Terms and Conditions of Entry for the "Ashes Challenge Facebook Quiz" Promotion
1. Information on how to enter and prize details form part of these conditions. Entry into the Promotion is deemed acceptance of these conditions.
2. The promoter is Cricket Australia ABN 53 006 089 130, of 60 Jolimont Street, Jolimont, Victoria 3002 (Promoter).
3. Entry to the Promotion is open to Australian residents who include in their Promotion application a valid Australian residential address (Eligible Entrants). Directors, management and employees (and their immediate families) of the Promoter, and suppliers, associated companies and agencies of the Promoter are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promotion commences at 9.00am AEDT, 19 October 2010 and closes at 5.00pm AEDT 9 November 2010 (Promotion Period).
5. To enter the Promotion, during the Promotion Period an Eligible Entrant must (i) log onto the relevant website located at http://www.facebook.com/CricketAustralia?v=app_161123687240618&ref=ts, (ii) complete (including by providing where indicated an explanation of no more than 250 characters "Why should you win tickets to the Vodafone Ashes Series?") and submit the entry form, and (iii) attempt to answer correctly 10 "History Will be Made" Ashes questions as quickly as possible. Eligible Entrants can enter as many times as they wish, provided each entry completes each of steps (i) through (iii) in this condition 5.6. The winner will be judged at 3.00pm AEDT on 12 November 2010 at Cricket Australia, 60 Jolimont Street, Jolimont, Victoria 3002. There will be one winner. The winner will be the Eligible Entrant who answers the most questions correctly. If there is more than one Eligible Entrant with the same number of correct answers, the winner will be the Eligible Entrant who answered their questions within the shortest time. In the event of two or more Eligible Entrants answering the same number of questions in exactly the same time, the winner will be determined by the judging panel in its sole and absolute discretion to be the Eligible Entrant having the best and most creative answer to the entry question "Why should you win tickets to the Vodafone Ashes Series?".
7. The winner as determined in accordance with the process set out in condition 6 will receive four tickets (general admission to all Test Matches other than the Sydney Test Match, where the four tickets shall be Bronze) to the first day of the 2010/11 Vodafone Ashes Series Test Match of their choice. The prize winner agrees to comply, and ensure that each companion complies, with the ticket conditions which accompany any tickets won in conjunction with the Promotion. Further the winner agrees to comply, and ensure that each companion complies, with the Promoter's Conditions of Entry into the Venue 2010/2011.
8. The prize is not transferable, exchangeable or redeemable for cash. The prize does not include flights, transfers or accommodation, which shall be the sole responsibility of the prize winner and/or his or her companions. The maximum total prize value is $240.9. The winner will be notified by email on 12 November 2010 at the email address provided by the Eligible Entrants on the entry form when entering the Promotion. The prize will be sent to the address specified by the Eligible Entrant on the entry form unless an alternative address is specified at the time that the winner is notified.
10. If the winner of the major prize is under 18 years of age, the prize will be awarded to the winner's parent or guardian.
11. If the prize is not claimed within one week of the date on which the original winner is selected (as set out in paragraph 6 above) or if, after making all reasonable attempts, the Promoter cannot personally contact a prize winner by 5.00pm AEDT on 19 November 2010, that winner's entry will be deemed invalid and the Promoter reserves the right to select the next best validated entry/entries on 19 November 2010 commencing from 5.00pm AEDT at 60 Jolimont Street, Jolimont, Victoria in order to distribute the unclaimed prize, subject to any written directions given by any relevant gaming authority, where required.
12. The winner of any subsequent prize determination (in accordance with paragraph 11) will be notified by email on 19 November 2010.
13. The Promoter reserves the right to disqualify any Eligible Entrant who provides incorrect or fake contact details or who otherwise fails to comply in any respect with these conditions of entry. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. The Promoter reserves the right to disqualify entries if, in the opinion of the Promoter, an Eligible Entrant tampers or interferes with any entry mechanism in any way.
14. The Promoter's decision in relation to any aspect of the Promotion and, in particular the selection of winners, is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries.
15. At the Promoter's request, each winner must participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge. Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome).
16. The Promoter accepts no responsibility for the cancellation of any Vodafone Ashes Series Test Match for any reason beyond the control of the Promoter. The Promoter reserves the right to change or amend the date or location of a match without notice in its absolute discretion.
17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.
18. Any cost associated with accessing the
http://www.facebook.com/CricketAustralia?v=app_161123687240618&ref=ts website is the entrant's responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
19. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use and disclose the information for promotional, marketing, publicity, research and profiling purposes and other purposes set out in the Promoter's Privacy Policy (including sending electronic messages or telephoning the entrant) which is available at
www.cricket.com.au/privacy or by emailing
privacy@cricket.com.au. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
