those of its related bodies corporate; (ii) publish the Statement on the "Competition Website"; and (iii) contact the entrant regarding their entry
(ii) warrants that he/she is entitled to authorise the Promoter to use the Statement as permitted by these conditions;
(iii) warrants that the Promoter's use of the Statement as permitted by these conditions will not infringe any rights (including without limitation any rights in copyright and any rights in respect of reputation) of any person; and
(iv) indemnifies the Promoter and all its related bodies corporate, contractors and personnel ("Indemnified Persons") from and against all losses, damage, claims (on any and all grounds), costs or expenses (including reasonable legal fees) that any of them may suffer as a result of any breach of conditions 9(i), 9(ii) or 9(iii).
10. All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any postal services.
11. All entries to the Competition may be subject to verification by the Promoter. An entrant MUST deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of their age, identity and place of residence. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
12. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's satisfaction; or (ii) fails to produce items as required by condition 11 or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's opinion, submits an entry which is not in accordance with these conditions.
JUDGING AND PRIZES
13. No later than 10/9/10, the Promoter will judge the Statement in the entries received. The criterion by which the Promoter will judge the Statement (“Criterion”) is creativity (the more creative the Statement the better).
14. The Eligible Entrant who submitted the valid entry that is judged to have included the best Statement, according to the Criterion, will win: (i) a
www.closetprincess.com voucher to the value of $1,000. The voucher will be provided in the form of an offer code to be used at checkout on closetprincess.com, is valid for use on all items on the site (for whole or partial payment depending up the items to be purchased) and can be used to cover shipping costs. Voucher will be valid for 12 months from 30/08/2010; and (ii) $500 worth of Estee Lauder products of the Promoter's choosing.
15. The Eligible Entrants who submitted the 10 valid entries that are judged to have included the next ten best Statements, according to the Criterion, will each win $500 worth of Estee Lauder products of the Promoter’s choosing.
16. If a prize (or part of a prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of a prize) is unavailable for any reason.
17. A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment.
WINNERS
18. In order to be entitled to any prize, each winner must, if requested by the Promoter, agree to and sign an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize.
GENERAL
19. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition.
20. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
21. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
22. All of the Promoter’s decisions are final and no correspondence will be entered into.
23. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
24. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death.
25. Each winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
26. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s). The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
