Conditions
1.Information on how to enter and prizes form part of these Conditions of Entry. Participation in this promotion is deemed to be acceptance of these Conditions of Entry.
2.Entry is open only to Australian residents aged 18 years and over. Employees and officers (and their immediate families) of the Promoter, its associated companies, participating retailers, advertising agencies and other agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.Promotion commences 1st October 2010 and Qualifying Purchases must be made before close of business on 29th January 2011 (Promotional Period).
4.To be eligible to enter, an entrant must purchase one (1) pack of GladŽ Tuff StuffŽ with Forceflex⢠Garbage Bags during the Promotional Period at a participating store. (Qualifying Purchase).
5.To enter, an entrant must then:
(i) visit www.glad.com.au, follow the prompts to the promotion entry page, complete the online entry form including phone number, input the requested details for the relevant Qualifying Purchase (including the last four (4) digits from the barcode of the Participating GladÂŽ Product purchased and the last four (4) digits of the receipt number);
(ii) answer in twenty five (25) words or less âwhy GladÂŽ Tuff StuffÂŽ with Forceflex⢠is your favourite garbage bagâ; and
(iii) submit the fully completed online entry form so that it is received by the Promoter before 11:59pm AEDST on 31st January 2011.
6.All entries become the property of the Promoter
7.Entrants will be required to retain their original receipt(s) for each entry submitted as proof of purchase. Failure to provide this to the Promoter upon request will, at the Promoterâs discretion, result in an invalid entry (and, at the Promoterâs discretion, in all of the entrantâs entries being invalid) and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period and prior to submission of the relevant entry online. 8.Multiple entries will be accepted but each entry must relate to a separate Qualifying Purchase. Each Participating GladÂŽ Product item may only be used in relation to one entry. Upon request, a photocopy of the receipt must be supplied for each entry submitted in order to claim a prize. 9.All entries are deemed to be received at the time of receipt into the Promoterâs database NOT the time of transmission by the entrant.
10.All valid entries will be reviewed by the judging panel. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually assessed on its merits by the judging panel, taking into consideration the quality and creativity of the 25 word submission.
11.Judging will take place on 7th February 2011 at the Promoterâs premises at 36 Gow St Padstow, NSW, 2211. The best 10 valid entries as determined by the judges will be notified by phone by 14th February 2011.
12.The judging panelâs decision is final and no correspondence will be entered into.
13.Each winner will receive one (1) of ten (10) GladÂŽ Prize packs including an autographed copy of Julie Goodwinâs cookbook âOur Family Tableâ, 6 x GladÂŽ Tuff Stuff with Forceflex⢠Garbage Bag 10 pack, 4 x GladÂŽ Wavetop TieÂŽ Large 30 pack, 7 x GladÂŽ Foil 20m, 4 x GladÂŽ Bake and Cooking Paper 18m, 5 x GladÂŽ SnaplockÂŽ Sandwich 30 pack and 4 x GladÂŽ Wrap 60m. Each GladÂŽ Prize pack is valued at RRP$165.28 (including GST). Winners should allow 28 days for delivery of their daily prize at the address provided on the entry form.
14.The total Prize Pool is valued at RRP $1652.80 (including GST). 15.No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed or misdirected entries. Incomplete, indecipherable or illegible entries will be deemed invalid.
16.Prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in the prize values. Where a prize is unavailable for any reason, the Promoter may substitute the prize (or an element of the prize) for a prize of equal or higher value and/or specifications, as determined by the Promoter.
17.The Promoter will not be liable for any damage in transit to prizes.
18.The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation technical malfunctions or failures.
19.The Promoter is not responsible for any technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, or any other technical failures, including any injury or damage to an entrantâs or any other person's computer related to or resulting from participation in or down-loading any materials in this promotion.
20.Entrants consent to the Promoter using the entrant's name, likeness, image, voice and entry submitted in the event they are a winner of a prize (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Entrants agree to participate and co-operate in any publicity activities connected with the promotion if they are a winner. This may include having photographs taken of a winner (and their prize) and having their name, picture and wining entry appear in advertising, marketing and publicity material within Australia at the Promoterâs sole discretion. Entrants acknowledge that they will not receive any compensation in this regard, and the Promoter will determine, in its absolute discretion, the content, format and style of any material to appear in such publications. It is a condition of accepting the prize that a winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
21.If for any reason this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to (i) cancel, postpone, terminate, suspend or amend the promotion; or (ii) disqualify any entrant, as appropriate.
22.The Promoter reserves the right at any time to verify the validity of entries and entrants (including an entrantâs identity, age and place of residence). The Promoter reserves the right in its sole discretion to disqualify any entrant who (i) the Promoter believes either has tampered with the entry process, has submitted an entry which is not in accordance with these Conditions of Entry, or has breached any of these Conditions of Entry or any instructions or directions on this web site; (ii) acts in a disruptive manner; or (iii) acts with the intent to annoy, abuse, threaten or harass any other person; or (iv) has engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoterâs legal rights to recover damages or other compensation from such an offender are reserved.
23.Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
24.Any costs associated with accessing the promotional website are the entrantâs responsibility and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website will deem the entry to be invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
25.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (i) any technical difficulties or equipment malfunction (whether or not under the Promoterâs control); (ii) any theft, unauthorised access or third party interference; (iii) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after it has been received by the Promoter) due to any reason beyond the reasonable control of the Promoter; (iv) any variation in prize value to that stated in these Conditions of Entry; (v) any tax liability incurred by a winner or entrant; (vi) force majeure; or (vii) use of a prize.
26.In the event of a prize not being accepted or claimed within 3 months of the judging, then that prize will be forfeited by the winner and the Promoter may, in its absolute discretion, award the prize to the next best entry as determined by the criteria outlined above.
27.The Promoter may require the winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoterâs absolute discretion. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
28.The Promoter, through its agent, The Marketing Zoo, is collecting personal information contained in the entry form for the purposes of conducting this Promotion, including, but not limited to, conducting the draw, publicising the details of the winners, notifying the winners, and as required, Australian regulatory authorities. Entry is conditional on providing this information. If the entrant has marked the âopt-inâ box on the entry form, the entrant consents to the storage of their personal information on the Promoterâs database and the Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, research, profiling and publicity purposes including sending electronic messages or telephoning the entrant.
