Smirnoff Nightlife Exchange Project In The Mix Promo
Terms and Conditions of Entry
1. The promotion is open to all residents of Australia aged 18 and over, except employees
of the Promoter and their families and the Promoter’s affiliate companies, agencies and
anyone professionally connected with the promotion.
2. No purchase necessary. Entries are submitted at www.inthemix.com.au. Entry forms
require entrants to fill out their personal details and answer the question “In 25 words or less
how would you celebrate nightlife in Brazil?” Competition entries open at 9am on the 25th
October 2010 and close at 9pm on the 10th November 2010.
The Judging of eligible entries will take place at 9am on 11th November 2010 at 5/113
Reservoir St. Surry Hills NSW 2010. A panel of experts will select the best entries from all
valid entries received.
Entries will be judged based on originality and the panel of experts will consist of music expert
Tim Hardaker who manages the music website inthemix.com.au and lifestyle journalist and
party promoter Tim Duggan. The overall best entry winner will win the Major Prize. The Major
Prize winner will be notified via phone and e-mail on the 11th November 2010. The Major
Winner’s name will be published on the Smirnoff Australia Facebook page at
www.facebook.com/SmirnoffAustralia on 12th November 2010. The next 50 best entries will
each receive a runners up prize. These 50 winners will be notified by phone and e-mail on the
day of judging and will also have their names published in the news feed on the Smirnoff
Australia Page on the Facebook platform at www.facebook.com/smirnoffaustralia.
3. There are 1 major prize and 50 runners up prizes to be won in total. The prizes consists
of:
Major Prize:
(i) 2 x return economy airfares from the winner’s nearest capital city to Sao Paulo,
Brazil;
(ii) 4 x nights of twin-share accommodation at a hotel of at least 3 stars in Sao
Paulo, Brazil
(iii) 2 x tickets to the Simrnoff Nightlife Exchange Project ‘Arrival Party’ in Sao Paulo,
Brazil on the 27th November.
(iv) $250 spending money.
Runners up Prize:
(i) 2 x tickets to the Smirnoff Nightlife Exchange Project ‘Arrival Party’ in Sydney on
the 27th November.
The total maximum Prize Pool value is $19, 200.
4. Where flights are included in a prize, transfers to and from the domestic airport, insurance
(such as travel or health cover), spending money, visas (if required), meals, drinks and
snacks from the hotel mini bar and any other hotel incidentals are not included. Only those
items listed in these terms and conditions are included in the prize.
The prize is nontransferable
and there is no cash alternative. If any prize (or part of any prize) is unavailable,
the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the
prize) with a prize to the equal value and/or specification, subject to any written directions
from a regulatory authority.
5. The Major Prize winner and the Major Prize winner’s guest chosen to participate in the
prize must be available to travel to Sao Paulo, Brazil in November 2010, on dates to be
specified to the winner by Promoter. The dates will not be flexible and are subject to black out
dates, booking and flight availability. The Promoter is not responsible for any delays or
cancellations of flights nor the malfunction of any ground services provided to the prize
winner.
6. The Major Prize winner and the Major Prize winner’s guest chosen to participate in the
prize are each responsible for ensuring they each have a valid passport, are eligible for their
chosen destination country’s visa waiver programme or are in possession of a valid visa for
their chosen destination country, as appropriate, and for ensuring they have travel insurance
and any vaccinations required.
7. All winners must claim his/her prize by 12th November 2010. In the event that any winner
does not claim their prize by 9:00am on the above dates, the winner shall forfeit his/her prize
and the next best entry, as judged by the panel of experts, will be awarded the prize at
2:00pm on the above dates. Winners of any unclaimed prize will be notified by phone and email.
They will have their names published in the news feed on the Smirnoff Australia Page
on the Facebook platform on the same date that their unclaimed prize is awarded.
8. To the maximum extent permitted by law, the Promoter shall not be liable for any loss
and/or personal injury suffered by or to the winner and/or his/her friend that occurs as a result
of the winner’s consumption of the prize.
9. The Promoter reserves the right to amend, terminate or temporarily suspend this
promotion if, in its absolute discretion, it considers it necessary to do so, save that the
Promoter shall not exercise this right unreasonably, subject to any written approval from a
relevant Regulatory Authority.
10. The Promoter and event organizers expressly reserve the right to eject any winner
(and/or his/her companion) for any inappropriate behaviour, including but not limited to
intoxication, whilst participating in any element of the prize, or if the Promoter determines, in
their absolute discretion, that a winner is not in the mental or physical condition necessary to
be able to safely participate in the prize.
11. The Promoter reserves the right to exclude any entries which it believes to be fraudulent
or based on misconduct.
12. This promotion and these terms are governed by the laws of New South Wales and are
subject to the exclusive jurisdiction of the courts sitting in this state.
13. An entrant’s personal data will only be held for the purpose of selecting the winner and
will not be used for any other purposes whatsoever without their prior permission. Entrants’
personal information may be disclosed to State and Territory lottery departments and winners’
names published as required under the relevant lottery legislation. A request to access,
update or correct any information should be directed to the Promoter at their address set out
below. Entrants grant the Promoter permission to communicate with them by phone and/or email
in order to provide details of the prize and/or instructions as to how the winner is to claim
the prize and establish his/her entitlement to it.
14. Contest entries and material submitted in connection with this promotion (whether in
written, audio, electronic or visual form, or a combination of those) or any photographs, video
and/or film footage and/or audio recording taken of winners becomes the property of the
Promoter which may use the material in any medium (including internet) and in any
reasonable manner it sees fit. All present and future copyright in any such material becomes
and remains the sole property of the Promoter. Entrants undertake to the Promoter that their
entry is not in breach of any third party intellectual property rights.

meh, another competition with one of my pet hates, more entries for referring friends in a 25WOL or less competition. Still have no idea how this helps if the competition is run properly and all entries are read.
