      Terms and Conditions

Conditions of Entry - GLAD DEGRADABLE PROMOTION

1. Information on how to enter and prizes forms part of these conditions of entry. By entering, entrants accept these conditions of entry.

2. Entry is open to all Australian residents over the age of 18 years old (as at the date of submitting their entry) that are able to take the prize in the time period set out in condition 13 except directors, management and employees (and immediate families of directors, management and employees) of the Promoter, associated companies and agencies and participating outlets. Immediate family means any of the following: spouse, ex spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.

3. The competition commences on 08/11/10 at 09:00 AEDT and entries must be received by the Promoter at 17:00 AEDT on 31/12/10 (‘Entry Period’).

4. Enter by:
(i) purchasing any product from the Glad® Degradable Plus range during the Entry Period from participating Woolworths and selected independent supermarkets (‘Eligible Product Purchase’);
(ii) registering and completing the online entry form at the competition page on www.bhg.com.au/competitions including entering the barcode number from the Eligible Product Purchase; and
(iii) telling us, in 25 words or less, your answer to the question: “What is your most innovative tip for making your home more environmentally friendly?” as posed in Better Homes and Gardens Magazine cover-dated 03/12/10 – Xmas Issue.

5. One entry per Eligible Product Purchase. All entrants must retain a copy of the receipt as proof to validate each Eligible Product Purchase. Such evidence must, on request by the Promoter, be provided to the reasonable satisfaction of the Promoter, which demonstrates that the winner is an eligible entrant and has complied with these conditions of entry.

6. Entries must include all requested details in the online entry form and a 25 words or less answer to be eligible to win.

7. The Promoter is Clorox Australia Pty Ltd, 36 Gow Street Padstow NSW 2211 (ABN 19 077 194 935).

8. The winner will be the entry that is judged by the judging panel to be the best valid entry, having regard to skill, creativity, innovation and originality. Judging will initially take place by a judging panel at Pacific Magazines to create a short list and the winner will be selected from this short list by a judging panel at the Promoter’s premises on 14/01/2011 at 11:00 AEDT.

9. Total prize value is up to $15,280 (including GST), as at 11/10/2010. The winner will receive:
 4 nights accommodation in a two bedroom ocean front villa at the Eco Beach Wilderness Retreat in Broome including for each of the four people travelling an eco beach sustainability tour and four complimentary yoga classes (one each day of the stay), valued at $4,000;
 Return helicopter transfers from Broome, valued at $2,160;
 Full breakfast daily for 4 people, valued at $480;
 A-la-carte lunch daily (any selection from menu) for 4 people up the maximum value of $640;
 A-la-car e dinner daily (any selection from menu) for 4 people up to the maximum value of $960;
 Private boat fishing charter for 4 people, valued at $1200;
 1 hour massage for 4 people, valued at $400;
 Ocean kayaking tour for 4 people, valued at $360;
 Guided bushwalk for 4 people, valued at $80; and
 Flights from the winners’ nearest capital city to Broome for 4 people which, depending on the winners’ point of departure, is valued at up to $5,000.


10. The winner will be notified by mail and the winners’ name will be published online on the competition page at www.bhg.com.au/competitions on 02/02/2011.

11. If the Promoter, using the contact details provided in the online entry form, is unable to contact the winner to claim fulfilment of the competition prize or if the winner is unable to attend any element of the prize, that winner will forfeit the prize in its entirety and it shall be awarded to the next runner up in the competition as judged by the judging panel. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize. No correspondence will be entered into.

12. Entrants may enter as many times as they like provided they meet the criteria in clause 4 (including making a separate eligible purchase for each entry with a unique 25 words or less statement).

13. Prize must be taken between 15/04/2011 and 09/01/2012. In the event a winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

14. Unless expressly stated in these conditions of entry all other expenses are the responsibility of the winner (and travelling companions) including but not limited to current passports, visas, meals, spending money, transport to and from departure and arrival points, transfers, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, airport taxes (including departure taxes), fuel surcharges, energy surcharges, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges.

15. By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising and relating to the prize, are inherently dangerous
and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.

16. Travel arrangements to and from the winners’ home and their nearest capital city airport do not form part of the prize unless expressly stated in these Conditions of Entry and are the responsibility of the winner and their travelling companions. Eligible Australian capital cities include Perth, Sydney, Melbourne, Brisbane, Adelaide, Darwin, Hobart and Canberra. The winner must travel on the same flights and itinerary as their travelling companions. The travel prize cannot be used as part payment for another airfare package. Frequent flyer miles cannot be accrued on this prize. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations. Travel restrictions & blackout dates apply. Prizes cannot be taken during peak periods or school holidays, and winner must provide all suppliers with a minimum of 21 days advance notice of intention to travel. Embargo restrictions apply during certain periods. Bookings are subject to conditions and availability (including but not limited to capacity limitations and other restrictions).

17. All entrants must submit ONLY their own original answers and works. Any such answers or works cannot be previously published in any forum worldwide. As a condition of entry each entrant grants to the Promoter a worldwide, irrevocable, perpetual and royalty free non-exclusive licence to use all the rights (including without limitation all intellectual property rights such as present and future copyright) in and to the entry (including without limitation the right to modify the content in the entry and to reproduce this content in any media). Each entrant consents to the Promoter using and reproducing the content in their entry in any form, in whole or in part, and distributing or publishing it through any medium. Each entrant also consents to the Promoter doing or omitting to do anything which would otherwise infringe the entrant’s moral rights (including but not limited to using the entry without acknowledgment of the entrant’s authorship). The winner agrees to irrevocably and unconditionally assign to the Promoter all of his/her right, title and interest (including without limitation all intellectual property rights such as present and future copyright) in and to the entry. The winner may be required to enter into an agreement with the Promoter whereby the winner formalises the assignment to the Promoter of all copyright and any other intellectual property rights in the entry and releases the Promoter from any liability arising from the use by the Promoter (or any of its assignees and licensees) of the entry. This contract may include any other provision the Promoter deems relevant. All entries become the property of the Promoter and cannot be returned. Entries that are found to have been derived from the work or designs of a third party will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. The winner may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality, the Promoter reserves the right to take legal action against anyone found to have breached this term.

18. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation are reserved.

19. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and instructed by the Promoter and no compensation will be payable if a winner is unable to use the prize as stated and instructed by the Promoter.

20. The Promoter highly recommends a current residential street address and contact details be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.

21. The Promoter reserves the right to, as a condition of receiving the prize, request that the winner (and their travel companions or, where the travel companions are under the age of 18 years old, the parent or guardian of each of these companions) sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary. This form may include, but is not limited to, a release of the Promoter’s liability and verification of the details provided by the winner including providing proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age, entry and eligibility considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

22. The Promoter reserves the right to rejudge in the event of an entrant, claiming to be a winner, being unable to satisfy these Conditions of Entry.

23. The judges’ decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into. No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed, illegible,
corrupted or misdirected entries or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over mobile telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and its’ associated agencies, and companies associated with this competition will take no responsibility for prizes damaged or lost in transit.

24. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. The Promoter and Pacific Magazines Pty Ltd and their related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winner) and for related purposes which would reasonably be expected without your permission. If the entrant has marked the “opt-in” box on the entry form, the entrant consents to the storage of their personal information for an indefinite period on the Pacific Magazines Pty Ltd’s and the Promoters’ database and each of the Promoter and Pacific Magazines Pty Ltd may use this information for future promotional and marketing purposes regarding their products including contacting the entrant via electronic messaging. If an entrant does not wish to be contacted for these purposes or wishes to access, update or correct any personal information, a claimant should direct these written requests to each of The Privacy Officer, Legal Compliance Department, Pacific Magazines Pty Ltd, 8 Central Ave, Eveleigh NSW 2015 and the Privacy Officer of the Promoter at Clorox Australia Pty Limited of 36 Gow Street, Padstow, NSW, 2211. Neither the Promoter nor Pacific Magazines Pty Ltd sells personal information to other organisations.

25. In participating in the prizes, the winner agrees to participate and co-operate as required in all editorial and promotional activities relating to the competition, including but not limited to being interviewed and photographed. The winner (and travelling companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winner (and travelling companions) will not be entitled to any fee for such use. It is a condition of the winner accepting the prize and their companion’s participation in the prize that the winner and companions sign relevant releases in this regard.

26. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.

27. The Promoter (including its’ officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition including taking the travel prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.

Each prize must be taken as stated and instructed by the Promoter and no compensation will be payable if a winner is unable to use the prize as stated and instructed by the Promoter.

20.  The Promoter highly recommends a current residential street address and contact details be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.

21.  The Promoter reserves the right to, as a condition of receiving the prize, request that the winner (and their travel companions or, where the travel companions are under the age of 18 years old, the parent or guardian of each of these companions) sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary. This form may include, but is not limited to, a release of the Promoter’s liability and verification of the details provided by the winner including providing proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age, entry and eligibility considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

22.  The Promoter reserves the right to rejudge in the event of an entrant, claiming to be a winner, being unable to satisfy these Conditions of Entry.

23.  The judges’ decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into. No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over mobile telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and its’ associated agencies, and companies associated with this competition will take no responsibility for prizes damaged or lost in transit.

24.  All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. The Promoter and Pacific Magazines Pty Ltd and their related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winner) and for related purposes which would reasonably be expected without your permission. If the entrant has marked the “opt-in” box on the entry form, the entrant consents to the storage of their personal information for an indefinite period on the Pacific Magazines Pty Ltd’s and the Promoters’ database and each of the Promoter and Pacific Magazines Pty Ltd may use this information for future promotional and marketing purposes regarding their products including contacting the entrant via electronic messaging. If an entrant does not wish to be contacted for these purposes or wishes to access, update or correct any personal information, a claimant should direct these written requests to each of The Privacy Officer, Legal Compliance Department, Pacific Magazines Pty Ltd, 8 Central Ave, Eveleigh NSW 2015 and the Privacy Officer of the Promoter at Clorox Australia Pty Limited of 36 Gow Street, Padstow, NSW, 2211. Neither the Promoter nor Pacific Magazines Pty Ltd sells personal information to other organisations.

25.  In participating in the prizes, the winner agrees to participate and co-operate as required in all editorial and promotional activities relating to the competition, including but not limited to being interviewed and photographed. The winner (and travelling companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winner (and travelling companions) will not be entitled to any fee for such use. It is a condition of the winner accepting the prize and their companion’s participation in the prize that the winner and companions sign relevant releases in this regard.

26.  Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.

27.  The Promoter (including its’ officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition including taking the travel prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
