CROSS-TITLE CHRISTMAS 2010 SUBSCRIPTIONS PROMOTION
TERMS & CONDITIONS

   1.

      Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

      To enter, entrants must either:

            Visit www.magshop.com.au/xmas or www.magshop.com.au during the promotional period and subscribe/renew online (clearly specifying the name of the magazine they wish to subscribe to/renew). Payment can be made online via credit card or a cheque can be sent to Reply Paid 4967, Sydney, NSW 2001; OR
          *

            Obtain or renew a subscription via telephone on 136 116 (Mon – Fri 8:00am AEST/AEDST – 8:00pm AEST/AEDST, whichever is applicable in NSW). Entrants must quote the promotional code relating to the magazine they wish to subscribe to which can be found online. Maximum cost of call is 55c. Calls from mobile and pay phones may attract a higher rate.
   4.

      If an entrant purchases a magazine subscription on behalf of a friend as a gift, both the gift recipient and the person who ordered and paid for the subscription will receive an entry into the draw.
   5.

      Multiple entries permitted, subject to the following: (a) only one entry permitted per subscription per person (unless otherwise stated); and (b) each entry must be submitted separately and in accordance with entry requirements.
   6.

      Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
   7.

      The promotion commences 25/10/2010 and closes 11:59pm AEDST on 1/2/2011. The draw will take place at ACP Magazines Level 11, 54 Park Street, Sydney NSW 2000 at 11:00am AEDST on 9/2/2011. Winners will be notified by mail and their names will be published on www.magshop.com.au, and in The Public notices section of The Australian on 16/2/2011. The Promoter’s decision is final and no correspondence will be entered into.

      There will be ten (10) prizes on offer to ten (10) individual winners. Each prize is for two (2) people. The first 10 (ten) valid entries drawn will each win a trip for the winner and one (1) guest to enjoy a six (6) night Hawaiian Accommodation package. Each prize trip is valued at up to AU$10,231.78 depending on time of the year trip is taken and the departure point.

      The prize includes:

                  Three (3) day Hertz car hire package on Hawaii’s Big Island.
          *

            The car rental consists of 3 consecutive days car hire (one day equals one 24 hour period) of a Convertible Group U vehicle (Ford Mustang or similar) from Hertz Kona Airport, Hawaii.

            The hire car element of the prize is subject to the following conditions:
                o

                  The driver must comply with Hertz standard license requirements and rental conditions;
                o

                  The hire car element of the prize cannot be exchanged, transferred or sold for cash;
                o

                  The hire car element of the prize cannot be split into separate rentals and refunds on unused days are not permitted;
                o

                  Winner must collect and return car to Kona airport;
                o

                  Unlimited mileage, Loss Damage Waiver (LDW), Liability Insurance Supplement (LIS) and associated taxes and charges are included in the prize; however petrol (gas), additional driver charges and any other optional services, including the tax incurred by these optional services, are not included; and
                o

   9.

      Travel is restricted to the scheduled services of Hawaiian Airlines as follows: Sydney-Honolulu-Sydney. The prize is subject to the following conditions:
          *

            Sydney-Honolulu-Sydney flight taxes and fuel surcharges are included;
          *

            The prize is non-transferrable/non-exchangeable/non-replaceable/non-upgradeable;
          *

            When ready to travel, winner must fax a copy of the completed travel form supplied to them by the Promoter along with the requested dates to (02) 9244 2345;
          *

            Each prize winner and their guest must travel together and share the same itinerary;
          *

            Spring break, Mid June to late August, Thanksgiving and Christmas holiday period are busy periods and bookings may not be available during these periods;
          *

            Changes are not permitted to date/time of flights once booked (unless permitted by the Promoter);
          *

            If the Promoter permits changes to date/time of flights, the winner will be responsible for penalties associated with the changes. Changes to flights, where permitted by the Promoter, are only available for other economy flights. The penalties that apply are as follows:
               1.

                  US$30 for change in dates/time for flights (economy class) to and/or from Honolulu and Hawaii’s Big Island;
               2.

                  US$150 for change in date/time for flights (economy class) to and/or from Sydney and Honolulu;
          *

            Changes in flights (where permitted by the Promoter) are subject to availability;
          *

            Payment for the airport taxes can only be done by cash or agency cheque and will be provided by the Promoter;
          *

            Winners must fax their completed travel form a minimum of THREE (3) weeks prior to their travel date for (electronic ticket) e-ticket issuance. The e-ticket confirmation will be e-mailed or faxed to the address the winner provides on the form;
          *

            All components of the prize must be taken together. Accommodation and flights are subject to availability. The prize is not redeemable for cash and is non transferable or exchangeable;
          *

            Prize is valid through to 14 December 2011 (subject to booking and flight availability), with the following blackout dates: 18-21 February 2011; 27-30 May 2011; 2–5 September 2011; 3-15 October 2011; and 12-26 November 2011.
          *

            All other costs including additional meals, tips, additional transfer fees, excess baggage, spending money, beverages, transport to and from departure/arrival points, additional transfers, taxes (unless otherwise specified), airport charges, insurances, passports, visas, gratuities, excess baggage costs, room service costs, optional excursions whilst on tour and all other ancillary costs are the responsibility of the winner and his/her guest.
          *

            No extension on the validity date of this prize will be permitted. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee at the cost of the winner.
          *

            The winner and his/her guest must be in possession of valid picture ID and proof of citizenship satisfactory to customs and immigration officials.
          *

            Prices quoted are recommended retail and are correct at 25/8/2010 and can be changed at any time subject to market fluctuation. The Promoter and publishers take no responsibility for market price fluctuations.
          *

            All food, beverages, taxes, and other incidental costs incurred by the guest are to be settled prior to departure from, and direct with, the individual hotel.
  10.

      Total prize pool is valued up to AU$102,317.80.
  11.

      If the winner wishes to stay longer than six (6) nights in Hawaii or at an accommodation not nominated by the Promoter, all additional costs incurred will be the winner’s responsibility.
  12.

      The Promoter recommends that the winner obtain travel insurance, however, this is not a mandatory requirement and any costs to do so will be at the winner’s personal expense.
  13.

      If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  14.

      Incomplete, indecipherable, or illegible entries will be deemed invalid.
  15.

      The winner and his/her companion is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations required and travel documentation. The winner (and his/her companion) must depart from and return to the same point of departure and travel together. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The winner may be required to present credit card at time of check in at accommodation. Prize is subject to the standard terms and conditions of individual prize and service providers.
  16.

      Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; and/or (f) participation in the prize/taking of the prize.
  17.

      In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
  18.

      In the event of unforeseen circumstances, the Promoter reserves the right to offer an alternative prize of equal or greater value. In the event of war, terrorism, state of emergency or disaster (including natural disaster), the Promoter reserves the right to either provide an alternative travel prize (including an alternative destination as specified by the Promoter) to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion.
  19.

      It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter at their discretion.
  20.

      Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize or an element of the prize by the time stipulated, then the prize or that element of the prize will be forfeited.
  21.

      If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  22.

      The Promoter may conduct a further draw at the same time and place as the original draw as necessary on 9/5/2011 in order to distribute any prize which remains unclaimed by that date subject to reference to all relevant state and territory regulations and any written directions. Publication of unclaimed prize draw winner will be in the Public Notices section of the Australian on 18/5/2011.
  23.

      The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  24.

      The Promoter reserves the right to verify the validity of all entries and entrants (including an entrants name, age and place of residence) and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

      The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers, to publish the winner's name and locality as required under the relevant lottery legislation and, as required, to provide winner’s information to Australian regulatory authorities without any further reference or payment or other compensation to the entrant. Entry is conditional on providing this information. Travel is restricted to the scheduled services of Hawaiian Airlines as follows: Sydney-Honolulu-Sydney. The prize is subject to the following conditions:

Sydney-Honolulu-Sydney flight taxes and fuel surcharges are included;

The prize is non-transferrable/non-exchangeable/non-replaceable/non-upgradeable;

When ready to travel, winner must fax a copy of the completed travel form supplied to them by the Promoter along with the requested dates to (02) 9244 2345;

Each prize winner and their guest must travel together and share the same itinerary;

Spring break, Mid June to late August, Thanksgiving and Christmas holiday period are busy periods and bookings may not be available during these periods;

Changes are not permitted to date/time of flights once booked (unless permitted by the Promoter);

If the Promoter permits changes to date/time of flights, the winner will be responsible for penalties associated with the changes. Changes to flights, where permitted by the Promoter, are only available for other economy flights. The penalties that apply are as follows:

US$30 for change in dates/time for flights (economy class) to and/or from Honolulu and Hawaii’s Big Island;

US$150 for change in date/time for flights (economy class) to and/or from Sydney and Honolulu;

Changes in flights (where permitted by the Promoter) are subject to availability;

Payment for the airport taxes can only be done by cash or agency cheque and will be provided by the Promoter;

Winners must fax their completed travel form a minimum of THREE (3) weeks prior to their travel date for (electronic ticket) e-ticket issuance. The e-ticket confirmation will be e-mailed or faxed to the address the winner provides on the form;

All components of the prize must be taken together. Accommodation and flights are subject to availability. The prize is not redeemable for cash and is non transferable or exchangeable;

Prize is valid through to 14 December 2011 (subject to booking and flight availability), with the following blackout dates: 18-21 February 2011; 27-30 May 2011; 2–5 September 2011; 3-15 October 2011; and 12-26 November 2011.

All other costs including additional meals, tips, additional transfer fees, excess baggage, spending money, beverages, transport to and from departure/arrival points, additional transfers, taxes (unless otherwise specified), airport charges, insurances, passports, visas, gratuities, excess baggage costs, room service costs, optional excursions whilst on tour and all other ancillary costs are the responsibility of the winner and his/her guest.

No extension on the validity date of this prize will be permitted. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee at the cost of the winner.

The winner and his/her guest must be in possession of valid picture ID and proof of citizenship satisfactory to customs and immigration officials.

Prices quoted are recommended retail and are correct at 25/8/2010 and can be changed at any time subject to market fluctuation. The Promoter and publishers take no responsibility for market price fluctuations.

All food, beverages, taxes, and other incidental costs incurred by the guest are to be settled prior to departure from, and direct with, the individual hotel.

Total prize pool is valued up to AU$102,317.80.

If the winner wishes to stay longer than six (6) nights in Hawaii or at an accommodation not nominated by the Promoter, all additional costs incurred will be the winner’s responsibility.

The Promoter recommends that the winner obtain travel insurance, however, this is not a mandatory requirement and any costs to do so will be at the winner’s personal expense.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Incomplete, indecipherable, or illegible entries will be deemed invalid.

The winner and his/her companion is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations required and travel documentation. The winner (and his/her companion) must depart from and return to the same point of departure and travel together. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The winner may be required to present credit card at time of check in at accommodation. Prize is subject to the standard terms and conditions of individual prize and service providers.

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; and/or (f) participation in the prize/taking of the prize.

In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.

In the event of unforeseen circumstances, the Promoter reserves the right to offer an alternative prize of equal or greater value. In the event of war, terrorism, state of emergency or disaster (including natural disaster), the Promoter reserves the right to either provide an alternative travel prize (including an alternative destination as specified by the Promoter) to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion.

It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter at their discretion.

Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize or an element of the prize by the time stipulated, then the prize or that element of the prize will be forfeited.

If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

The Promoter may conduct a further draw at the same time and place as the original draw as necessary on 9/5/2011 in order to distribute any prize which remains unclaimed by that date subject to reference to all relevant state and territory regulations and any written directions. Publication of unclaimed prize draw winner will be in the Public Notices section of the Australian on 18/5/2011.

The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

The Promoter reserves the right to verify the validity of all entries and entrants (including an entrants name, age and place of residence) and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers, to publish the winner's name and locality as required under the relevant lottery legislation and, as required, to provide winner’s information to Australian regulatory authorities without any further reference or payment or other compensation to the entrant. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Collection, use and disclosure of information collected in connection with this promotion is governed by the Privacy Notice. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
