CONDITIONS OF ENTRY (“THE RULES”)
1. Information on how to enter and prizes form part of these Conditions of Entry. Entries not
completed in accordance with the Conditions of Entry or received after close of entry will
not be considered. Incomplete or inaudible entries will be disregarded. The judge’s
decision in relation to any aspect of the promotion is final and binding on every person
who enters. No correspondence will be entered into.
2. The promotion is open to people who are residents of Australia who are 18 years and
over, except for employees of the Promoter, 5th Finger Pty Ltd and their immediate
families, and all companies and agencies associated with this promotion.
3. The promotion commences on Thursday, 4 November, 2010 at 19:30 AEDST and
concludes on Monday, 8 November 2010 at 9:30 AEDST. The draw will take place at 5th
Finger Pty Ltd, Australia Square, 264 George Street, Sydney, NSW 2000 on Monday 8
November 2010 at 10:00 AEDST. The winners will be notified by telephone and mail
using contact details provided in their entry and their name will be published in the public
notices section of The Australian on Thursday, 18 November 2010
4. There are two ways of entering the promotion:
a. 1-90 Call: Participants can enter the promotion by calling and registering their full
name, address and a daytime telephone number on 1902 555 999 Maximum 1-
90 entry cost per message is 55c including GST. Calls from mobiles and pay

b. SMS: Text their full name to 191 999 Maximum SMS entry cost per message is
55c including GST. The SMS entry mechanic is only open to consumers with a
SMS compatible mobile phone connected to a service provider which permits
text messaging to the promotional SMS number. It is recommended that entrants

5. Multiple competition entries are permitted, subject to the following: (a) only one entry
permitted per SMS message or 190 call; and (b) each entry must be submitted separately
and in accordance with the entry requirements.
6. No responsibility accepted for late, lost, misdirected, incomplete or inaudible entries.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants
(including an entrant’/ winners identity, age, place of residence, receipt (for proof of
purchase) and/or if necessary relevant phone bills to determine identification) and to
disqualify any entrant who submits an entry that is not in accordance with these
Conditions of Entry or who tampers with the entry process. Failure by the Promoter to
enforce any of its rights at any stage does not constitute a waiver of those rights.
8. The winner of the promotion will be determined by the first valid entry randomly drawn by
the Promoter.
9. The first (1) valid entry drawn by the Promoter from all entries received will receive the
following prize;
PRIZE DETAILS:
Return economy class airfares from the winner’s closest Australian Major Capital City to Honolulu
for four (4) adults
Return transfers from Honolulu Airport to Hotel in a private car
Five nights accommodation in Honolulu at a minimum of 4 star hotel – two (2) adults per room in
two rooms
60 min Helicopter tour including return transfers between hotel and helipad (maximum passenger
weight limits may apply)
3 hour dolphin snorkeling tour for 4 adults
2 hour surfing lesson for 4 adults
Traditional Hawaiian Luau dinner for 4 adults
$1500 AUD spending money awarded in the form of a cheque made in favour of the winner or
direct deposit to be paid into the winner’s nominated bank account.
10. The total prize package is valued at up to $25,000 including GST (depending on point of
departure)
11. Prices are as provided by the service providers and are correct as of 6 October 2010
12. The Prize must be booked by 4 February 2011.
13. The winner must book at least 60 days prior to travel, no changes allowed within 7 days
of departure and 100% cancellation fee applies
14. All prizes are subject to the standard terms and conditions of individual prize and service
providers If the prize is not redeemed in full by 4 November 2011, the prize will be
forfeited by the winner.
15. Prize is a single event holiday and cannot be separated into different holiday vacations.
16. Availability cannot be guaranteed during Christmas, School holidays and special event periods.
Blackout periods may apply and prize is subject to availability.
17. Travel suppliers/airlines to be chosen by 33 Degrees discretion.
18. Once booking is confirmed, any changes will incur a fee of $150 per person by agent,
including GST plus supplier charges.
19. Travel insurance is compulsory and at the expense of the winner.
20. Winner will be required to sign a prize acceptance form including liability waiver by 16
December 2010
21. It is a condition of the prize that the winner and any traveling companions must comply
with all the conditions of use of the prize and prize supplier’s requirements
22. The winner (and their companion) are responsible for all other expenses including
spending money, meals (unless specified), drinks, transfers (unless specified), laundry
charges, activities (unless specified), incidentals, energy surcharges, gratuities, services
charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance
is highly recommended to protect against the additional costs incurred in the event of
unforeseen circumstances.
23. A credit card imprint or cash deposit will be required from the winner at check-in in order
to board the ship, for all incidental charges. Once accommodation vouchers are issued
they are non-changeable.
24. Unless expressly stated in these terms and conditions all other expenses (including travel
to and from the departure point) become the responsibility of the winner.
25. The prize (or any part thereof) cannot be sold, is not transferable or exchangeable and
cannot be taken for cash. No responsibility is accepted for any variation in the value of
the prize.
26. A valid passport is required for all international journeys. It the responsibility of the winner
and their travel companion to ensure they have all required passports and visas as
required for travel.
27. The four (4) flights must be utilized at the same time, for the same travel dates, to the
same destination.
28. The winner needs to present the original letter announcing their success when redeeming
flight tickets – the letter will be forwarded to the winner. This is a validity issue to ensure
the recipient of the flight(s) and accommodation is the actual winner of the competition.
29. Adequate travel insurance for the duration of the trip must be organised by the winner at
his/her own expense. Meals or tips, transfer fees (other than specified), excess baggage,
government taxes, airport charges and any other personal expenses not specified in the
prize package must be paid for by the winner.
30. If the prize or portion of the prize is unavailable, for whatever reason, the Promoter
reserves the right to substitute the prize for a prize of equal or greater value, subject to
State Regulation.
31. The Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
32. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not
transferable or exchangeable and cannot be redeemed as cash. The prize is not valid in
conjunction with any other offer. The prize is valued in Australian dollars. The Promoter
accepts no responsibility for any variation in the prize value. Prize winners are advised
that tax implications may arise from their prize winnings and they should seek
independent financial advice prior to acceptance of their prize. In the event that a potion
of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption
of that portion of the prize will be subject to the terms and conditions stipulated on the
voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that
has been lost, stolen, forged, damaged or tampered with in any way.
33. The winner and their traveling companions must all be over the age of 18 years old.
34. By entering the promotion via SMS an entrant consents to the Promoter using the their
personal details for the purposes of sending one (1) mobile terminated (MT) reply
message which includes a confirmation of your entry in the promotion AND details of a
special offer made by one of our partners.
35. Prize winners will be notified within 2 days of the end of the prize draw by telephone, and
will also be notified in writing.
36. The Promoter makes no representation as to the safety, conditions or other issues that
may exist at any destination. International travel advice can be obtained from various
sources, including government, local consular offices and the web site of the Australian
Department of Foreign Affairs and Trade.
37. It is a condition of accepting a prize that the winner agrees to be interviewed,
photographed and filmed at any time during the acceptance of the prize by the Promoter
or their agents for a story or feature on this promotion to be developed and featured on
the Nine Network (or any other form of media it deems suitable) without further
remuneration or reference to the participant. Details may feature on Nine Network on a
date to be determined by the Promoters. The inclusion of any such feature (including but
not limited to creative control of the feature) will remain with the Promoter at all times.
38. Participants must ensure that all care is taken when dialing or sending messages to the
promotional number. It is the complete responsibility of the participant to ensure that they
dial or SMS the correct number, in the event that an error occurs the Promoter accepts
no responsibility for either, costs incurred, responses received or all other consequences.
This is the responsibility of the participant.
39. The Promoter accepts no responsibility for any SMS messages not received by the
Promoter or delays in the delivery of the SMS message due to technical disruptions or for
any other reason. An entry will only be counted as being received when it has been
received by the Promoter’s software system, not when it was sent from the handset.
40. If a medical circumstance in some way restricts your ability to enter the competition
through the required mechanic, you are still eligible to enter however you must briefly
state your circumstances upon entry.
41. If your entry is selected as a winning entry, validation of your circumstances/ the validity
of your entry will be undertaken by the Promoter. Method of validation (without limitation)
will be determined by the Promoter in its complete discretion. If the winning entry is
deemed to be a winner, the winner will be notified as per the terms and conditions herein.
In the event that the Promoter requests the entrant to sign any legal documents relating
to the verification of their medical circumstance, the legal documents will take the form
determined by the Promoter. It is a condition of accepting the prize the winner sign any
such legal documentation.
42. The Promoter reserves the right to refuse to allow a winner to take part in any or all
aspects of the prize, if the promoter determines, in their absolute discretion, that a winner
is not in the mental or physical condition necessary to be able to safely participate in the
prize. It is a condition of accepting the prize that the winner may be required to sign a
legal release in a form determined by the promoter in its absolute discretion.
43. The Promoter reserves the right to verify, at any time during or after the closing of the
promotion, the validity of all entries and to disqualify any entrant who tampers with the
entry process, including techniques designed to avoid payment of call costs. SMS
entries via the internet are not valid and will not be accepted. The use of any automated
entry software or any other mechanical or electronic means that permits the participant to
automatically enter repeatedly are not valid and will not be accepted.
44. The Promoter may conduct such further draws at the same time and place as the original
draw as are necessary at 10am AEST on Monday, 14 February 2011 in order to
distribute any prize that remain unclaimed by that date, subject however to all reference
to any relevant state and territory regulations. In the event of a winner in the unclaimed
prize draw, the winner will be notified in writing and their name will be published in The
Australian on Thursday, 17 February 2011.
45. The Promoter is not responsible for any incorrect or inaccurate information, either caused
by the phone user or for any of the equipment or programming associated with or utilised
in this competition, or for any technical error, or any combination thereof that may occur
in the course of the administration of this competition including any omission, interruption,
deletion, defect, delay in operation or transmission, communications line or telephone,
mobile or satellite network failure, theft or destruction or unauthorised access to or
alteration of entries.
46. If for any reason this competition is not capable of running as planned (including but not
limited to) technical failures, unauthorised intervention, fraud or any other causes beyond
the control of the Promoter which corrupts or affect the administration, security, fairness,
integrity or proper conduct of this competition, the Promoter reserves the right in its sole
discretion to disqualify any individual who tampers with the entry process, and, subject to
any written directions given by the various Lottery Departments, to cancel, terminate,
modify or suspend the competition.
47. All entries and other information provided in the course of this competition become the
property of the Promoter and the Sponsor. The collection, use and disclosure of personal
information in connection with this promotion are governed by the Promoter’s Privacy
Notice available from Channel 9 and these Conditions of Entry. The Promoter may use
information it collects in relation to you to provide you with information regarding further
offers, promotions or goods and services provided by the Promoter and/or the Promoter’s

legislation may imply warranties or conditions or impose obligations (collectively
Provisions) in relation to the Promoter’s provision of services to you which cannot be
excluded, restricted or modified except to a limited extent. If those Provisions apply, to
the extent that the Promoter is entitled to do so, the Promoter’s limits its liability in respect
of any claim under those Provisions to, at the Promoter’s option, the supply of the
