"nib OUTBACK ADVENTURE PROMOTION 2010"TERMS AND CONDITIONS
1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Entry is open to all Australian residents aged 18 years and over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.Promotion commences on 25/10/2010. Entries close 11:59pm AEDST on 30/11/2010 ("Promotional Period').
4.To enter, individuals must, during the Promotional Period, visit
www.nibmanmuster.com.au follow the prompts to the competition entry page, correctly answer 3 multiple choice questions, and input the requested details including first name, last name, address, email address, mobile number, age bracket, sex, and whether they are an nib customer or not. They must then submit the fully completed online entry form.
5.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6.Entrants are permitted to enter the competition additional times after the initial entry. After the initial entry, 3 additional entries are able to be gained per session by using the 'refer a friend' mechanism, which sends details of the competition to a nominated email address. 1 additional entry will be permitted for each new referral made by the entrant.
7.The draw will be computer-generated and will take place at Anisimoff Legal Suite 1, Level 1, 34 Chandos Street St Leonards NSW 2065 on 06/12/2010 at 1:00pm AEDST. The winner will be notified by both phone and mail. The winners' names will also be published in The Australian on 15/12/2010. 9.The winner must be available to travel between 1/04/2011 and 31/05/2011 and have confirmed all travel bookings prior to 1/03/2011. In the event that for any reason whatsoever the prize winner does not take an element of the prize at the stipulated time by the Promoter, then that element of the prize will be forfeited and cash or product will not be awarded in lieu of that element of the prize.
10.To the extent permitted by law and regulatory authorities, if any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
11.Total prize pool is valued up to AUD$11000. Prizes are not transferable or exchangeable and cannot be taken as cash. The prize does not include all transfers, any meals, spending money or any other ancillary costs. These and any other additional costs associated with claiming or redeeming the prizes are the sole responsibility of the winner.
12.The Promoter's decision as to the selection of the winner is final and not subject to negotiation. The prize can only be claimed by verbal or written acceptance by the winner.
13.A draw for any unclaimed prizes may take place on 07/03/2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner will be notified by both phone and mail and the winner's name (if any) will be published in The Australian on 14/03/2011. In the event that the unclaimed prize draw takes place, the winner of this draw will be given an extension on the deadline for confirming all travel bookings from that mentioned in point 11. The unclaimed prize draw winner will have until 15/04/2011 to confirm all travel bookings related to the prize.
14.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
15.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
