How to enter
 
To be eligible to receive an entry into the draw, individuals must, during the promotional period, either:
A.         obtain a quote for any Maxxia insurance policy from the Promoter; or
B.         purchase any Maxxia insurance policy offered by the Promoter; or
C.         register their insurance policy renewal details with the Promoter online (including their personal information and the details of their current home or car insurance policy(s), if applicable).
Individuals can obtain a quote and/or purchase an insurance policy by either calling 1800 066 908 (a free call number) or visiting www.maxxiainsurance.com.au, www.maxxia.com.au or www.maxxiacampaign.com.au/insurance and following the provided instructions.
Individuals can register their renewal details with the Promoter (i.e. entry option C) by visiting www.maxxiacampaign.com.au/insurance.
Insurance products are issued by Auto & General Insurance Company Limited (ABN 42 111 586 353 AFSL 285571). Individuals should read any applicable product disclosure statements carefully before purchasing / renewing an insurance policy to ensure the suitability of the product to their needs. Product disclosure statements are available at www.maxxiainsurance.com.au or www.maxxia.com.au.
Terms and conditions

1.         Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.         Entry is only open to Australian residents (excluding NT residents and WA and QLD residents who reside north of the Tropic of Capricorn in WA and QLD except Rockhampton surrounds) aged 18 years or over.
3.         Entries received by purchasing an insurance policy offered by the Promoter (i.e. entry option B) will be deemed invalid if the policy is cancelled, for any reason, before the date of the draw.
4.         Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5.         Multiple entries are permitted provided each entry is submitted separately and in accordance with entry requirements.6.         Incomplete or indecipherableentries will be deemed invalid.
7.         The Promoter reserves the right, in its sole discretion and at any time, to verify and/or determine the validity of any entry and/or any entrant (including, without limitation, an entrant’s identity, age and place of residence). The Promoter may, in its sole discretion, disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
8.         The promotion commenceson 01/10/2010. Entries close 5pm AEST on 31/12/2010.
9.         The draw will take place at the Promoter’s head office, The Tower, Melbourne Central, Floor 19, 360 Elizabeth Street, Melbourne VIC 3000 on 24/01/2011 at 11am AEST. The Promoter reserves the right to draw additional reserve entries and record them in the order drawn in case an invalid entry or ineligible entrant is drawn.
10.       Winners will be notified by telephone and email or mail within 2 days of the draw. The winners’ names will be published in The Australian newspaper on 31/01/2011.
11.       The Promoter’s decision is final and no correspondence will be entered into.

12.       There are four (4) prize packs to be won in VIC/TAS and six (6) prize packs to be won in NSW/ACT/SA/QLD/WA. The first four (4) valid entries drawn from VIC/TAS and the first six (6) valid entries drawn from NSW/ACT/SA/QLD/WA will win a prize pack.

13.       Each prize pack contains a DeLonghi / Nespresso Coffee Machine model number EN 165CW - Citiz with a recommended retail value of AU$369.00 (please refer to the manufacturer’s website for further information and specifications at www.delonghi.com.au/products/product_details.asp?Model=EN165CW), a Nespresso Aeroccino (milk frothing jug) with a recommended retail value of AU$129.00 and 365 Nespresso capsules with a recommended retail value of AU$248.20. Each capsule allows for two coffees to be made. There are 16 different flavoured capsules available. The capsules contained in each prize pack will be selected at random and may not include all 16 different capsules. A year’s supply of coffee is based on an average of 2 coffees (or 1 capsule) per day. No further capsules will be provided.

14.       The total value of each prize pack is AU$746.20. The total prize pool in VIC/TAS is AU$2,984.80 and in NSW/ACT/SA/QLD/WA is AU$4,477.20. The total value of all prizes in the competition is AU$7,462.00.

15.       Any ancillary costs associated with the ownership or maintenance of the coffee machine are not included.
16.       Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.
17.       Each prize pack will be delivered to the winner’s nominated address free of charge. Subject to clause 20, if for any reason a winner does not take delivery of any prize (or any part of any prize) by the time stipulated by the Promoter, then the prize (or that part of the prize) will be forfeited.
18.       If anyprize (or any part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19.       Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. Prizes are not redeemable for cash.
20.       A draw for any unclaimed prizes may take place on 28/04/2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian newspaper on 05/05/2011.
21.       Each entrant consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
22.       If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
23.       The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
24.       To the extent permitted by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or any damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or in connection with the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); or (b) any theft, unauthorised access or third party interference; or (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) any variation in prize value to that stated in these Terms and Conditions; or (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
25.       To the extent permitted by law, the Promoter (including its officers, employees and agents) excludes all statutory or implied conditions and warranties and, subject to clause 24, the liability of the Promoter (including its officers, employees and agents) under any condition or warranty which cannot legally be excluded is, in the case of goods, limited to: (a) the replacement of the goods or the supply of equivalent goods; or (b) the repair of the goods; or (c) the payment of the cost of replacing the goods or of acquiring equivalent goods; or (d) the payment of the cost of having the goods repaired.
26.       As a condition of accepting the prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including, without limitation, any legal release and indemnity form.
27.       A failure or delay by the Promoter to exercise any power or right under these Terms and Conditions does not operate as a waiver of that power or right.
28.       The information about each entrant collected by the Promoter is collected for the purpose of conducting the Maxxia Insurance 2010 Coffee Completion. Unless otherwise advised, the Promoter may also use this information for promotional, marketing, publicity, research and profiling purposes (including sending electronic messages or telephoning the entrant).  The information about each entrant collected by the Promoter may be disclosed to third parties (including the entrant’s employer, the Promoter’s agents, contractors and external service providers, the prize supplier, regulatory bodies, government agencies and law enforcement bodies) for these purposes. If an entrant chooses not to provide some or all of the information requested his or her entry may be invalid. Entrants have a right to access personal information that the Promoter holds about them, subject to any exceptions in relevant legislation.
