Terms and Conditions:1. Instructions on ‘how to enter’ and prizes form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.
2. Entry is only open to residents of Australia and New Zealand who visit okmagazine.com.au during the promotional period. Employees, of the Promoter and their immediate families and companies associated with this promotion are ineligible to enter.
3. The Promoter, in its absolute discretion, reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Incomplete or indecipherable entries will be deemed invalid.
5. To enter, entrants must visit okmagazine.com.au and follow the prompts to submit their entry during the promotional period. Entrants must include their full name, address and daytime contact phone number. Only one entry per person permitted per household. Only one prize per household per entire promotional period permitted for all entrants, excluding SA and ACT.
6. Promotion commences 5th November, 2010 and closes 12 midnight (AEST– AEDST when applicable) on first closes 5th December, 2010.
7. The draw will take place at the Promoter’s premises, 54 Park Street, Sydney, NSW 2000 at 11am (AEST– AEDST when applicable) on 9th December 2010. Winners will be notified by mail using contact details provided in their entry and the names of winners of prizes will have their names published at okmagazine.com.au on 17th December 2010.
8. The Prize Pack available to be won this week is an August Street clothing pack valued at $500 This prize includes the items pictured on the Editor’s Letter page of this issue of OK! magazine. Items included in the prize pack (including but not limited to colours, brands, designs, flavours etc) are determined by the Promoter in its absolute discretion.
9. The Promoter may conduct further draws as are necessary at 11am (AEST– AEDST when applicable) on 17th March 2011 at the Promoter’s premises, 54 Park Street, Sydney, NSW 2000 in order to distribute any prizes unclaimed by that date subject however to any written directions given. In the event of a winner in this draw, winners will be notified by mail and will have their names published at okmagazine.com.au on 25th March 2011.
10. Total prize pool for this issue is $500. Prize values stated are in Australian dollars. Prizes, including any unused portion are not transferable or exchangeable and cannot be taken as cash unless otherwise stipulated. The Promoter’s decision in relation to any aspect of the competition is final and binding on every person who enters and no correspondence will be entered into.
11. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
12. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
13. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
14. In the event that a prize(s) is/are not available, the Promoter reserves the right to substitute prize(s) to the same and equal recommended retail value and/or specification, subject to any written directions from the various lottery Departments.
15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; and/or (f) redemption of a prize.
