Conditions of entry for the Weekly Times Now ATV Giveaway
1. Information on how to enter and the prizes form part of these conditions of entry. Entry into the competition is deemed acceptance of the Terms and Conditions.
2. Entry is open only to residents of Australia over the age of 18 years.
3. The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City Road Southbank, Victoria 3006.
4. Promotion commences 12:01am (AEDST), Wednesday October 20, 2010 and closes 11.59pm (AEDST), Tuesday November 16, 2010. The winner will be drawn at 10am Wednesday November 17, 2010 at Salmat Interactive Pty Ltd, Level 17 Innovation Place, 100 Arthur St, North Sydney NSW 2060. The winner will be notified by writing and phone within 2 days of the draw. The prize winner will be published in the Public Notices section of The Weekly Times on Wednesday November 24, 2010. The judges’ decision is final and no correspondence will be entered into.
5. If the prize is unclaimed, a second draw will be held at 3:00pm (AEDST) on Thursday February 17, 2011 at Salmat Interactive Pty Ltd, Level 17 Innovation Place, 100 Arthur St, North Sydney NSW 2060 subject to any written directions given by the relevant state permit regulatory authorities. The winner will be notified in writing and by phone and their name will be published in the Public Notices section of The Weekly Times on Wednesday February 23, 2011.

7. Entries without the required information will be deemed incomplete and will not count towards an entry into the Promotion.

9. The major prize is valued up to $15,990. The major prize is a Kymco UXV 500.

Prize value correct at time of printing including dealer delivery charges which may vary from dealer to dealer, stamp duty which varies from state to state, registration and compulsory third party insurance costs. Prize will be delivered within 28 days of the draw date (as per VIC permit requirement). Additional insurance, additional options, petrol and all other ancillary costs are the responsibility of the winner. The Promoter takes no responsibility for any mechanical, body or paint repairs from the date and time of collection of the prize. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the ATV is awarded. If the winner fails to return the required documentation within 3 months of the closing date they will forfeit their prize and the prize will be entered into the unclaimed prize draw.
10. There is one major prize and the total prize pool is valued up to $15,990 at the time of printing.
11. The Promoter accepts no responsibility for any variation in the value of the prizes. All prize values are in Australian dollars.
12. The prize is not transferable or redeemable for cash or kind.
13. Winners must take the prize as offered.
14. The Promoter reserves the right to substitute the prize with a prize of equal or greater value if the prize is for some reason unavailable subject to gaming authority approval.
15. Unless otherwise specified, all ancillary costs are the winner’s responsibility.
16. Any change in the value of the prize between the publishing date and the date prizes are claimed is not the responsibility of the promoter/s.
17. The promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
18. The promoter is not responsible for lost, late, incomprehensible or incorrect entries in the competition. We also accept no responsibility for any tax implications that may arise from prize winnings in the competition. Entrants should seek Independent financial advice about such matters.
19. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, the promoter is entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments).
20. If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the promoters control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the promoter is entitled in their sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by the various Lotteries Departments), to cancel, terminate, modify or suspend the competition.
21. The winners release the Promoter from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the winner as a result of any loss or damage to any physical property of the winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoters or the prize.
22. In the event of a promoter other than The Herald and Weekly Times Pty Ltd cancelling any event related to this prize, The Herald and Weekly Times Pty Ltd cannot be held responsible.
23. All entries become the property of the Promoter. All entries will be entered into a database and the Promoter may use the entrants’ names and addresses for future promotional, marketing and publicity purposes.
24. The winner agrees to participate in any news media activities surrounding the promotion.
25. HWT collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. HWT may share entrants’ information with persons or entities assisting in the conduct of the promotion and with companies who are prize partners. HWT for publicity purposes may use the name and if applicable, image of the winners and persons accompanying the winners.
